Can you please clarify if CPARS can be utilized in lieu of PPQs for this RFP?

A: The Government will use data provided by each offeror in this proposal and may use data obtained from other sources, i.e., Contractor Performance Assessment Reporting System (CPARS), and/or Past Performance Information Retrieval System (PPIRS), in the development of the confidence assessment. The Past Performance Questionnaire, provided will be one means used by the Government to obtain past performance information.

Can you please clarify the copies that are required? In one place it states copies and another email only.

A: Copies are not required. Electronically submission only.

Q: There was an online meeting on July 28th. Was it mandatory to join that meeting?

A: The site conference was not a mandatory meeting.

Q: Are proposals to be submitted electronically to procurement officer(s) or by mail? Please confirm L.12 alleviates need to mail hard copies. Instructions later in proposal state electronic submission.

A: All proposals will be submitted electronically to Jacquelyn.reed-bush@fletc.dhs.gov

In section M of the solicitation, it states justification is required for coefficients greater than 1.

Why do offerors need to justify their coefficients when it is a competitive bid?

A: Based on the Statement of Work and FAR 15.404-1 ( The contracting officer is responsible for evaluating the reasonableness of the offered prices. The analytical techniques and procedures, singly or in combination with others, to ensure that the final price is fair and reasonable. The complexity and circumstances of each acquisition should determine the level of detail of the analysis required) the coefficient will be evaluated for realism and reasonableness if it is above or below 1.0. The offeror shall provide sufficient justifications in the development of the proposed coefficients. The justification may include, but not limited to, items such as efficiencies in utilizing in-house employees, relationships with local vendors, developed internal processes, etc. that justify a coefficient less than 1.0. The offeror shall also provide sufficient justification for coefficients greater than 1.0 by citing areas such as significant use of subcontract work, costs required to be included in the coefficient under Section B.3, etc. Award will not be made if the Government considers the coefficient to be unreasonable or unrealistic. The objective of this source selection is to evaluate and select the Offeror whose proposal provides the best value to the Government through use of a tradeoff process among price and non-price factors. The non-price factors, when combined, are approximately equal to price.

The below requirements must be included in a coefficient—how would anything less than one be possible if none of the below can be line itemed in the estimate?

1. Prime Contractor’s and subcontractor field overhead

2. Indirect labor with social security contribution

3. Workman’s compensation insurance, FUTA, and SUTA

4. Preparation of as-built drawings

5. Mobilization of field office trailer/dumpster, and laydown area, including setup mailto:Jacquelyn.reed-bush@fletc.dhs.gov

6. Demobilization of field office trailer, dumpster, and laydown area

7. Attending government meetings

8. General and Administrative (G&A) expenses (Home Office Overhead)

9. Company officers and support staff

10. Superintendents

11. Quality control, including daily Quality control reports

12. Submittal preparation

13. On-site Management Expenses

14. Rsmeansonline Cost Data and all applicable updates

15. Incidental engineering services

16. Utility services

17. Material waste allowances for task orders with less than 10 cubic yards of waste (coefficient includes hauling to dumpster at office trailer/laydown area and disposal)

18. Profit

19. Any differences in labor costs between RSMeans Labor rates and applicable The Construction Requirements Statute Wage Determinations (previously known as Davis Bacon.)

20. All requirements in Rsmeansonline Cost Data, excluding those Non Pre-Priced Items identified in Section B.6.

21. All requirements in Rsmeansonline Cost Data line items outlined as “Minimum Labor/Equipment Charge”.

22. Estimating, scheduling, Quality Control and Planning.

23. Protection of furniture and portable equipment that is not required to be moved to perform the work.

24. Initial Performance Bond Premium for Overall Contract A: As stated in the Statement of Work, the coefficient will be evaluated for realism and reasonableness if it is above or below 1.0.

As a follow-up to number 2 above, please confirm that the 24 items listed as part of the coefficient may not be included as a line item in the RS Means estimate provided to the government for review.

A: Confirmed.

Can the government confirm it will audit or review all RS Means estimates provided by the Contractor to ensure it matches that of its internal estimators’ bids?

In Section M of the solicitation, guidance is given regarding proposed coefficients and weights assigned. Can you clarify what the purpose of showing this illustrated example is? The guidance states that the Contractor will propose a coefficient and it will be multiplied by the sum total of the estimated work inclusive OH & Profit within RS Means. No mention of weights is made anywhere—why is it shown on page 175 of Section M.

A: NOTE: The coefficients used in the example are for illustration purposes only.

Do you require Contractors to submit Tier 1 Packet documents 1-5 or is only after award that sponsorship (these forms) would require submission?

A: Submit packets only after award.

Where is the Section K (Reps and Certs) form, you would like signed and returned with the proposal?

A: It is in the Statement of Work in Section K.

Does the government desire a numbered amount in the contractor’s bid guarantee (bid bond)? It is not clear what amount the government wants the Contractor to issue a bid bond for.

A: Refer to the statement of work in Section L.4.

Does an incumbent exist on this type of contract or is this a new contract opportunity with no current 8a or other company on site eligible to renew or propose on this solicitation?

A: This is a new solicitation. As stated in this solicitation notice, PROCUREMENT IS 100% SET-ASIDE FOR Small Business 8(a) firms (FAR 19.8), NAICS Code: 236220, Size Standard 35.5 million.

Will hazardous material disposal and or PPE/engineering services be considered a non-prepriced item?

A: Refer to Section B.6 for description of non-prepriced items.

Please clarify when the payment and performance bonds are due?

A: See Statement of Work Section G.7

Language within the solicitation leads one to believe they are issued on each task order but other language states for the total contract value—would that be $4M per year?

A: See I.17 and Section G.7 to distinguishing between the Bid Guarantee, Payment, and Performance Bond.

Or are bonds required on an individual task order only?

A: See Statement of Work Section G.7

Will all Task Orders have accompanying drawings and specifications provided by the government?

A: Typically yes, but drawings and/or specification sections may not be required for a particular task order.

Does the government intend to share Revit or CAD files with the Contractor?

A: Yes, if this software was used in developing the drawings at task order level .

H.40 states that the Contractor must have a designated Safety Representative on site for the contract. He or she cannot be the QCM—can the PM or the Superintendent act as the Safety Representative?

A: Yes.

May the contractor include traffic control supplies/rentals as part of its line item costs for any site or roadway work?

A: Yes.

The solicitation states that Contractor must provide written verification from RSMEANSONLINE if an item does not appear in the database—does the government mean RSMeans must issue a statement or email, or the Contractor must attest and submit a letter that it cannot find the item within RSMeans online?

A: Contractor must attest and submit a letter.

RSMeans updates quarterly, not annually. It is well known that RS Means does not receive updates on every line item each quarter, thus it is important to consider updates to RS Means quarterly vice annually. Would the government consider accepting updated data each quarter vice annually. It could be detrimental to the Contractor should prices not reflect accurately due to update cycles by RS Means/Gordian.

A: Correct, RS Means is updated quarterly. The contractor shall update their RS Means database on a quarterly basis.

Are standard Union Rates utilized or open shop? Utilizing Construction Requirement Wages (Davis Bacon) type wages would require use of Standard Union wages to provide parity. Please clarify--labor differential is required to be part of the coefficient, but this does not reconcile the two types of labor available for selection within RS Means.

A: Use open shop. Note that the Davis Bacon Act requires that all contractors and subcontractors performing construction, alteration, and repair (including painting and decorating) work under federal or District of Columbia contracts more than $2,000, pay their laborers and mechanics not less than the prevailing wage and fringe benefits for the geographic location.

Is the government utilizing new construction figures or renovation figures within RS Means?

A: Commercial new construction.

Are utilities available on site (electric/water); if not, will the government supply hookup from local public works department--Number 16 on Page 12 states Contractor is responsible for utility services, but this is a government site. What do we need to consider here and is this something that can be line itemed in the estimate or does it have to be included in a job to job coefficient calculation?

A: Refer to Section C.15.

Please clarify when incidental engineering services would not be included in the base bid?

Engineering services are part of RS Means data and should be part of the scope of work if any engineering is required.

A: Incidental engineering services are typically found within the specification sections.

Some examples are Section 05 40 00 para. 1.6.2, Section 07 41 13 para. 1.4.1, and Section 08 51 13 para. 1.4.3.

Can the government clarify B.5 further by providing a better range of project values? $2,000.00 to $1,000,000 is a wide range and this directly affects the coefficient calculation. For instance, can you provide a range such as 30% of projects fall below $10,000.00 and last 1 month or less.

30% fall between $10,000 and $100,000 and last 1-2 months. 30% between $100k-500k and last 2-3 months, etc.

A: At this time, the Government does not have a database of project values.

Section II, Management Approach asks for a management approach; however, the description provided below does not relate to a management approach and is repeated within Section III (1).

Please provide updated instructions for number 2.

A: Section L, tells you what the Government is looking for in the proposal. Section M repeats how the Government will use the evaluation factors in each proposals.

Please confirm that Primary personnel can be named in alternate positions in the event Contractor/Government need to plus up or rearrange personnel to better fit projects. The intent is to provide adequate coverage and flexibility to bring approved alternates in as primaries where existing primaries can be shuffled to other duties on site.

Verbiage for the Non-Pre-Priced Coefficient in Section B says, “Coefficient for Non-Pre-Priced Items,” but the SF1442 lists the NPP verbiage for each period as “Coefficient for Non-Pre-Priced Items For Other Than Normal Working Hours”. Can this be clarified as to which is expected in our submission?

A: Clarification has been made on the corrected SF1442 (attached) To be read as follows:

SECTION B - SUPPLIES

OR

SERVICES/PRICESITEM

Specification 011400 Section 1.4.1 says “Work under this contract is restricted to U.S. citizens.”

Earlier the security and access requirements under Section H.29 allowed Foreign Nationals to work on projects. Please clarify as to which applies?

A: Foreign Nationals are permitted as detailed in Section H.29.

The solicitation states that multiple copies of our proposal submission are due. Are those copies still pertinent for an electronic submission?

A: Only one copy. Electronic submission only.

Electronic submission only.

Section L Page 164 Part A of the solicitation states for each “Project Manager and Project Manager Alternate:”, “Project Superintendent and Project Superintendent Alternate” and “Quality Control Manager and Quality Control Manager Alternate” “resume shall clearly demonstrate experience and skillset of the individuals proposed…”. However Section M Page 171 Factor A states “Provide resumes for the proposed key personnel of the prime contractor including project manager, project superintendent, and quality control manager.

QUESTION 1: Can the Government clarify if it would like us to submit a total of 3 resumes for each: Project Manager, Project Superintendent & QC Manager? Or would the Government like us to submit a total of 6 resumes for each: Project Manager, Project Manager Alternate, Project Superintendent, Project Superintendent Alternate & QC Manager and QC Manger Alternate?

This question is very important due to the 30 page restriction on the Technical Proposal.

A: Provide resumes for all six personnel to include alternates.

Section L Section II Technical Proposal Page 165 Section 2 states “Offerors must provide information on five (5) relevant contracts…” but does not list what specific information they want for each project. Solicitation only lists Management Approach bullet points on Pg 172 that must be addressed.

QUESTION 2: Does the Government want us to provide the same information in the Technical proposal, on our five relevant contracts, that we are also providing in our past performance proposal? Or are we only required to list information on our five (5) relevant contracts in the Past Performance Proposal and limit the Technical proposal to Part A Key Personnel Resumes and Factor B Management Approach (bullet points listed on Pg 172?

A: Yes, provide in both. There are different teams evaluating sections. Best Value is recommended on your submission.

The solicitation states that this proposal shall be emailed however, Page Number 162, Section L.12 lists how many copies of each volume must be submitted.

Question 3: Can the Government clarify that Offeror is to submit one electronic file for each volume? i.e. Section I RFP Proposal, Section II Technical Proposal, Section III Past Performance Information & Section IV Price Proposal A: Yes, submit an electronic file for each volume. The Government have different evaluators.

PPI# Section/Page

Paragraph Question

1 Section L, Pg.

and Section M, Pg. 170

Management Approach

Section L Instructions, Conditions, and Notices to Bidders and Section M Evaluation Criteria are in conflict.

Section L - Section II Refers to Part A and Part B.

Thereafter, Part A.1 is Key Personnel and A.2 is Management Approach; however, there is no Part B.

Section M Evaluation Factors for Award is titled Factor A, Key Personnel and Factor B, Management Approach.

Should contractors refer to Part A and Part B to meet the criteria, and if so, what would be included in Part B, or should we refer to Factor A and Factor B?

Please clarify.

Answer Factor A: Key Personnel

Factor B: Management Approach

Factor C: Past Performance

2 Section L, Pg.

and Section M, Pg. 171

Management Approach

Section L Instructions, Conditions, and Notices to Bidders and Section M Evaluation Criteria are in conflict.

Section L – 2. Management Approach states “Offerors must provide information on five (5) relevant contracts that are active or have been completed within the past three (3) years that demonstrate the Offeror’s ability to perform the proposed effort.

Section M Evaluation Factors for Award Factor B Management Approach states, “Offerors’ will address the following:

• Approach to multiple open task orders. Discuss the overall organizational structure to manage multiple task orders with concurrent periods of performance.

• Self-performance capability. More self-performance is favored over subcontracting. Self-performance of trade within the similar projects is favored over unrelated work.

• Working with the stakeholders, shops representatives and occupants during repair/renovation. Management activities typically occur during normal working hours as not to disrupt occupants.

• Approach to Construction Scheduling on multiple projects

• Approach to Construction Quality (Quality in Construction) on multiple projects

• Experience in RS Means

Is it the Government’s intent that contractors provide relevant projects in this section as stated in Section L or provide a management approach narrative as stated in Section M?

Please clarify.

A: Section L contains instructions for the proposal—everything from required organization and content.

Section M, Evaluation factors for award.

Identify all significant factors and any significant subfactors that will be considered in awarding the contract and their relative importance

Is there an example project that the coefficient could be calculated off of?

A: No.

There appears to be inconsistencies in the RFP language regarding whether annual or quarterly RSMeans updates will apply to this solicitation. Please clarify whether quarterly or annual updates apply and when will those updates go into effect. See below for examples of these inconsistencies:

See examples: a. SAM.GOV: Individual task order prices will be based on pre-established prices for materials in place contained in the R.S. Means Facility Construction Cost Data book (updated quarterly) with the application of coefficients established result of the solicitation.

b. Sec B, Pg 9: The current edition of the Rsmeansonline, Facilities Construction Data, at the time of contract award, shall be used. At the beginning of each calendar year, within 30 days, the new edition of the Rsmeansonline Cost Data will be automatically incorporated into the contract.

c. B.2: Services for the Base period (and subsequent option periods, if exercised) shall be at the unit prices specified in RS Means online Cost Data, (annual update at time of proposal development)

d. B.3.3.b: “… Column of the Rsmeansonline Cost Data, current edition at time of award …”

e. B.3.3.f: “No adjustment to coefficients will be made to the contract as a result of incorporation of new Wage Determinations, since any change in labor costs caused by inflation/deflation will be accounted for by incorporation of the current edition of Rsmeansonline Cost Data each January and published quarterly updates.”

f. C.6.c(1): “The current edition of the Rsmeansonline Cost Data at the time of contract award shall be used. At the beginning of each calendar year, within 30 days, the new edition of the Rsmeansonline Cost Data or will be automatically incorporated into the contract.”

g. C.17(b): The Contractor will also furnish for their own use the Rsmeansonline Cost Data, edition current at time of award, and subsequent years during the life of the contract, and be https://urldefense.us/v3/__http:/SAM.GOV__;!!BClRuOV5cvtbuNI!W-5sC5XKe2FlierNMiKywX5E8A_VIE2qkzZiLk-KMQxCWA4vwP465XRkiPMXP8adh9vxahVMCrbXGZE$ responsible for obtaining quarterly updates.

h. Section M, Page 175: “Any changes in prices due to inflation/deflation and required labor rate increases pursuant to Davis Bacon Wage Determinations will be accomplished by incorporating the new edition of the R. S. Means Cost Works, Facilities Construction Data … Construction Cost Data. R.S. Means Facilities Construction Cost Data will be automatically be updated quarterly.”

A: Quarterly updates are required.

2. Sec L.12 for the Price Proposal indicates a requirement to provide rationale and justification for proposed coefficients. It requires “any pricing information to substantiate coefficient development…be provided via electronic format in MS Excel.” Can this requirement be submitted in narrative format, since much of the requirement will be verbiage, not purely numerical?

A: The Government does not advise how a contractor should submit their proposal. The Government is looking for proposal that provides the best value to the Government.

3. Sec L. Section III (3) states "Offerors shall include two additional pages (8-1/2 x 11 page with .5" margins), in spreadsheet format, that simply list all contracts that the offeror is performing or has performed in the past three (3) years." Does this refer to IDIQ/JOC type contracts or contracts for individual projects in totality?

A: Please read Section III when it talks about “…Relevant contracts are those of similar size, type, and complexity to the proposed effort.”

4. Sec L. Section III (5) states "The offeror shall send out - and track the completion of - the Past Performance Questionnaires to each of the offeror's critical subcontractors, teaming contractors and/or joint venture partners (i.e. each entity's) Points of Contact POCs identified." What is meant by "critical subcontractor"?

A: Typically, a sub-contractor that have performed majority work on any project.

5. Both Sec L. Section II: Management Approach and Section III: Past Performance state "Offeror's must provide information on (5) relevant contracts that are active or have been completed within the past three (3) years that demonstrate the offeror's ability to perform the proposed effort. Relevant contracts are those of similar size, type, and complexity to the proposed effort."

Under which section are we to address this or should we duplicate answers for both sections?

A: For each section, there will be different evaluators looking at a company proposal. It is advised to submit what is required for each section.

6. Please provide the total annual dollar volume of projects awarded under the current (expiring) IDIQ for the last five years.

A: At this time, the Government does not have a database for the total annual dollar volume, the previous contract was award with the aggregate value not to exceed $16.5M.

7. Sec L. Section III (6) What specific variables is FLETC looking for Offerors to track within the PPQ Tracker Document?

A: The purpose of the spreadsheet is to capture the total scope of work (whether the offeror deems the work relevant or not to this instant RFP) that the offeror has ongoing or completed in the past three (3) years.

8. Once awarded, will individual project requirements be issued from a single point of contact or will project requirements come from multiple users/contacts?

A: Multiple users/contacts.

Can CPARS be used in lieu of PPQs?

A: The Government will use data provided by each offeror in this section and may use data obtained from other sources, i.e., Contractor Performance Assessment Reporting System (CPARS), and/or Past Performance Information Retrieval System (PPIRS), in the development of the confidence assessment. The Past Performance Questionnaire, provided as Attachment, will be one means used by the Government to obtain past performance information.

Please confirm that the personnel expected on site each working day are a Superintendent (Sup), Project Manager (PM), and Quality Control Manager (QCM) and that the alternates of each of these positions are only expected to be onsite when the primary Sup, PM, or QCM is not present.

File details come from the government source that posted it. Updated .
