About this file
This is a 2026 Sole Source Request and Determination Form submitted by Northern New Mexico College to the State of New Mexico for the renewal of credit and debit card processing services provided by TouchNet Information Systems Inc. The agency requests authorization to enter into a contract for the continuation of TouchNet Solutions' payment gateway services, which integrate directly with the college's Workday enterprise resource planning system to process financial transactions for students and the institution. The contract term runs from August 16, 2026, through October 1, 2027. No bidders' meetings, site visits, or response deadlines are specified in the sole source documentation, as this procurement bypasses competitive bidding requirements based on the vendor's unique capabilities and the substantial costs associated with platform migration.
The contract value is $75,019.00 before tax, representing a renewal of existing software subscription services including support and maintenance. Northern New Mexico College justifies the sole source designation by citing TouchNet's exclusive ownership and licensing of the payment gateway technology that integrates with Workday, combined with the prohibitive costs and operational disruptions that would result from vendor transition, including historical data conversion, staff and faculty retraining, and student system familiarization. The college's Chief Procurement Officer is Josephine Velasquez, and the vendor contact is Adam McDonald of TouchNet Information Systems Inc., located in Atlanta, Georgia. The sole source determination requires a thirty-day posting period without protest before final approval by the State Purchasing Agent.

STATE OF NEW MEXICO
SOLE SOURCE REQUEST AND DETERMINATION FORM
A sole source determination is not effective until the sole source request for determination has been posted for thirty (30) calendar days without Protest and subsequently approved in writing by the State Purchasing Agent. IV. If this is a Sole Source for new or existing IT software licensing subscription(s), Agency is required to upload the Contractor’s draft Service Level Agreement (SLA) with the Sole Source online submission.
V. Agency is required to provide the detailed scope of work (or amendment) for this sole source. Scope of work must match the scope included in the services determination and Horizons declination.
Renewal of software subscription, including support and maintenance, for Northern New Mexico College is required to process credit/debit card payments. TouchNet Solutions can interface with various resources, including Banner, Workday, and other ERP systems.
VI. Provide a detailed explanation of the criteria developed and specified by the agency as necessary to perform and/or fulfill the contract and upon which the state agency reviewed available sources. (Do not use “technical jargon;” use plain English. Do not tailor the criteria simply to exclude other contractors if it is not rationally related to the purpose of the contract.)
Northern New Mexico College (NNMC) has minimum need to acquire continued credit/debit card processing services that integrate directly into the Workday system for student and financial systems for TouchNet.
VII. Provide a detailed, sufficient explanation of the reasons, qualifications, proprietary rights or unique capabilities of the prospective contractor that makes their company the only source capable of providing the required professional service, general service, construction or item(s) of tangible personal property. (Please do not state the source is the “best” source or the “least costly” source. Those factors do not justify a “sole source.”)
The associated costs of changing vendors/platforms, including the conversion of historical data, and the cost and time required to train staff, faculty, as well as the college’s student base, would far exceed the college’s current state-approved budget for these services.
VIII. Provide a detailed, sufficient explanation of how the professional service, general service, construction or item(s) of tangible personal property is/are unique and how this uniqueness is substantially related to the intended purpose of the contract.
TouchNet is a sole manufacturer, sole distributor, and exclusive licensor of the TouchNet Payment Gateway services that directly integrate into the Workday system.
IX. Provide a narrative description of the agency’s due diligence in determining the basis for the procurement, including procedures used by the agency to conduct a review of available sources such as researching trade publications, industry newsletters and the internet;;
contacting similar service providers; and reviewing the State Purchasing Divisions’ Statewide Price Agreements. Include a list of businesses contacted (do not state that no other businesses were contacted), date of contact, method of contact (telephone, mail, e-mail, other), and documentation demonstrating an explanation of why those businesses could not or would not, under any circumstances, perform the contract; or an explanation of why the agency has determined that no businesses other than the prospective contractor can perform the contract.
Based on the agency’s research and vendor outreach, it was determined that the prospective contractor is uniquely qualified to perform the required services because of its specialized expertise, proprietary knowledge, and qualifications.
Agency certifies this sole source submission complies with NMSA 1978, Sections 13-1-28 through 13-1-199, the New Mexico Administrative Code (NMAC) and Governmental Conduct Act, NMSA 1978, Sections 10-16-1 through 10-16-18.
