About this file

This document is a Single Source Justification (Simplified Acquisition) for a federal contract to provide commercial Internet service to Building 2063 at Kapaun Air Station, Germany. The estimated contract cost is $25,046.96. The contractor shall provide all necessary equipment, materials, and personnel to deliver high-speed, freely accessible Internet service with 24/7 support. The justification cites FAR 6.302-1, as TKS owns the exclusive cable distribution infrastructure in the area and is the only responsible source. Past market research found no other viable options, and the cost for other vendors to install new infrastructure would be prohibitively expensive. The contract was awarded to an unknown vendor on 2024-09-23 under solicitation number 700CONSPKP2024V2.

Section A: General Contract Information

Is this a Bridge Action as defined in the AF Bridge Action Reduction Plan? Yes No

Contracting Activity: 700 CONS/ PKP

Project/Program Name: Wi Fi Vogelweh Bldg 2063

Purchase Request / Local ID Number: F3N6094051AW01

Estimated Contract Cost (including Options): $25,046.96

Section B: Description of the Supplies/Services Required

Contractor shall provide all necessary equipment and materials to provide commercial Internet service to Building 2063, Kapaun AS, Germany, in accordance with the TKS quotation dated 18 September 2024. Contractor shall provide all personnel and equipment to include upgrade(s), tools, maintenance, repair and/or replacement, technical support, and any other components necessary for uninterrupted operations of high speed Internet service for customers 24 hours a day, 7 days a week. Internet access must be freely accessible (no password required) and anonymous. Access shall be enabled according to the most current Wi-Fi Standards with backwards compatibility. Internet shall be capable of handling and sharing connections with several clients.

Section C: Justification for Soliciting from a Single Source or Brand Name

This justification for other than full and open competition is under the statutory authority of FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. TKS owns the Internet distribution system (infrastructure) serving the various offices, housing, and lodging areas in the KMC area, estimated population 68,000. No other source has a similar cable distribution system across the KMC and TKS has stated that they have no intention of providing licenses (or selling the infrastructure) to other vendors or the government. While the Internet services are common to the commercial marketplace, the circumstances of TKS being the only contractor to have ownership of the infrastructure network makes these services sole source. Deutsche Telekom also has a limited distribution plant within the KMC, but the vast majority of it consists of aging copper cables which are unable to provide reliable Wifi/Internet services nor speeds required(they are limited to 2 Mb lines under the best conditions). All previous services have been determined fair and reasonable, so it is anticipated that the cost will be fair and reasonable.

Section D: Efforts to Obtain Competition

After contacting known sources of services, subject matter experts, reviewing recent market research, it was established that there are no other options. The commercial marketplace will continue to be evaluated.

Section E: Steps to Preclude Future Single Source or Brand Name Awards

Past market research has reflected that TKS is the established and feasible option to fulfill this requirement. Including a market research report done for FA561320A0019 and a sources sought completed in January of 2020, yielding no acceptable vendors.

The market conditions have not changed. TKS owns the cable distribution system and is not granting licenses to other contractors or the government. The cost for other vendors to meet the requirement would be exponentially more expensive due to their complete lack of cable distribution in the areas required.
