JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

Procuring these services will ensure that HSI can stay current with the constantly evolving and complex usage of emerging technology and techniques being implemented by complex cyber-criminal enterprises and threat actors. This will provide the capability for HSI personnel to respond and act quickly to identify and infiltrate criminal organizations to disrupt, dismantle, and/or arrest these individuals/groups per HSI's mission. Overall this will also support the furtherance of the HSI Cyber Strategic Plan, FY21 – 26, specifically for Objective 1.3 to provide capabilities to disrupt the criminal use of online marketplaces and illicit dark web activity, such as the proliferation of opioids such as fentanyl; Objective 3.1 to provide world-class training to combat increasingly sophisticated cyber threats; Objective 5.1 to invest in personnel and technological resources to increase the effectiveness of HSI’s cyber program and investigative capabilities.

10. A listing of the sources, if any that expressed, in writing, an interest in the acquisition.

An intent to solicit a single source was posted on www.sam.gov on September 7, 2023. No parties expressed interest in this requirement.

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for supplies or services required.

HSI C3 will continue to monitor the market for new entrants and products into the field that can meet the requirements. If it is found that there are no new entrants and products into the field that can meet the requirements, C3 will also continue to communicate with to determine if the company has new authorized resellers or distributors to increase competition.

After award of this action, DHS intends to post the approved/signed justification pursuant to FAR Part 6.305.
