This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation, proposal are being requested and a written solicitation will not be issued.
The solicitation number is 70B03C20Q00000149 and is issued as a request for quotes (RFQ) for firing range services. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2020-03. The U. S. Customs and Border Protection (CBP) Port of Champlain, NY has a requirement to secure a commercial firing range facility that will effectively support the U.S. Customs and Border Protection firearms training and recertification program.
Refer to the attached Statement of Work (SOW) for further requirement details.
This procurement shall be full and open competition. All qualified, responsible Offerors may submit an offer that shall be considered by the agency. Offerors are advised that they are responsible for obtaining amendments. The resulting contract shall be awarded to the Offeror who provides the lowest price technically acceptable offer. Prior to award, U.S. Customs and Border Protection shall inspect the proposed facility to ensure it meets all the requirements of the Statement of Work (SOW) for technical acceptability.
The U.S. Customs and Border Protection intend to issue a contract to secure a commercial firing range facility. The contemplated period of performance would be one 12 month base year with four (4) 12 month option periods. However, the funding is subject to the availability of funds in accordance with FAR 52.232-18. Please complete the attached price quote form for each of the five years. If you wish to quote the same price for all five years, please clearly and legibly state this on your price quote form. All Offerors must submit their quote as a monthly price. The Offeror shall meet or exceed the requirements as outlined in the attached SOW. Please refer to the attached SOW for additional requirements information. All Offerors submitting a quote shall be required to meet all the requirements as found in the Statement of Work (SOW).
Award of this contract shall be made on the basis of lowest price and technically acceptable. Technical acceptability shall be determined by whether or not the Offeror addresses and meets each point in the attached SOW as well as this RFQ. CBP will inspect the contactor’s facility that is determined to have the lowest price to determine compliance with the requirements outlined in the Statement of Work. CBP will conduct a site visit prior to award, and reserve the right to make unscheduled inspections to ensure acceptable conditions and that the SOW is being meet. The Government shall reserve the right to call vendors for clarifications on quotes, but no discussions shall be held. The contract period of performance will most likely start in February 2020.
Vendor MUST register in the System for Award Management (www.sam.gov) and receive payment via Electronic Funds Transfer (EFT) as a condition of the contract.
Registration in SAM requires a valid Dun & Bradstreet number.
Vendor MUST also complete and sign Blocks 13, 14, 15 and 16 on page one of the SF 18 form. Quotes that are incomplete, unsigned, or late will not be considered.
All quotes MUST be emailed to the Contract Specialist at deborah.brent@dhs.gov. All quotes must be received by the Contract Specialist by April 22, 2020 at 3:00 PM Eastern Time (Indianapolis).

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in paragraphs (e)(1) in a subcontract for commercial items. II.8 CONTRACTING OFFICER'S AUTHORITY (MAR 2003)
The Contracting Officer is the only person authorized to approve changes in any of the requirements of this contract. In the event the Contractor effects any changes at the direction of any person other than the Contracting Officer, the changes will be considered to have been made without authority and no adjustment will be made in the contract price to cover any increase in costs incurred as a result thereof. The Contracting Officer shall be the only individual authorized to accept nonconforming work, waive any requirement of the contract, or to modify any term or condition of the contract.
The Contracting Officer is the only individual who can legally obligate Government funds. No cost chargeable to the proposed contract can be incurred before receipt of a fully executed contract or specific authorization from the Contracting Officer.

II.9 ELECTRONIC INVOICING AND PAYMENT REQUIREMENTS - INVOICE PROCESSING PLATFORM (IPP) (JAN 2016)
Beginning April 11, 2016, payment requests for all new awards must be submitted electronically through the U. S.
Department of the Treasury's Invoice Processing Platform System (IPP). Payment terms for existing contracts and orders awarded prior to April 11, 2016 remain the same. The Contractor must use IPP for contracts and orders awarded April 11, 2016 or later, and must use the non-IPP invoicing process for those contracts and orders awarded prior to April 11, 2016.
"Payment request" means any request for contract financing payment or invoice payment by the Contractor. FIRING RANGE

FY 2020
1. BACKGROUND
The Department of Homeland Security (DHS), U.S. Customs and Border Protection (CBP), Office of Field Operations (OFO), Buffalo Field Office (BFO), Area Port of Champlain, NY has an immediate requirement for use of a weapon firing range located in the Champlain, NY area.
2. SCOPE
The purpose of this procurement is to establish an agreement with a local outdoor firing range contractor to provide a facility to accommodate CBP’s required weapons training and qualification initiatives.
2.1 A Technical POC will be appointed - to monitor Contractor performance and to coordinate technical and administrative matters with the Contracting Officer. The Technical POC may conduct a semi-annual review and additional reviews as necessary.
3. REQUIREMENTS
3.1 The Contractor shall provide a firing range that meets, or exceeds all Federal, State and Local requirements including all Health, Safety and Environmental Requirements.
3.2 The Contractor shall provide a facility that meets or exceeds all OSHA established standards for safety, health, noise, and air quality at all times.
4. SPECIFIC TASKS
4.1 The Contractor must be located within 20 miles of 237 West Service Road, Champlain, NY 12919.
4.2 The Contractor shall provide a (fifty) 50-yard outdoor Firing Range facility that is capable of accommodating CBP’s weapons training and qualification requirements as outlined below. This range shall meet or exceed all state and federal regulations governing the operation of said facility. The Contractor will provide the training venue Monday through Friday from 0700 to 1700 hours for training quarters two, three and four respectively (January 1st through September 30th). The Contractor will provide the training venue Monday through Friday from 1100 to 2100 hours for the purposes of CBP required reduced light training in quarter one respectively (October 1st through December 31st).
4.3 Customs and Border Protection (CBP) Officers will be the only persons permitted to use this range while so occupied. When not utilized by CBP personnel for the range will be available for use to members of the range. CBP approximates roughly 300 officers utilizing facilities during Fiscal Year (FY) 2020. The 50-yard pistol range will be for the entire quarter. The range is responsible for the target supports, uprights and backers and agrees to repair these items as needed.
The range will perform other normal range maintenance including ground cover.
5. DELIVERABLES AND DELIVERY SCHEDULE
Delivery schedule in accordance with section 4.1 and 8 of this Statement of Work
6. GOVERNMENT-FURNISHED EQUIPMENT AND INFORMATION
No government-furnished property or information will be required since staff will be training in the Contractor’s facility.

9. SECURITY
The Contractor shall not use, disclose, or reproduce data, which bears a restrictive legend, other than as required in the performance of this contract. The contractor must sign a Non-Disclosure Statement to ensure the Range Owner does not disclose CBP Firearms Training regimen to outside sources.
10. PERFORMANCE REQUIREMENTS
10.1 Range Size: The Firing Range shall be a fifty (50)-yard facility, suitable for the purpose of providing weapons training and qualification for up to eight CBP personnel at a time.
10.2 Ammunition Compatibility: The Contractor shall provide a Firing Range that will accommodate both standard lead and frangible ammunition that may be utilized in training and qualification of CBP personnel. The following calibers will be required .40 handgun, 9mm handgun, 12 gauge shotgun (buckshot and slug), and .223.
10.3 Spent Round Trap (Berm): The spent round trap shall be free of any and all objects that may result in deflection of spent rounds. It must be capable of entrapment of all rounds that are fired into it, up to fifty – (.50) caliber rounds.
The spent shell casings should be removed consistent with OSHA requirements.
10.4 Firing Positions and Corresponding Targets: All firing positions and corresponding targets shall be identified.
10.5 Firing Range Ground Cover: The Contractor shall maintain the Firing Range Ground Cover in a manner that does not obstruct visibility or access to the target area.
10.6 Maintenance of Firing Range and Contractor Provided Equipment: The Contractor shall provide for all labor, maintenance and supplies necessary to maintain the facility and Contractor provided equipment.
10.7 Inspection of Firing Range and Contractor Provided Equipment: The firing range, and Contractor provided equipment shall be inspected and maintained by the Contractor in a serviceable condition acceptable to the CBP Firing Range and Safety Officers
10.8 Licenses and Permits: The Contractor shall provide, and maintain in force, all required local, state and federal licenses and permits.
10.9 Availability of Range: For group practice/qualifications, the contractor shall make the facility available to CBP personnel, within a (7) day notification period by the Supervisory CBP Officer – Champlain Firearms and Tactical Unit or their duly appointed representative; however, a twenty-four (24) hour notification may be required for individuals requiring training under special circumstances.
10.10 Required Access: The Contractor’s facility shall be made available five (5) days per week, Monday through Friday during the hours and time frames outlined in 4.2; including all federal recognized non-priority holidays as defined herein:

10.12 Marksmanship Qualifications: CBP will require the facility for a six (6) week period each quarter. Please note one of the four quarters shall include pre-scheduled times for CBP personnel to conduct Marksmanship qualifications including night time qualifications.
10.13 Duration of Qualification: Qualification requirements should not exceed six (6) weeks during any quarter. Should additional time for qualifications be necessary, exceeding the agreed upon six (6) week period, the contractor will be provided with at least a twenty-four (24) hour notification by the CBP Officer – Champlain Firearms and Tactical unit.
10.14 Defining Quarters: Quarters are defined as: October 1st through December 31st, January 1st through March 31st, April 1st through June 30th, and July 1st through September 30th.
10.15 Performance Interruption: Performance of contract requirements shall not be interrupted as a result of an authorized schedule change that has been initiated by an authorized CBP-OFO Representative and the Contractor.
10.16 Other CBP Requirements: The Contractor shall provide the following additional accommodations in support of CBP Firearms Training and Qualification initiatives.
10.17 Administrative/Training Trailer – Parking Area: The Contractor shall provide an area for the CBP Firearms Tactical Unit to permanently (during the term of the purchase order only) park and set up a 12’ x 30’ administrative/training office trailer. The exact site shall be mutually agreed upon be the CBP Tactical and Firearms Officer and the Contractor.
10.18 Restroom(s): The Contractor shall provide at least one (1) unisex rest room for CBP-OFO personnel participating in training and qualification activities.
10.19 Vehicle Parking: The Contractor shall provide adequate parking to support government and privately owned vehicles of CBP-OFO personnel participating in training or weapons qualification activities at any given time during utilization of the facility by CBP personnel. A minimum of six (6) parking spots should be available at all times to CBP personnel. CBP personnel must adhere to parking rules and be cognizant of not blocking access to other ranges on facility grounds.
10.20 Facility Inspection: The Contractor shall provide access to his facility, by the Supervisory CBP Officer – Champlain Firearms and Tactical Unit and CBP Safety Officer, or their designated representatives, at any and all times during normal business hours without prior notification. The purpose of these visits may vary and may include general facility condition inspections or health and safety inspections. Designated CBP personnel shall have twenty-four (24) hour access to range facilities in the event of a training accident, and for related follow up reporting and documentation purposes (training conditions, pictures).
11. CBP NOTIFICATIONS AND IDENTIFICATION OBLIGATIONS
11.1 Contractor Notification: The CBP Champlain Firearms and Tactical Program Officer, or duly authorized representative, shall notify the Contractor of performance requirements under the following conditions (Note: CBP will provide a TENTATIVE calendar to range in advance for the sole purpose of approximating the days/weeks that the range shall be used for qualifications).
11.2 Notification for Quarter Weapons Qualifications: CBP shall provide the Contractor with a three (3) week prior notification for quarterly weapons qualifications. Performance dates and times shall be established between the Contractor and CBP.
11.3 Notification for Night Weapons Qualifications: CBP shall provide the Contractor with a three (3) week prior notification for night weapons qualifications. Typical night weapons qualifications occur during the entirety of the first quarter from October 1st through December 31st Monday through Thursday. Performance dates and times shall be finalized between the Contractor and CBP.
11.4 Identification of CBP Personnel: All CBP personnel shall provide the Contractor with a valid Department of Homeland Security, CBP Form 3701 upon request while participating in weapons practice or qualifications sessions. No personal membership is conferred, or implied by this agreement. All CBP personnel are advised to provide valid CBP credentials upon request while utilizing contractor facilities.
