U.S. Department of Homeland

Security

FEMA Region IX

1111 Broadway, Suite 1200

Oakland, CA 94607-4052

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION FOR

ACQUISITIONS NOT EXCEEDING THE SIMPLIFIED ACQUISITION THRESHOLD

Joint Field Office – DR-4407-CA Wildfires (2018)

(Per 41 U.S.C. 1901)

In accordance with Federal Acquisition Regulation 13.106-1(b) (1), 13.501 (a) (1) (ii), and FAR 6.302-2, I hereby determine that the Activation of Travel Trailer Services in support of DR-4407-CA is needed under FAR 6.302-2 Unusual and Compelling

Urgency.

1. Agency and Contracting Activity. The Department of Homeland Security, Federal

Emergency Management Agency, Region IX, Disaster Declaration DR-4407-CA proposes to award contract on a basis other than full and open competition.

2. Nature and/or Description of the Action Being Approved.

(a) Type of action: Firm-fixed price contract

(b) Amount: $4,805.00 with a Base and All Optional Quantities up to: $20,967.50

(c) Type of funding: Disaster Relief Fund

(d) Year of funding: FY2019; and

(e) Other brief description: FEMA intends to award a contract to procure on an other than full and open competition basis under Unusual and Compelling Urgency activation transportation and installation services of up to twenty (20) travel trailers over a two (2) week period while a long term contract is being competed.

3. Description of Supplies/Services. DR-4407-CA Wildfires (2018) was declared on November 12, 2018 and a Joint Field Office (JFO) was set up in Sacramento, CA for proximity to California State

Office of Emergency Services (OES). There is a requirement for activation services of up to twenty (20) travel trailers for up to two (2) weeks. This is short term contract to provide services while a long-term contract can be placed. Once a housing mission is approved, Region IX has a goal of getting survivors into temporary housing within thirty days. As such, as a “stop-gap” measure, this requirement is to activate travel trailers, which includes transportation from the staging yard and set up at the parking location, that are already available until a larger long-term contract is awarded.

4. Identification of Statutory Authority Permitting Other Than Full and Open

Competition. The statutory authority permitting other than full and open competition is 41

U.S.C.3304 (a) (1) implemented by the FAR Subpart 6.302-2 entitled “Unusual and Compelling

Urgency.”

5. Demonstration that the Nature of the Acquisition Require Use of the Authority Cited. In an effort to ensure the Wildfire survivors are placed in temporary housing as soon as possible considering the changing weather, holidays, and goal to get housing in place as soon as possible in the first thirty days this contract is being issued while a larger, more encompassing contract is being competed among the FEMA Log HOUSE vendors.

6. Description of Efforts Made to Ensure that Offers are Solicited from as Many Potential

Sources as is Practicable. Under DR-4344-CA Wildfires (2017) two vendors were used to activate travel trailers: Stier’s RV Centers LLC and MLU Services. Stier’s RV was the lower priced vendor and is known to be capable for these services. As this is a short term contract, the longer term contract is being competed.

7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable. The contracting officer has determined that pricing for these services to be fair and reasonable based on: the previous purchase order, 70FBR918P00000144 that was awarded for similar work under DR-4344.

8. Description of Market Research. Stier’s RV is a known vendor that has previously performed work with FEMA for these services. Due to the Unusual and Compelling Urgency of this requirement, this historic knowledge was used as market research. MLU Services also has a contract with FEMA to activate Mobile Housing Units (MHUs), however this is at a greater cost because an MHU activation is a more difficult process.

9. Any Other Facts Supporting the Use of Other Than Full and Open Competition. The

Contracting Officer finds it to be in the best interest of the Government to issue an award to

Stier’s RV in order to provide the required support to activate travel trailers to house survivors.

Additionally, this is a short term contract to be placed while a long term contract can be competed.

10. A Listing of the Sources, if Any That Expressed, in Writing, an Interest in the

Acquisition. N/A.

11. A Statement of the Actions, if Any, the Agency May Take to Remove or Overcome Any

Barriers to Competition Before Any Subsequent Acquisition for Supplies or Services

Required. There is a long-term contract that will also be placed through competition.

12. Contracting Officer’s Certification. I certify that the data supporting the recommended use of other than full and open competition is accurate and complete to the best of my knowledge and belief.
