Request for Proposal 70B06C24R00000052
Attachment 3- Question & Answer
#QuestionGovernment ResponseRFP Changes
1What is the due date for the provided sample?Volume II, Sample Submissions, is due 2:00PM ET May 30, 2024.None.
2Section III.3 C, states the government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt…. Confirming that solicitations shall still be reviewed and considered in whole or in part if there are items absent the proposal? The Government intends to make a single award resulting from this solicitation that provides all items. The Government will not consider offers that do not include all items listed in the solicitation.None.
3It states that alternatives not listed in the solicitation will require 2 samples to be supplied along with the Training red dot samples. We want to confirm that quoting items already listed in the solicitation as alternatives to another item listed in the solicitation will not require samples as their salient characteristics are already known and enumerated?Offerors are not required to submit optic samples for any line item in which the item being offered is elsewhere listed as a name brand item.None.
4CLIN 4.5.10 calls for the Nightforce C575 but we have been notified by Nightforce that this item has been updated to the C653 and will no longer be available. Since the C653 is a direct replacement will it be evaluated as the C575 or will it be seen as an alternate item?Any item that is not the listed brand name product will be treated as an alternate which will require sample submission.None.
5Will bidders be allowed to supply multiple options per line item (exp. 1. Name Brand 2. Better or Equal Option 3. Second Better or Equal option)?Offerors shall only submit one (1) item per line item, so CBP advises offerors to choose items based on the Lowest Price, Technically Acceptable evaluation approach CBP is utilizing. However, offerors may submit more than one proposal in response to this RFP.None.
6What brand name should bidders reference for better than or equal to on the performance of line 4.3.7, Non-magnified Battery Illuminated TRAINING Miniature Red Dot Sight (MRDS)?There is not a specific brand name equivalent CBP requires. CBP is requesting offerors submit an MRDS that meets the salient charactertistics as listed at Section 4.3.7.None.
7Will varying TRAINING Miniature Red Dot Sights (MRDS) be accepted from the same bidder?Offerors shall only submit one (1) item per line item, so CBP advises offerors to choose items based on the Lowest Price, Technically Acceptable evaluation approach CBP is utilizing. However, offerors may submit more than one proposal in response to this RFP.None.
8Will final submission for volumes I & III be required to be sent in separate emails? (Acknowledging requirements; separate attachments per Proposal General Information). Additionally, should Volume II - (List of )Samples be included in this collective or noncollective email?Submissions for Volumes I & III can be sent as either separate or single email. All Volume II submissions shall be made via mail to the address shown in the solicitation. No Volume II submissions should be sent to the Contracting Officer.None.
9Will Past Performance be an evaluation factor in any way for this solicitation?No.None.
10The Nightforce PN# C597 has been discontinued and improved upon with replacement PN# C653, https://www.nightforceoptics.com/riflescopes/atacr/atacr-1-8x24-f1/. Will this be updated on the Statement of Work? No. If any particular items are discontinued, offerors may submit alternative items (requiring sample submission) that will be evaluated against the salient characterisitcs listed in the Statement of Work.None.
11There are several Trijicon items where no part number was called out in the SOW section nor is there any mention of the requirement for the Trijicon items to be the “non-scripted” version that Federal agencies are allowed to purchase. Trijicon has always included a laser etched bible verse somewhere on the optic for all of their commercial part numbers. Trijicon has Government part numbers that they use to designate the models that do not include the bible verse etching. Based on the way the SOW is currently written, bidders can utilize the commercial parts which will include the laser etched bible verse. It is our understanding from providing Trijicon items to CBP in the past, that the commercial Trijicon items with the laser etched bible verses are not in compliance with CBP (and other agencies) policies. All Trijicon name-brand specified optics part numbers have been updated to reflect the Government-only part number that excludes bible verse etching on the optic. Additionally, additional requirements have been added to each optic salient characteristics prohibiting the inclusion of text on the optic other than for the purpose of identification or operation.CBP is updating part numbers for Trijicon-brand specific optics. Inclusion of the following salient characteristic on each optic:

Optic/Sight shall include no additional markings (e.g., engravings, etchings, printings, etc.) other than those that are necessary for the identification (e.g., serial number, part number, magnification, etc.) and operation (e.g., elevation markings, windage markings, magnification markings, etc.).

12 After reviewing SOW Section 4.6.9. with the OEM for the BE Meyers MODULAR ADVANCED WEAPON LASER – C-1+ (MAWL-C1+), we believe a few of the specifications are incorrect.

Specifically, the OEM has confirmed the following:

1.The weight is 10.5oz without battery on both models.
2.The MAWL is 5.5” long.
3.The MAWL-DA has Class 3R & 3B outputs. The salient characteristics require the optic has a Class 3R output. The requirements do not preclude a 3B output.

CBP is updating the SOW specifications for Section 4.6.9 to change the weight requirements to 10.5oz or less without battery.

CBP is updating the SOW specifications for Section 4.6.9 to change the length requirements to 5.5" or less. CBP is updating the SOW specifications for Section 4.6.9 to change the weight requirements to 10.5oz or less without battery.
