About this file
Summary of File
This is a Sole-Source Determination Form submitted by Northern New Mexico College (NNMC) for the procurement of CDL and Residential and Commercial Maintenance Technician I Training services. The determination document outlines NNMC's justification for selecting a single source vendor rather than conducting a competitive procurement process. The form addresses the college's need for specialized vocational training programs in commercial driver's license (CDL) certification and maintenance technician skills, which align with workforce development objectives in the region. The document establishes the rationale for sole-source selection, citing factors such as the vendor's unique qualifications, specialized curriculum delivery capabilities, and alignment with the college's accreditation and programmatic requirements.
The sole-source determination form includes documentation supporting NNMC's position that only one qualified source exists capable of meeting the specified training requirements and delivery standards. The form addresses competitive procurement alternatives considered and explains why they were deemed inadequate or unavailable. This determination would typically precede contract award and establishes the legal and administrative foundation for NNMC to proceed directly with negotiations and contract execution with the identified vendor without soliciting competitive bids. The procurement supports New Mexico's broader workforce development initiatives by enabling NNMC to deliver critical vocational training programs efficiently and effectively.

SOLE SOURCE REQUEST AND DETERMINATION FORM
Per NMSA 1978, Section 13-1-126.1, a contract may be awarded without competitive sealed bids or competitive sealed proposals regardless of the estimated cost when the state purchasing agent or a central purchasing office makes a determination, after conducting a good-faith review of available sources. Per NM Stat § 13-1-126.1 (2016) a notice of intent to award a sole-source contract must be posted 30 days prior to award. NNMC posts such notices on the state purchasing agent's website www.generalservices.state.nm.us/statepurchasing/sole_source_emergency_view.aspx.
It is the responsibility of the College’s state registered Chief Procurement Officer to make the determination that a Sole- Source procurement is required and to post the request and determination as outlined above.

2. Provide an explanation of the criteria developed and specified by the agency as necessary to perform and/or fulfill the contract and upon which the state agency reviewed available sources.
(Do not use “technical jargon;” use plain English. Do not tailor the criteria simply to exclude other contractors if it is not rationally related to the purpose of the contract.)
The College developed the following criteria based on the needs of the Adult Education and Continuing Education programs and the workforce training needs of the students and local community.
For the CDL training, the contractor must be able to provide qualified instruction that prepares students to obtain their Commercial Driver’s License. The training must include classroom instruction, hands-on driving experience, appropriate training equipment and vehicles, and preparation for the required licensing examination. The contractor must also be able to provide training in a manner that meets applicable state and industry requirements.
For the Residential and Commercial Maintenance Technician I training, the contractor must be able to provide instruction and hands-on training that prepares students for entry-level employment in residential and commercial maintenance. Training must provide students with practical skills applicable to areas such as basic electrical, plumbing, carpentry, maintenance, safety, and other related building maintenance activities. The contractor must have qualified instructors, appropriate training materials and equipment, and the ability to provide hands-on instruction.
In reviewing available sources, the Adult Education – Northern NM College considered the contractor’s ability to provide the required training, qualified instructors, appropriate equipment and facilities, hands-on learning opportunities, scheduling, student support, and training that meets the needs of the College’s Adult Education and Continuing Education students.
These criteria were established to ensure that the contracted services meet the educational and workforce training needs of the College and its students. The criteria are based on the requirements of the programs and are not intended to unnecessarily limit competition among potential contractors.
3. Provide a detailed, sufficient explanation of the reasons, qualifications, proprietary rights or unique capabilities of the prospective contractor that makes the prospective contractor the one source capable of providing the required professional service, service, construction or item(s) of tangible personal property. (Please do not state the source is the “best” source or the “least costly” source. Those factors do not justify a “sole source.”)
Mountain View Vocational Institute, LLC possesses the qualifications, instructional resources, equipment, and experience necessary to provide the CDL and Residential and Commercial Maintenance Technician I training required by Northern New Mexico College’s - Adult Education and Continuing Education programs.
For the CDL training, Mountain View Vocational Institute, LLC is able to provide the required classroom and hands-on driving instruction, including access to the appropriate training vehicles, equipment, instructors, and training resources necessary to prepare students for the Commercial Driver’s License examination and related requirements. The contractor’s ability to provide the classroom and b
For the Residential and Commercial Maintenance Technician I training, Mountain View Vocational Institute, LLC is able to provide qualified instruction and hands-on training in the practical skills needed for entry-level residential and commercial maintenance employment. This includes instruction in areas such as basic electrical, plumbing, carpentry, general maintenance, workplace safety, and related building maintenance skills. The contractor has the instructional resources and hands-on training capabilities necessary to deliver this type of occupational training.
A significant consideration is Mountain View Vocational Institute, LLC’s ability to provide the required occupational training, qualified instructors, hands-on learning, equipment, and related training resources as part of the same contracted service. This allows the Northern NM College – Adult Education to provide students with a coordinated training experience that addresses both the CDL and Residential and Commercial Maintenance Technician I program requirements.
The Adult Education reviewed available sources and determined that Mountain View Vocational Institute, LLC has the specific combination of instructional capabilities, qualified personnel, training resources, equipment, and ability to deliver the required services within the College’s program structure and timeframe.
The determination is based on the contractor’s specific qualifications and unique capabilities to fulfill the stated scope of work. It is not based on the contractor being the “best” or “least costly” provider.
4. Provide a detailed, sufficient explanation of how the professional service, service, construction or item(s) of tangible personal property is/are unique and how this uniqueness is substantially related to the intended purpose of the contract.
The services to be provided by Mountain View Vocational Institute, LLC are unique because they provide the Northern NM College – Adult Education with access to specialized, hands-on workforce training that combines classroom instruction with practical training in the occupational skills required for the CDL and Residential and Commercial Maintenance Technician I programs.
For the CDL program, the unique nature of the service is the ability to provide both the instructional and practical components of CDL training, including classroom instruction and hands-on driving experience using appropriate training vehicles and equipment. The hands-on component is essential because students must develop practical driving skills in addition to completing classroom instruction. This capability is directly related to the purpose of the contract, which is to prepare Adult Education and Continuing Education students for employment and successful completion of the requirements associated with obtaining a Commercial Driver’s License.
For the Residential and Commercial Maintenance Technician I program, the service is unique because it provides occupational training that combines classroom learning with hands-on experience in multiple areas of residential and commercial maintenance. Students receive practical instruction in areas such as basic electrical, plumbing, carpentry, general maintenance, and workplace safety. The combination of these skills is directly related to the intended purpose of the contract because the program is designed to prepare students for entry-level employment in the residential and commercial maintenance field.
The uniqueness of the contracted services is substantially related to the Adult Education – Northern NM College’s goal of providing students with accessible, industry-focused training that leads to employment opportunities and supports local workforce needs. The services are not limited to classroom instruction; they provide the specialized equipment, practical training, qualified instruction, and hands-on learning opportunities necessary for students to develop job-ready skills.
Mountain View Vocational Institute, LLC’s ability to provide the required combination of classroom instruction, hands-on training, qualified instructors, equipment, and occupational training resources in support of these programs directly fulfills the Adult Education – Northern NM College’s intended purpose. Without these specialized training components, the Adult Education – Northern NM College would not be able to provide students with the same level of practical workforce preparation required by the program
Therefore, the uniqueness of the services is substantially related to the purpose of the contract because the Adult Education – Northern NM College is seeking specialized occupational training that provides students with the knowledge, practical skills, and workforce preparation necessary to pursue employment in CDL and residential and commercial maintenance occupations.
5. Explain why other similar professional services, services, construction or item(s) of tangible personal property cannot meet the intended purpose of the contract.
Other similar professional training services cannot meet the intended purpose of the contract unless they are able to provide the complete combination of services required by Northern New Mexico College’s - Adult Education and Continuing Education programs.
The Adult Education requires a provider capable of delivering specialized occupational training that includes qualified instruction, classroom learning, hands-on training, appropriate equipment and training resources, and instruction that supports students in obtaining industry-recognized credentials or developing job-ready skills.
For the CDL program, a provider must be able to offer both classroom and hands-on driving instruction, including access to appropriate training vehicles, equipment, qualified instructors, and preparation for the required CDL examination. A provider that can offer only classroom instruction, or that does not have the necessary vehicles, equipment, instructors, or training capacity, would not fulfill the intended purpose of the contract.
For the Residential and Commercial Maintenance Technician I program, a provider must be able to deliver hands-on occupational training across multiple maintenance skill areas, including basic electrical, plumbing, carpentry, general maintenance, and workplace safety. A provider that offers only classroom-based instruction or training in a limited number of these areas would not provide the comprehensive hands-on workforce preparation required by the program.
The College's intended purpose is to provide students with practical, employment-focused training that prepares them for entry-level employment and advancement in high-demand occupational fields. Therefore, a provider must be able to meet the full scope of the training requirements rather than provide only a portion of the services.
Based on the Northern’s – Adult Education review of available sources, Mountain View Vocational Institute, LLC has the combination of instructional capabilities, qualified personnel, hands-on training, equipment, and program resources necessary to fulfill the complete scope of the contract within the required program structure and timeframe. Other providers that do not possess or cannot provide this complete combination of resources and services would not meet the intended purpose of the contract.
The determination is based on the specific requirements of the College's programs and the capabilities necessary to fulfill those requirements, rather than on cost, convenience, or a determination that Mountain View Vocational Institute, LLC is simply the “best” provider.
6. Provide a narrative description of the college’s due diligence in determining the basis for the procurement, including procedures used by the agency to conduct a review of available sources such as researching trade publications, industry newsletters and the internet; reviewing telephone books and other advertisements; contacting similar service providers; and reviewing the State Purchasing Agent’s vendor list.
Northern New Mexico College – Adult Education conducted due diligence to determine the appropriate procurement method and to identify available sources capable of providing the specialized training services required for the Adult Education and Continuing Education programs.
The Adult Education reviewed the specific requirements for the CDL and Residential and Commercial Maintenance Technician I training, including the need for qualified instructors, appropriate training equipment and facilities, classroom instruction, hands-on training, occupational skills development, and the ability to provide the services within the College’s required program schedule and timeframe.
As part of its review of available sources, the Adult Education researched providers of similar occupational and workforce training services through internet searches, industry and training resources, available provider information, and other publicly available sources. The Adult Education also considered information regarding providers that offer CDL training and residential and commercial maintenance training in the region.
The Adult Education reviewed available vendor information and considered whether potential providers had the qualifications, instructional personnel, facilities, equipment, hands-on training capabilities, and capacity necessary to meet the complete scope of the Adult Education requirements. The Adult Education
- College also considered available information from potential service providers regarding the type and extent of training services they could provide.
The Adult Education – Northern NM College reviewed the State Purchasing Agent’s vendor information/list to identify potential sources capable of providing the required services. Where appropriate, the Adult Education also considered information obtained through communications with training providers and other available sources regarding their ability to provide the required occupational training.
Through this due diligence process, the Adult Education – Northern NM College determined that Mountain View Vocational Institute, LLC has the combination of qualified instructional personnel, occupational training capabilities, hands-on training resources, equipment, and capacity necessary to fulfill the Adult Education – Northern NM College’s specific requirements for the CDL and Residential and Commercial Maintenance Technician I programs.
The Adult Education – Northern NM College’s review was based on the actual requirements of the programs and was conducted to determine whether other reasonably available sources could provide the complete scope of services required. The Adult Education – Northern NM College determined that the unique combination of services and resources required for these programs could not be readily obtained from another available source that could meet the Adult Education – Northern NM College’s requirements within the required program structure and timeframe.
The due diligence conducted by the Adult Education – Northern NM College supports the determination that a sole-source procurement is appropriate based on the specific requirements and circumstances of the requested services.
