1. Under “7. Invoices” it states “A consolidated payment will be made for each specified period." Does this mean the period of performance? In other words: if the Period of Performance is 12/15/2022 to 12/14/2023 does that mean that all work handled between 12/15/22 and 12/14/23 will be paid at the conclusion of the period on 12/14/23?

Answer: Individual Call Orders will specify the period of performance. Invoices are to be submitted after each BPA Call order services & deliverables are rendered.

2. There are four different statements of work, based upon four different types of services requested (EEO Deposition, EEOC Hearing, MSPB Deposition, and Union Grievance), but there is only one Price Schedule per period. Court reporters charge different rates for the four types of proceedings required. So there would need to be a four price schedules per period. Would you just like us to create those or will you be modifying the RFP to add additional pricing charts? (If your intent is to remain with one price schedule note that offerors would be forced to charge for the most expensive type of proceeding of the four required in order to ensure they are not out-of-pocket, otherwise this would be an irresponsible bid).

Answer: Please provide price rates for items listed in the Price Schedule and all other price rates as applicable based on all Statement of Works (SOW) listed in the solicitation.

3. It appears at though, albeit rarely, that the contractor will be required to provide services on national holidays, with no additional compensation. Is this correct? (See page 25):

c. Occasionally Federal holidays will be declared normal training days and full Contractor support will be required.

Notice of this requirement will be given to the Contractor at least one week in advance.

d. The Contractor shall NOT receive premium rates for any special declared holiday for Federal employees (e.g., national day of mourning for death of a former president).

Answer: Section H.27 Holidays, paragraph c & d applies to contractor support for training.

Court Reporters will not be required to work on Federal holidays.

4. Can you clarify what level of security the court reporters will need to be cleared for under this contract? (See page 25)

FLETC FTC-OSPR-17 Badge Application form, U.S.

Customs and Immigration Service (USCIS) Employment Eligibility Verification I-9, Office of Personnel Management (OPM) Declaration for Federal Employment form OF-306, and Federal Bureau of Investigation (FBI) Fingerprint Card FD-258 in order to undergo a suitability background investigation which will be either a fingerprint check, a National Agency Check with Written Inquiries (NACI) or a Minimum Background Investigation (MBI).

1) If an MBI or NACI investigation is required, Contractor and subcontractor personnel will be required to complete a Standard Form 85 (SF 85), Questionnaire for Non-Sensitive Positions, or SF 85P, Questionnaire for Public Trust Positions. An SF 85 is required to be filled out for a NACI. A NACI is performed on Contractor and subcontractor personnel who are considered low risk. An SF 85P is required to be filled out for an MBI. A MBI is normally conducted for Contractor and subcontractor personnel who are in a moderate risk position or have access to Sensitive But Unclassified (SBU) information in all its forms and markings. Individuals in this category include, but are not limited to, those working as educational aides, FLETC Security Police, firearms personnel, explosives handlers, and Information Technology (IT) specialists. In addition, the Contractor should ensure that they have completed an e-Verify search for all Foreign National (FN) Contractor and subcontractor personnel.

8. Litigation Support Package. Is this referring to compatibility with the RealLegal E-Transcript Viewer or services such as Notary, putting together exhibits, etc

Answer: Litigation Support Packages vary based on the Statement of Work. As the needs/support services the government requests may change, it is the discretion of the court reporting agency as to how they list their fees. For example: Some contractors choose to list a litigation support package; however, some choose to break it down by specific services.
