About this file

This is a Sole Source Justification (SSJ) document for a simplified acquisition below the simplified acquisition threshold, submitted by the Federal Emergency Management Agency (FEMA) on May 18, 2026, under PR Number FN00543Y2026T and SSJ No. 26-079.

FEMA is procuring ongoing trash removal services for the Kilohana Group Site and three micro-sites (180 Dickenson St, 730 Luakini St, and 840 Waine'e St) in Maui to support disaster recovery operations for DR4724HI. The period of performance runs from May 22, 2026, through November 21, 2026. The procurement is structured into two CLINs: CLIN 3001 covers delivery and rental of 168 ninety-six-gallon trash bins with twice-weekly garbage pickup service at the Kilohana Group Site, while CLIN 2002 covers delivery and rental of six four-cubic-yard containers and two three-cubic-yard containers with twice-weekly pickup service at the three micro-sites. The total 6-month anticipated cost for both CLINs is redacted in the document.

The justification for sole source procurement is based on only one source being reasonably available. Maui Disposal Company Inc. is identified as the incumbent contractor under existing PO 70FBR925P00000005 with established routes, equipment placement, and dedicated workforce serving these sites. The rationale emphasizes that continuity is essential to prevent service disruption, health hazards, and pest infestations. The document notes that Maui continues recovery from 2023 wildfires, many local waste management businesses remain non-operational or closed, and local landfills are overwhelmed by reconstruction debris, leaving insufficient capacity among local competitors. Price fairness and reasonableness will be determined through market research and comparison to the Independent Government Cost Estimate (IGCE), with proposed pricing consistent with current contract rates and comparable market rates for trash removal services in Maui County.

___X______Only one source reasonably available.

_________ Urgent and compelling circumstances exists.

_________ Exclusive licensing agreement exists.

_________ Brand name. If the brand name requirement applies to a portion of the procurement, please identify that portion.

_________ Industrial Mobilization _________ Other. Explain:

Continuity of trash removal services is essential to ensure uninterrupted operations, health, and safety at FEMA-managed group and micro-sites. Any disruption could lead to accumulated waste, health hazards, pest infestations, and increased operational costs. Maui Disposal Company Inc. is the incumbent contractor providing both bin and dumpster services under PO 70FBR925P00000005 and has established routes, equipment placement, and workforce dedicated to the Kilohana Group Site and micro-sites.

The island of Maui—particularly Lahaina—continues to recover from the 2023 wildfires. Many local businesses remain not fully operational, and some have permanently closed. The local waste management sector has been significantly stressed by ongoing home rebuilding and large-scale debris cleanup. Maui’s landfills were designed for normal daily waste from the local population. Due to the increased volume from debris and reconstruction, these facilities are overwhelmed and local municipalities have had to improvise with temporary dump sites. Under these conditions, there are little to no other known local businesses with sufficient capacity to meet the sustained demand for trash removal services at the FEMA group sites.

Attempting to transition to a new provider at this stage would introduce significant risk of service disruption, jeopardize public health and safety, and potentially compromise FEMA’s direct housing mission. Maui Disposal Company Inc. is the only responsible source currently capable of providing continuous, compliant service through the end of the required period.

3. The anticipated price will be determined fair and reasonable based on one or more of the price analysis techniques described below. (Check one or more and provide short explanation and description of action taken):

_________ Current price List.

_________ Comparison with similar items in a related industry.

____X_____ Comparison to IGCE.

_________ Contracting Officer’s personal knowledge.

_________ Other.
