(f) Year of funding: 2019
(g) Solicitation number: 70LGL Y l 8RGLB000 18
(h) Background information about the requirement: In 2016, FLETC conducted a source selection for these services which resulted in a protest by the incumbent contractor. The agency terminated the new award and issued a new bridge contract to the protestor to ensure coverage during the protest and ultimately decided to take corrective action. That bridge contract was awarded on June 29, 2016 for a one-year period of performance. However, due to the actions required to complete the corrective action and conduct a new source selection, that bridge contract was extended three times for a total of 15 additional months.
The source selection for these services c01mnenced with an award decision on September 7, 2018, and FLETC received congressional authority to make award on September 19, 2018. The contracting officer issued post-award notices to all offerors on September 20, 2018. One vendor, a joint venture that includes the incumbent contractor as a minority pattner, filed a protest on September 25, 2018. FLETC believes the protest is baseless and intends to file a summary motion with GAO requesting it be dismissed. That request, however, cannot be submitted in time to be resolved prior to the intended sta11 date of the new contract, so a bridge contract is required to continue these mission critical services. FLETC needs contractual coverage for at least I 00 days to complete the GAO protest period.
(3) Description o(Supplies/Services. The Contractor shall provide the management, supervision, and all personnel, equipment, tools, materials, transpo1iation, supplies and services necessary to perfonn uniform, equipment issue and laund1y supp011 services at FLETC, Glynco GA. The uniform, equipment issue and laundty services include planning, scheduling, repmt preparation, establishing and maintaining records, and quality control. The contract action will be for a 4-month period to allow time for resolution in response to the aforementioned GAO protest. The period of performance shall commence October I, 2018 ending J anua1y 31, 2019. The funding for this contract action has been approved for four months inclusive of all services under PRS 19SSD0012A, subject to availability of funds, with a not to exceed total amount of
(4) Identification ofStatutoryAuthority Permitting Other than Full and Open Competition. The statutory authority permitting other than full and open competition is 41 U.S.C. 3304(a)(l) implemented by the Federal Acquisition Regulation (FAR) Subpart FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The period of performance shall not exceed four months which is the anticipated amount of time necessaty to allow for GAO decision on GAO Protest
B-416402.2.
(5) Demonstration that the Nature of the Acquisition Requires use of the Authority Cited. A GAO protest requires an automatic CICA stay of the protested contract, but does not guarantee the incumbent contractor the right to continue petforming the services during the stay period. These services are in the 8(a) program, but the incumbent contractor graduated from the 8(a) program approximately two years ago and therefore is no longer eligible to petform these services under contract. As discussed previously, a source selection for these services with updated requirements completed recently, and United Global Group, which is a small disadvantaged 8(a) contractor, was the lowest priced, technically acceptable offeror in accordance with the solicitation evaluation factors. Therefore, they are the only contractor determined to be eligible for these services under a new bridge contract during the protest period. The only other option would be to discontinue these services. However, they are critical to the mission of FLETC and must continue. This contract provides suppmt activities through the issuance of uniforms and equipment for the students, and
