70B06C22R00000057 CONSOLIDATED QUESTIONS AND ANSWERS

The Statement of Work calls for rifles to come with a 3” Picatinny Rail Section, Aluminum, M-LOK compatible. Given that lengths of rail sections vary slightly across the industry, would CBP accept rail sections in lengths ranging from 2.3” to 3.3’? Or more preferably, would CBP replace the length specification with a number of rail slots CBP would like to have on the rail section, for example 5 slots or 7 slots? The solicitation shall be modified to state 3” (±.5”) Picatinny Rail Section, Aluminum, M- LOK compatible. This shall apply to all sections of the SOW that reference a requirement for a 3” Picatinny Rail Section, Aluminum, M-LOK compatible.

The solicitation requires that sample rifles be delivered to CBP no later than June 10, 2022. However, both the Short Barrel Rifle (SBR) Select Fire, and the Standard Patrol Rifle (SBR) require approval from the Bureau of Alcohol, Tobacco, Firearms, & Explosives (BATFE) prior to being shipped to CBP. Often the BATFE takes a month or more to approve these transfers. Will CBP allow for extensions for sample delivery if BATFE approval on the requires forms has not been received prior to the June 10 due date?

No, CBP will not extend the solicitation at this time. CBP has communicated with ATF and has been informed that an electronically filed ATF FORM 3 should take 10 days or less to be approved.

Would your team be fine with a personal delivery on the weapons? I would be hand delivering them either on 6/8/22 or 6/9/22. Yes, hand delivery is acceptable provided that advanced notice is given, and a scheduled date and time is established (as CBP personnel will have to meet the offeror outside the secure facility at the ATC Visitor Center for handoff.) Initial communication to schedule shall be done via email with the CO.

SOW 6.1 says that orders shall be shipped within 60 calendar days after receipt of order, unless otherwise specified in the DO. Are we able to extend that? No, this language shall remain. The government understands there are longer lead times with large volume orders and will work with vendors on a delivery order by delivery order basis to establish a reasonable “Delivery By” date.

Is that a conversation for the KO? This is all the more important because section II.10 (p. 12 of Solicitation) notes that the maximum orders are $5m for any single line item and $10m for any combination of line items. Does this mean the vendor needs to be prepared to ship up to $10m in products within 60 days? See answer above.

While the solicitation notes the possible max orders per line item, it does not address whether orders from different agencies are also covered by the max limits per line items listed in section II.10. Based on the way it is written, it would appear we could receive orders from CBP and FBI both of which would be subject to the $5m/$10m maximums but collectively would equal $10m/$20m in orders. Awardees may receive multiple orders simultaneously, with each maximum being $5M, but the total value of orders placed against the contract simultaneously (no matter who the agency is) shall not exceed $10M.

SOW 5.8.1 states the vendor is required to maintain the capacity to manufacture or acquire 1,000 completed rifles per month, which is far less than what would be ordered under the $5m/$10m limits noted above. The question are:

o Which provision applies when we receive orders – the solicitation or SOW: Are we to be required to maintain capacity for upwards of $10m in orders that need to be delivered within 60 days or are we required to maintain a capacity to make 1,000 complete rifles and deliver same within 60 days? See question #1 above.

o Is the 60 day delivery deadline firm or negotiable? See question #1 above.

If negotiable do we have that conversation with Mr. Myers, who is listed as the POC for the solicitation and SOW or do we have that conversation with the KO noted on page 1 of the solicitation, who, according to the solicitation, is the only person authorized to amend/revise the terms and conditions of the contract (section II.22 (p. 21))? See question #1 above.

On page 1 of the solicitation (top left corner) it states the “Offeror to complete blocks 12, 17, 23, 24 & 30”; however, on page 52 of the solicitation, it requires Offeror to “complete blocks 12, 17a & 30(a-c).” We need to confirm whether we need not complete blocks 23 & 24 of SF1449 (page 1 of the solicitation). Follow the instructions on page 52.

There is a “deliver to” address on page 5 of the solicitation (which I believe is the location where we would ship the product if we were to win the solicitation) but this address is different than those on page 49 (locations where we must send our proposal). I would like to confirm that nothing needs to go to the Washington, DC address identified on page 5 of the solicitation at the time of submission. After award, Delivery Schedules (to include items, dates, and locations) shall be established per each individual Delivery Order. This is what Section 1.2 on Page 5 is referencing. Instructions located on page 49 apply only to an offer’s physical submission in response to this solicitation and only references Harper Ferry and Indianapolis, respectively.

Page 49 of the solicitation explains that Volume I (non-physical) of the proposal needs to be submitted in a binder to both locations identified on the page. Volume I (physical) needs to be submitted to Harpers Ferry. It then states that Volume III will be submitted via email by the persons whom we’ve chose to complete the Past Performance Questionnaire, and that Volume IV must be emailed directly to Mr. Myers. However, on page 52 of the solicitation it states that “Offerors shall deliver their proposals (Volumes I, III, and IV) to the locations detailed above in Section 2 of this solicitation. Each volume shall be its own separate and individual attachment submitted with the proposal.”

o Question – can we confirm/clarify whether Volumes III and IV need to be submitted along with Volume I to Harpers Ferry and Indianapolis or if they are only to be emailed to Mr. Myers. Volume I shall be physically sent to both Harpers Ferry and Indianapolis. Volumes III and IV shall be emailed to the CO at the email address listed in Section III.20 Subsection 3. Specifics are detailed on p49 and p50 of the solicitation.

• I’d like to get conformation that the attached image does not have a “curved beavertail back strap” and will satisfy the grip requirement in the SOW 4.5.4.1. The attached picture does show an extended beavertail or tang. This would not meet the requirement contained in the SOW. The specified grip should come straight across to where it meets the lower receiver.

• For the Pricing matrix would we be able to add 3 more lower receiver assemblies? No, the pricing matrix shall remain as is. The SOW allows for a single buffer for the semi-auto lower receiver and a single buffer for the select fire lower receiver with no other variations. It currently only has two listed (semi and select fire)

We need to do this for lowers with different weight buffers and for registering SBR lowers with the appropriate barrel length(semi lowers for the 11.5” and 14.5” barrels).

The lowers would be:

Semi-Auto 11.5” (H3 buffer) Select Fire 11.5” (H3 buffer) Semi-Auto 14.5” (H2 buffer) Select Fire 14.5” (H2 buffer) Semi-Auto 18” (H2 buffer)
