About this file

This is a Questions and Answers document addressing clarifications on a Federal Emergency Management Agency tree removal solicitation (70FBR126Q00000003) issued as a Firm Fixed Price Purchase Order set aside for 100% Small Business.

The Q&A addresses key scope and payment clarifications: FEMA will mark trees for removal prior to performance start, with details provided in Attachment 3; the access road requirement is limited to 8-foot-wide vegetation and tree clearing only, with no grading or surface improvements; removed tree stumps should be cut flush; fire road work is also limited to vegetation clearing without grading or improvements; and progress payments will be made upon completion of all work rather than monthly invoicing. The document also clarifies that several FAR clauses were inadvertently included in the original solicitation and have been removed, including FAR 52.226-5 (Restrictions on Subcontracting Outside Disaster or Emergency Area), FAR 52.226-4 (designated area identification), FAR 52.212-3, FAR 52.212-5, and FAR 52.219-14 (Limitations on Subcontracting). The Q&A confirms that the outdated FAR provisions 52.212-3 and 52.212-5 are no longer effective due to the Revolutionary FAR Overhaul.
