About this file

This is an Emergency Determination Form submitted by the New Mexico Department of Transportation (NMDOT) for an emergency procurement of Class D Rock (3'-5' rock) from A-1 Quality Redi-Mix, Inc. The procurement was necessitated by severe erosion and scour damage sustained at the bases of two bridge structures spanning the Matanza Arroyo near Socorro, New Mexico following heavy rainfall during the week of September 21, 2026. The affected bridges are located at Interstate 25 milepost 147.5 and New Mexico Route 1 milepost 60.5. The Class D Rock will be delivered and placed at the base of both bridge structures to prevent scour and potential structural washout. The project involves the procurement and delivery of 5,000 tons of material over a 30-day contract term, with actual delivery expected to occur within one day. The emergency procurement was justified based on the immediate threat posed by forecasted additional heavy rainfall that could further compromise structural integrity and result in potential loss of critical transportation infrastructure and danger to the traveling public.

The total contract amount is $459,829.69, awarded to A-1 Quality Redi-Mix, Inc., located at 1141 West Highway 60, PO Box 591, Socorro, New Mexico 87801. NMDOT determined that emergency procurement was the only viable option because the material was not available under existing Statewide Price Agreements, there was no contract with a qualified contractor to place the material, and the quantity needed exceeded the $60,000 threshold allowable under the three-quote procurement process. The agency anticipates that this emergency procurement will be in place only for the duration necessary for vendor delivery. To prevent similar emergencies in the future, NMDOT District One maintenance crews will conduct ongoing structural maintenance and establish in-place statewide price agreements for comparable situations. The emergency procurement was approved by Heather Kent and certified in accordance with NMSA 1978, Section 13-1-127.

2022 Emergency Form

STATE OF NEW MEXICO

EMERGENCY DETERMINATION FORM

The emergency procurement method (NMSA 1978, Section 13-1-127) may only be used when the service, construction or item of tangible personal property procured:

1. is needed immediately to:

a. control a serious threat to public health, welfare, safety or property caused by a flood, fire, epidemic, riot, act of terrorism, equipment failure or similar event; or

b. plan or prepare for the response to a serious threat to public health, welfare, safety or property caused by a flood, fire, epidemic, riot, act of terrorism, equipment failure or similar event; and

2. cannot be acquired through normal procurement methods.

a. The agency entering into an emergency procurement should employ a competitive process to the extent practicable under circumstances.

The purchase or lease of heavy road equipment is not allowed under the emergency procurement statute.

The state purchasing agent or a central purchasing office that makes an emergency procurement shall outline its determination of the basis for the procurement and its selection of the contractor in writing and include the writing in the procurement file. (That writing can be made on this form.) Promptly thereafter:

the state purchasing agent shall post notice of the procurement on its website; or the central purchasing office shall post notice of the procurement on its website, if it maintains one, and shall transmit the notice to the state purchasing agent for posting on the state purchasing agent's website.

NOTE: the state purchasing agent or a central purchasing office that makes an emergency procurement to plan or prepare for the response to a serious threat to public health, welfare, safety or property caused by a flood, fire, epidemic, riot, act of terrorism, equipment failure or similar event shall account for the money spent in making the procurement and report on that accounting to the legislative finance committee and the department of finance and administration within sixty days after the end of the fiscal year in which the procurement was made.

I. Name of Agency: New Mexico Department of Transportation

Agency Chief Procurement Officer: Christina Baca

Telephone Number: (505)469-8800

II. Name of Contractor: A-1 Quality Redi-Mix, Inc.

Address of Contractor: 1141 West Highway 60, PO Box 591 Socorro, NM 87801

Amount of prospective contract: $459,829.69

Term of prospective contract: 30 days

III. Thoroughly list the services (scope of work), construction or items of tangible personal property being procured: The District One office needs to purchase Class D Rock (3’ – 5’ rock) Delivered to two bridges: I-25 MP 147.5 and NM 1 MP 60.5; both bridges span the Matanza Arroyo near Socorro, NM. The rock will be placed at the base of both bridge structures to prevent scour and potential wash out of both structures.

IV. Provide an explanation for the justification of the procurement including a description of the emergency condition(s) requiring use of emergency procurement and the practicable competition utilized in compliance with NMSA 1978, Section 13-1-127. Due to heavy rainfall last week (week of 9/21/26) both bridges experienced significant erosion of material near the base of both structures. Additional heavier rains (forecasted tonight) will further degrade the structural integrity of both structures. We need to purchase Class D Rock, to be placed at the base of the structures to prevent potential wash out and loss of structures. This material is not available on Statewide Price Agreement, nor do we have a contract for a Contractor to place the material, nor can we procure enough material to protect the bridges using a three-quote process (limited at $60k).

Our only viable option is to procure the rock via Emergency Procurement.

V. Describe what measures are being taken to minimize the duration and effect of this particular emergency procurement (for example: is the emergency only in place until a competitive process can be completed, etc.). This emergency procurement will only be in place long enough for the vendor to deliver the rock to the structures that are threatened by the heavy rainfalls (1-day).

VI. Describe what measures the Agency will take in the future to prevent/mitigate use of an emergency procurement under similar circumstances. The District maintenance crews will be performing on-going maintenance activities to shore-up the structural integrity of both bridges and we will ensure that future events such as those that we are experiencing can be mitigated via “in-place” statewide price agreements.

Due to heavy rainfall the week of 9/21/26, two bridges have experienced significant scour and erosion at the base of the support structures. Additional heavier rainfall that is expected tonight may further degrade (and possibly wash out) the structural integrity of both bridges.

One bridge is on I-25 milepost 147.5 and the other bridge is on NM 1 milepost 60.5. Failure to act immediately could result in substantial damage and/or loss of both structures resulting in potential immediate danger to the traveling public as well as prolonged Interstate and New Mexico state route closures. If these bridges wash out, there are no alternate north-south routes in the area.
