About this file
This is a 2026 Sole Source Request and Determination Form submitted by the Village of Fort Sumner, New Mexico, for engineering services related to wastewater treatment plant improvements. The Village seeks to engage Bohannan Huston, Inc. (BHI) to provide additional electrical design work to resolve issues identified during the construction phase, along with continued construction administration and project closeout support. BHI has served as the Engineer of Record since the project's inception in 2020 and developed all preliminary engineering reports, design plans, specifications, technical analyses, and supporting project documentation. The contract term extends from July 22, 2026, to July 30, 2027, with no renewal options specified in the documentation.
The prospective contract amount is $114,014.38 before tax, with an estimated tax amount of $7,926.13. The Village justifies the sole source determination by asserting that engaging a different engineering firm would result in substantial duplication of costs and unacceptable project delays. According to the agency, a new consultant would need to extensively review and verify existing proprietary engineering documents, recreate project knowledge, and evaluate prior design decisions already completed by BHI. The Village contends that BHI's unique institutional knowledge, proprietary design methodologies, and technical expertise specific to the Village's wastewater treatment system make the firm the only responsible source capable of continuing services without incurring significant additional expenses or compromising construction schedules and regulatory compliance requirements.

2026 Sole Source Form
STATE OF NEW MEXICO
SOLE SOURCE REQUEST AND DETERMINATION FORM

The foregoing requirement is regardless of whether the sole source request for determination has been signed by the Agency.

V. Agency is required to provide the detailed scope of work (or amendment) for this sole source. Scope of work must match the scope included in the services determination and Horizons declination.
Horizons declination does not apply to Engineering & Design Contracts.
The purpose and need for the project is to complete improvements to the existing wastewater treatment plant to ensure its current and continued performance to treat the Village’s wastewater. BHI will provide addition electrical design to resolve an issue
2026 Sole Source Form found during the construction phase of the project as well as provide the remainder of construction administration and closeout support.
VI. Provide a detailed explanation of the criteria developed and specified by the agency as necessary to perform and/or fulfill the contract and upon which the state agency reviewed available sources. (Do not use “technical jargon;” use plain English. Do not tailor the criteria simply to exclude other contractors if it is not rationally related to the purpose of the contract.)
Procuring engineering services from a different firm would result in a substantial duplication of cost. A new consultant would be required to perform an extensive review and verification of the existing proprietary engineering documents, recreate project knowledge, evaluate prior design decisions, and assume responsibility for work already completed. This effort would duplicate engineering services that have already been performed, resulting in significant additional costs without providing any added benefit to the Village. These delays could adversely affect construction schedules, regulatory compliance, funding requirements, and the timely completion of the Wastewater Treatment Plant Improvements Project.
VII. Provide a detailed, sufficient explanation of the reasons, qualifications, proprietary rights or unique capabilities of the prospective contractor that makes their company the only source capable of providing the required professional service, general service, construction or item(s) of tangible personal property. (Please do not state the source is the “best” source or the “least costly” source. Those factors do not justify a “sole source.”)
Bohannan Huston is the Engineer of Record for the project since it began in 2020 and has completed not only the Preliminary Engineering Report, but also developed the project's engineering plans, specifications, calculations, technical analyses, design documents, and supporting project records. These engineering documents and methodologies are developed with proprietary knowledge resulting in work products developed specifically for the Village's wastewater treatment system. As the original design engineer, Bohannan Huston possesses the unique technical knowledge and institutional familiarity necessary to interpret, modify, and support these proprietary designs throughout construction and project completion.
VIII. Provide a detailed, sufficient explanation of how the professional service, general service, construction or item(s) of tangible personal property is/are unique and how this uniqueness is substantially related to the intended purpose of the contract.
Because Bohannan Huston is the Engineer of Record and maintains the proprietary engineering knowledge, design documents, and technical expertise necessary for the continuation of this project, the Village has determined that no other source can provide these services without incurring substantial duplication of cost and unacceptable delays.
Therefore, Bohannan Huston, Inc. is the only responsible source for the continued engineering services required to successfully complete the Wastewater Treatment Plant Improvements Project.
