About this file
This is a Sole Source Justification for Simplified Acquisitions document (J&A-26-0091) prepared by the U.S. Immigration and Customs Enforcement (ICE), Office of Acquisition Management, on behalf of the Office of the Chief Information Officer (OCIO).
ICE proposes to sole source a firm-fixed price contract for a license subscription to IMPLAN, an economic modeling software used for input-output analysis, economic impact studies, and regional planning. The contract value is $129,000.00. IMPLAN Group LLC, located at 16905 North Cross Drive, Suite 120, Huntersville, NC 28078, is the sole developer and distributor of the software. The justification cites "Unusual and Compelling Circumstances" as the exception to fair opportunity competition under FAR 12.102(a) and FAR Class Deviation 25-21. The rationale emphasizes that IMPLAN's proprietary capabilities are essential for conducting critical economic analyses required by legislature under accelerated timelines, and that delays in acquiring the software would impede ICE's ability to meet statutory and regulatory obligations affecting national security and public safety. The contracting officer determined the $129,000 price to be fair and reasonable through comparison of the proposed price with prices found reasonable on previous government purchases of IMPLAN licenses, confirming the price falls within the range of comparable government transactions and is consistent with current market conditions.

states. Specifically, IMPLAN’s proprietary facilitate the identification and evaluation of direct, indirect, and induced economic impacts related expenditures. This analysis is essential for informing policy decisions, resource allocation, and compliance with legislative mandates under accelerated timelines.
The urgency of this requirement is such that adhering to normal competitive procedures would result in unacceptable delays.
Delays in acquiring IMPLAN software would impede ICE’s ability to conduct critical economic analyses required by legislature, potentially impacting national security, public safety, and other mission-essential functions. The inability to secure timely access to IMPLAN would jeopardize ICE’s ability to fulfill statutory and regulatory obligations and meet accelerated timelines mandated by legislature. Immediate action is necessary to ensure continuity of essential services and compliance with agency mandates.
