MARAD / FEMA PUERTO RICO/USVIRGIN ISLANDS HURRICANE MARIA RELIEF

AFLOAT MESSING AND BERTHING REQUIREMENT

Statement of Work

6 OCTOBER 2017

In response to the extensive damage caused by Hurricane Maria in Puerto Rico, the Federal Emergency Management Agency (FEMA) requires multiple commercial vessels to provide, after fitting out, at the earliest possible date in Puerto Rico (PR) /US Virgin Islands (USVI)

A floating housing facility, with Berthing and Hotel Services (all meals including Boxed/bagged lunches as required, drinking water, wash water, restroom facilities, laundry, power, climate control, waste disposal, onboard and gangway security, dining space(s), break room(s), etc. for up to 6000 FEMA approved personnel. The initial requirement is for a minimum period of 30 days onsite with the option for FEMA to exercise, at its sole discretion, multiple additional 14 day increments in the following ports:

FEMA reserves the right to direct the vessel to a different port in PR/USVI at or after contract award or during the period of performance.

FEMA requires delivery of the proposed vessel(s) no later than 10 days after contract award. Delivery means the ship is fully operational including the ability to accept passengers.

U.S.-flag vessels with adequate berthing capacity to meet FEMA requirements will be given priority.

Foreign-flag vessels permissible with U.S. crew if no U.S.-flag vessel can meet the urgent technical requirement. Foreign-flag vessels with foreign crew may be permitted in the absence of suitable U.S.

options. Vessels that are not coastwise qualified cannot be used in transportation of passengers or cargo domestically.

Vessels of less than 250 bed capacity may be considered but only vessels with a passenger berthing capacity of one hundred (100) passengers or more will be considered technically qualified. Multiple vessels are envisioned and cruise ships, offshore construction vessels, and berthing barges may all be chartered under this requirement. Draft restrictions may apply.

FEMA will inspect all ships before award is made.

Technical Requirements

Contractor shall provide:

1. Commercial berthing vessel or vessels, which include either self-propelled vessels or barges, suitably classed, certified, fitted, crewed and supervised for the messing and berthing of a high number of berthing passengers (no fewer than one hundred per vessel).

2. Period of Performance shall be for a minimum period of 30 days onsite with the option for the government to exercise, at its sole discretion, multiple additional 14-day option periods.

3. Vessel must be on site at the FEMA designated port, fully operational and ready receive emergency responders on board as soon as possible after contract award.

4. Maintain vessel classification, all applicable certificates required by - USCG (or the flag state), USCG port state controls (for foreign flag vessels), applicable international maritime conventions, and any applicable US regulations; and promptly correct all deficiencies during the period of performance of this contract. This includes, but is not limited to:

a. USCG (or equivalent foreign flag sate) Certificate of Inspection

b. International Load Line Certificate

c. Safety of Life at Sea (SOLAS) Passenger Ship Certificate

d. Classification Society Class Certificates

e. Certificate of Financial Responsibility (COFR) and a Non-Tank Vessel Response Plan (NTVRP).

i. Foreign flag vessel must be able to obtain this before contract award or Notice to Proceed.

f. All officers must have current USCG or STCW required licenses, credentials and endorsements. All crew must have current USCG or STCW required credentials and endorsements.

g. All other certificates required by US regulations or international maritime conventions

h. Vessel certificates must have been issued by the flag state and/or a member of the International

Association of Classification Societies (IACS).

i. If foreign flag vessel, contractor shall obtain satisfactory United States Coast Guard (USCG) port state inspection before contract award or Notice to Proceed.

5. Maintain all firefighting, lifesaving and emergency equipment in proper operating condition.

6. Adequately trained and licensed and vessel officers and crew to comply with vessel certificate requirements and provide the services listed in this Statement of Work.

a. Crew must be fully trained in Lifesaving, Firefighting, crowd control, and crisis management.

7. Messing adequate for the bed capacity of the vessel or vessels with provision for multiple meal sittings as needed. Three hot meals per day and a midnight ration for 24-hour workers is the minimum messing requirement. Vessel must arrange to provide hot dinner as late as 2030 to emergency responders who may return late to the vessel. Vessel must have capability to provide boxed lunches as required.

8. Full linen service (including towels, soaps, shampoo - like hotel) commensurate with the total bed capacity.

a. Adequate change of linen – minimum weekly

9. On board Laundry services for passengers as required.

10. Housekeeping services to ensure vessel and all areas open to passengers are maintained in a clean, sanitary condition always.

a. All messing areas, sleeping areas and entertainment areas shall be cleaned daily as a minimum.

11. Vessel must be capable of providing its own electrical power. Shore power may not be available.

12. Purchase and arrange for fuel and potable water deliveries to the vessel in quantities required.

13. Vessel must provide positive access control and track each arrival/departure of all passengers to ensure personnel accountability – so that Vessel Master/Person-In-Charge knows at all times who is on board and can ensure their safe evacuation in case of any emergencies.

14. Ensure safety of all passengers at all times.

15. Provide mandatory Vessel Safety and Familiarization Brief to all passengers within 2 hours of their first arrival on board vessel. Contractor will track this on daily basis and submit training logs to FEMA weekly.

a. The brief shall include vessel safety procedures, safety alarms, evacuation procedures, and familiarization of all vessel spaces open to passengers.

b. The brief will be designed for passengers who are totally unfamiliar with vessels and shipboard environment.

c. Contractor shall submit their Vessel Safety and Familiarization Brief for the government’s records.

16. Track berthing/messing provided on daily basis.

a. Submit daily situation reports to FEMA, with copy to MARAD, at a time to be designated by the

Government.

17. Vessel Master/person-in-charge and Contractor’s representative shall attend daily coordination teleconferences with the General Agent, MARAD and FEMA – at a time to be designated by the Government.

18. Accommodation ladders/gangways must be provided, deployed with safety nets, and maintained in safe condition by the vessel.

a. Accommodation ladders/gangways shall be suitable for use by people who are unfamiliar with vessels.

b. Accommodation ladders/gangways shall be capable of being utilized safely if vessels are nested or anchored.

19. Adequate fendering - including for nested vessels, if required.

22. Adequate Potable water (see notes on port conditions below)

23. Baggage handling assistance, between pier or floating platform (for anchored vessels) and state room or sleeping area, to the emergency responders being provided berthing.

24. Satellite internet with unlimited local calls with a notional capacity of approximately 1500 KBS upload and 500 KBS download speed without buffering.

25. Cable TV in passenger recreation areas, messing areas. Wi-Fi accessible internet service.

26. Vessel officers, crew and contractor personnel shall not make any statements or release any documents to the press without prior approval from the FEMA Public Affairs Officer.

27. Sufficient project management to oversee the berthing, messing, linen services, laundry, housekeeping, security, safety, vessel repairs and maintenance, and all other above noted operating requirements.

Additional Requirements for Vessel(s) at St. John, USVI:

28. Maintain vessel safely at anchor.

29. Maintain all required services while vessel is at anchor.

30. Provide safe floating platform at bottom of gangway to safely embark/disembark passengers.

31. Provide regular, safe launch service of adequate capacity between St. John pier and vessel at anchor for emergency responders, government personnel, vessel needs.

a. Note the St. John pier can only accept vessels with 5’ draft.

b. Emergency responders will typically depart vessel for shore in the morning and return in the evening. Launch service must be able to accommodate varying departure and return times without unreasonable delays

Estimated port conditions:

The Government intends the Vessel to be berthed in one of the ports listed above. However, the Government may direct the vessel or require relocation of the vessel to a different port in Puerto Rico or U.S. Virgin Island.

Note: Vessel must complete satisfactory on-site and offsite FEMA assessments. Off-site assessments will supplement FEMA on-site assessment efforts. All vessel and offeror’s expenses to arrange for and host any FEMA vessel inspections will be at offeror’s expense.

26. Insurance Certificate

• Contractor shall add the United States of America as an additional assured, with waiver of subrogation, to its existing insurance policies for Vessel's Hull and Machinery policy (and the Increased Value policy if applicable), the Vessel's P&I entry, and any additional pollution liability coverage carried. There shall be no recourse for premiums against the Government. The contractor shall provide documentation of this coverage to the Contracting Officer prior to delivering the vessel.

C. Cost Proposal Submit all-inclusive prices for following:

27. Service at government designated service location in PR/USVI for a Base Period of 30-days (after arrival at service location).

28. Service at government designated service location in PR/USVI for Each Additional 14-day Option Period.

29. Per Diem Vessel Service Rate -for any Additional Days if required by FEMA after either the original Base Period or any awarded Option Period.

30. Mobilization/Demobilization Cost - including mobilization, vessel positioning to US PR/VI, as soon possible after contract award to any of the following ports, and demobilization cost.
