For Orders or Blank Purchase Agreements (BPAs)

Exceeding the Simplified Acquisitions Threshold

This acquisition is conducted under the authority of the Multiple-Award Schedule Program, 41

U.S.C. 152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies.

1. Agency and Contracting Activity. Identification of agency, contracting activity, and specific identification of document as a “Limited-Sources Justification.”

This document is a Limited-Sources Justification. The Department of Homeland Security

(DHS), Federal Emergency Management Agency (FEMA) proposes to award a BPA pursuant to FAR 8.405-6(a), Limiting Sources.

2. Nature and/or description of action being approved. Describe the action being approved, and include the name and address of the proposed contractor(s).

DHS, FEMA intends to limit the number of sources solicited pursuant to FAR 8.405-6(a) for acquisition management support services and integrated business program support services from ASI Government, Inc. (ASI) , 1655 North Fort Myer Drive, Suite 1000, Arlington, VA 22209.

e) Other brief descriptive words and phrases: In accordance with FAR 8.405-

6(a)(1)(i)(C), in the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule contract GS-10F-0308N, BPA

HSFE60-15-A-0001.

3. Description of Supplies/Services. Describe the supplies or services to be acquired.

Provide the estimated total value (including options, if any).

FEMA intends to award one BPA to procure contractor support services for the following grouped service categories: Group 1: Acquisition Management Support Services and

Group 2: Integrated Business Program Support Services. These Groups of services align with the scope of the General Services Administration (GSA) Multiple Award Schedule

(MAS) Mission Oriented Business Integrated Services (MOBIS) 874, Special Item

Number (SIN) 874-6 Acquisition Management Support and SIN 874-7 Integrated

Business Program Support Services, respectively.

The Group 1 scope of services include providing support to FEMA’s Federal Insurance and Mitigation Administration(FIMA) in: Acquisition planning assistance, including market research and recommending procurement strategy; Acquisition document development, including cost/price estimates, quality assurance surveillance plans, statements of work, synopses, solicitations, price negotiation memoranda, etc.; Expert assistance in supporting proposal evaluations, including price/cost analysis or technical proposal analysis; Contract administration support services, including assistance with reviewing contractor performance, developing contract modifications, and investigating reports of contract discrepancies; Contract close-out assistance; Competitive Sourcing support, including Office of Management and Budget (OMB) Circular A-76 studies, strategic sourcing studies, privatization studies, public-private partnerships, and Federal

Activities Inventory Reform (FAIR) Act studies.

The Group 2 scope of services includes providing support to FIMA in: Managing mission-oriented business projects or programs and achieving mission performance goals.

Group 2 includes supporting program or project management, from planning to closeout and operational/administrative business support services in order to carry out program objectives.

4. Authority and Supporting Rationale. Select one of the circumstances justifying limiting sources pursuant to FAR 8.405-6(a)(1)(i) below and demonstrate the proposed contractor’s unique qualifications to provide the required services.

8.405-6(a)(1)(i)(C) In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original BPA was not previously issued under sole-source or limited-sources procedures.

This acquisition is being conducted under the authority of the Multiple-Award Schedule

Program, 41 U.S.C. 152(3), Competitive Procedures, and 40 U.S.C. 501, Services for

Executive Agencies, in accordance with FAR 8.405-6(a), Limiting Sources. An award will be made in the interest of economy and efficiency as a logical follow-on to an http://uscode.house.gov/ original Federal Supply Schedule GS# GS-10F-0308N BPA# HSFE60-15-A-0001 pursuant to FAR 8.405-6(a)(1)(i)(C). The original BPA award was competitively solicited and awarded using the ordering procedures at FAR 8.405.

It is necessary to limit competition for this work described herein as a logical follow-on because the current Contractor, ASI, is the only contractor with the required knowledge & expertise to support FIMA without significant performance, schedule and cost risk.

Proceeding with a logical follow-on BPA under FAR 8.405-6(a)(1)(i)(C) reduces the risks and impact associated with transition-out and transition-in services. At this time, to lose the ASI Govt Inc. support would be a significant schedule risk to high priority FIMA acquisitions. For example, ASI Govt Inc. has been instrumental in assisting with FIMA high profile Reinsurance and Risk Rating procurements. FY 2018 Reinsurance procurements would be in jeopardy if a new contractor transitioned-in to provide these follow-on services. A transition-in period would cause FIMA to be delayed in submitting not only Reinsurance but other procurement packages for Risk Management Directorate, Funds Management Directorate, and Mitigation and Federal Insurance Directorate in FY

2018. A follow-on award to ASI would allow FIMA to continue with its current management priorities without costly schedule delays and possible lapse in services for these high profile requirements.

5. Determination by the ordering activity contracting officer that the anticipated BPA represents the best value consistent with FAR 8.404(d).

The contracting officer has determined that issuing the proposed BPA to ASI for FIMA

Acquisition and Management support services represents the best value and will result in the lowest overall cost, considering price and administrative costs, to meet the

Government’s needs. This BPA will be placed in accordance with FAR 8.404, “Use of

Federal Supply Schedules.” The General Services Administration (GSA) has already negotiated fair and reasonable pricing rates. Discounts to these GSA schedule rates will be requested. Additionally, prior to issuance of the BPA, the ordering activity will consider the level of effort and the mix of labor proposed to perform the specific tasks being ordered in order to determine that the total price is reasonable. The contractor’s labor mix and level of effort will also be compared to the Independent Government

Cost Estimate (IGCE).

6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.

Initially, FIMA conducted market research, assessed lessons learned from previous procurements from similar requirements, searched the internet for commercial service providers, researched GSA Advantage, GSA eLibrary, and the DHS Strategic Sourcing

Program. The Contracting Officer provided guidance and reviewed the market research report to ensure that appropriate market research documentation is included in the official contract file. Timeframe in which the market research was conducted from May 2015 through July 2015. However, for the current timeframe, FIMA has determined that it will be in the governments best interest and more efficient to proceed with a logical follow-on

BPA under FAR 8.405-6(a)(1)(i)(C). By proceeding with a logical follow-on BPA, the acquisition and program management support can continue without the risk of losing consistent support at a critical time. Also, the contractor shall support transition out activities (i.e. transitioning business and technical knowledge) to ensure the subsequent acquisition and services contractor can assume full operations of the services currently provided by the contractor under the BPA.

A statement of actions, if any, the agency may take to remove or overcome any barriers that led to restricted consideration (i.e., limited-sources) before any subsequent acquisition for the supplies or services is made. Include a statement of actions taken or that will be taken to increase competition for future acquisitions of the same

Using FEMA’s own single-awarded BPA contract will provide the flexibility and continuity of service required to effectively and efficiently manage the changing DHS requirements for FIMA Acquisition and Management support services. It would also ensure that FEMA can meet its operational mission and goals. FEMA intends to compete the next BPA for these services during the next fiscal year. This will allow the

Government to seek competition in future acquisitions for the same type of support, thus eliminating the barriers to competition.

9. FEMA intends to post this requirement on Fedbizopps pursuant to FAR 8.405-6(a)(2)(i).

Government’s minimum need and that the supporting data, which form a basis for the

Limited-Sources Justification, are accurate and complete.
