About this file

This is an Emergency Procurement Request submitted by Dona Ana County, New Mexico for demolition and abatement services of a fire-damaged residential structure located at 4045 Tellbrook Road. The emergency procurement was authorized by Detention Personnel via email on July 16, 2026, and confirmed on July 20, 2026, under New Mexico Statute 13-1-127 due to immediate threats to public health, safety, and welfare. The County Building Official documented hazardous conditions at the property, including unstable structural elements, debris, and safety hazards that created imminent danger of serious injury or death, particularly to children and other individuals observed entering the site. The scope of work includes demolition of the burned residential structure, removal and proper disposal of all remaining structural debris, removal of associated demolition debris, site cleanup and grading to leave the property in a safe condition, and compliance with all applicable federal, state, and local regulations regarding demolition and disposal. Prior to the emergency procurement, the County solicited sealed bids from qualified contractors, including Crosstown Construction, DJM Construction, and Sandoval Construction, with bid submissions to be reviewed by the County Finance Department for award to the lowest responsive and responsible bidder.

Crosstown Construction submitted an estimate dated September 18, 2025 (Estimate #2762) with a total project cost of $22,585.59, including sales tax of $1,685.59, for the complete demolition project. The estimate includes all labor, equipment, utility disconnection, material hauling to landfill, dust control via water truck, debris removal, and rock wall removal, with permits, environmental permits for asbestos and lead paint assessment, and landfill dumping fees included in the cost. The County noted that Crosstown Construction has been the only contractor consistently willing to submit bids for demolition projects, creating recurring delays in addressing unsafe structures. Following the emergency demolition, the County indicated its intention to issue a new invitation to bid (ITB) for demolition and abatement services to establish a more competitive procurement process for future similar projects.

Emergency Procurement Request

Doña Ana County is requesting the Purchasing Department for an emergency procurement of services for Demolition and abatement of a property to be provided by Crosstown Construction.

Written authorization from Detention Personnel:

Submitted via email, July 16, 2026 at 7:59 AM MST and Confirmed July 20 , 2026 at 2:18 PM MST.

Written justification of the basis for the emergency:

13-1-127. Emergency procurement; required conditions; limitations; notice.

A. The state purchasing agent or a central purchasing office may only make an emergency procurement when the service, construction or item of tangible personal property procured:

(1) is needed immediately to:

(a) control a serious threat to public health, welfare, safety or property caused by a flood, fire, epidemic, riot, act of terrorism, equipment failure or similar event; or

(b) plan or prepare for the response to a serious threat to public health, welfare, safety or property caused by a flood, fire, epidemic, riot, act of terrorism, equipment failure or similar event; and

(2) cannot be acquired through normal procurement methods

This emergency procurement is for the demolition and abatement, located at 4045 Tellbrook in Dona

Ana County, NM. The emergency directly impacts the health, safety, and welfare of both children and adults living near the property. Due to numerous complaints from constituents reporting that children and other individuals have been observed entering and congregating around this property, the condition of the site presents an immediate and significant threat to public safety. As documented in the attached photographs, hazardous conditions exist throughout the property, including unstable structural elements, debris, and numerous safety hazards. The remaining structure is severely compromised and could collapse without warning, creating an imminent danger of serious injury or death to anyone entering the site.

Despite these hazardous conditions, the property owner has failed to secure the property or take reasonable measures to prevent unauthorized access. As the Authority Having Jurisdiction, Doña Ana

County has a responsibility to protect the health, safety, and welfare of the public. Given the immediate danger posed by the unstable structure and the continued unauthorized access by members of the public, I am requesting authorization to proceed with an emergency demolition to eliminate this imminent hazard before a preventable tragedy occurs

Selection of the particular vendor:

The Doña Ana County Detention Center is requesting the procurement of medical services from Thrive Medical Services, LLC through an emergency procurement process. These services must be provided by a licensed medical services provider to ensure the continued delivery of essential healthcare services to the detention center population.

The County solicited multiple bids as required; however, the County only received a single response.

Unfortunately, this has become a recurring problem. Despite contacting multiple contractors, Crosstown is consistently the only contractor willing to submit bids for these projects. The lack of participation significantly delays our ability to address structures that have been determined to be unsafe and pose a risk to public health and safety.

To ensure a competitive procurement process, the County will issue a new invitation to bid (ITB) for demolition and abatement services. The emergency procurement is intended solely as a temporary measure to demolition the structure as it presents a risk to the residents.
