About this file

This is a Sole Source Determination Form submitted by the New Mexico Department of Workforce Solutions (DWS) for a contract with the New Mexico Center on Law and Poverty (NMCLP). The contract, valued at $150,000 before tax, will span two years and requires NMCLP to build a statewide framework to track eviction data and inform housing policy and eviction prevention strategies. The scope of work includes hiring a full-time Eviction Data Program Manager to lead project coordination and data analysis, conducting a statewide data needs assessment in collaboration with courts and agencies, convening a cross-sector eviction data problem-solving team comprising state agencies, legal aid organizations, and community partners, building sustainable data infrastructure for ongoing eviction data collection and analysis, and supporting data-informed decision-making to improve housing stability and eviction prevention efforts across New Mexico.

The sole source determination is justified based on NMCLP's unique selection by New America as one of 11 states nationwide to participate in the Eviction Data Response Network (EDRN), which provides $100,000 in grant funding, technical assistance, data tools, and national expertise. The Office of Housing is providing $150,000 in matching funds to support the project, exceeding the minimum 1:1 match requirement. DWS determined that no other New Mexico entity possesses the combination of New America funding and technical assistance necessary to successfully execute this initiative. The agency conducted due diligence by reviewing the New Mexico Procurement Code, researching other eviction prevention entities in the state, and reviewing statewide price agreements before concluding that NMCLP is the only source capable of performing the work. The sole source request was approved on June 30, 2026, by the State Purchasing Agent following certification by the Agency Chief Procurement Officer and Agency Legal Counsel.

The New Mexico Center for Law and Poverty (NMCLP) shall address New Mexico’s

Docusign Envelope ID: F271EE46-2A0C-88B6-83F1-9CCCE87E86E2 mailto:sireesha@nmpovertylaw.org critical need for eviction data by building a statewide framework to track eviction data and inform housing policy and eviction prevention strategies. NMCLP was recently selected by New America as one of 11 states nationwide to participate in the Eviction Data

Response Network (EDRN). Through EDRN, New Mexico shall receive technical assistance, data tools, peer learning, and national expertise to strengthen eviction data systems. The NMCLP shall be responsible for leading a cross-sector team—including state policymakers and key stakeholders—to identify data needs, develop solutions, and support implementation of a sustainable statewide eviction data strategy.

Over the next two years, NMCLP shall lead a coordinated effort to:

1. Hire an Eviction Data Program Manager: This full-time position shall lead project coordination, data analysis, partner engagement, and translation of findings into policy and program improvements.

2. Conduct a Statewide Data Needs Assessment: Work with courts, agencies, researchers, national EDRN technical assistance providers, and community partners to identify data gaps and establish shared standards that make eviction data usable statewide.

3. Convene a Cross-Sector Eviction Data Problem-solving Team: Partners shall include state agencies, legal aid organizations, homeless service providers, courts, community partners, data specialists, and researchers to set priorities and ensure data informs real-world decisions.

4. Build Sustainable Data Infrastructure: Develop agreements, systems, and practices that allow eviction data collection and analysis to continue beyond the grant period.

5. Support Data-Informed Decision-Making: Analyze and identify solutions that improve data sharing and inform housing stability and eviction prevention strategies.

By the end of the project, New Mexico shall have a sustainable framework for collecting, analyzing, and using eviction data statewide. Policymakers, courts, service providers, and community organizations shall have access to better information about eviction trends, geographic areas of greatest need, and opportunities for intervention. This data shall help strengthen eviction prevention efforts and target resources—including legal services, housing assistance, and other supports—to keep New Mexicans stably housed.

VI. Provide a detailed explanation of the criteria developed and specified by the agency as necessary to perform and/or fulfill the contract and upon which the state agency reviewed available sources. (Do not use “technical jargon;” use plain English. Do not tailor the criteria simply to exclude other contractors if it is not rationally related to the purpose of the contract.)

DWS determined that vendor must meet the following criteria in order to build a sustainable framework for collecting, analyzing and using eviction data statewide:

• Capacity and Experience: The entity must have the operational capacity and experience to understand the system for evictions in New Mexico, to engage statewide partners and to utilize the data to inform solutions.

• Financial resources: The entity must have sufficient financial resources to carry out the project.

• Technical assistance support: The entity must have access to skilled technical assistance and data tools to build a sustainable data infrastructure for eviction data collection and analysis.

VII. Provide a detailed, sufficient explanation of the reasons, qualifications, proprietary rights or unique capabilities of the prospective contractor that makes their company the only source capable of providing the required professional service, general service, construction or item(s) of tangible personal property. (Please do not state the source is the “best” source or the “least costly” source. Those factors do not justify a “sole source.”)

In March 2026, the NMCLP submitted an application to a private funder, New America, to be part of the Eviction Data Response Network (EDRN) technical assistance and funding opportunity. In April 2026, New America notified NMCLP that it had been selected.

By being selected, NMCLP becomes eligible to receive a $100,000 grant along with technical assistance to lead a state-level team that builds reliable and comprehensive eviction data and craft policies and programs based on that data.

NMCLP is the only New Mexico entity to be awarded funding and technical assistance through this opportunity. Currently, the process to collect and analyze eviction data in New

Mexico is cumbersome and labor intensive. There is currently no entity working on a coordinated statewide effort to collect and analyze this data or to improve the process for doing so. This is concerning because it means limited data is available to inform policy and programming to be most impactful to reduce evictions in New Mexico.

Office of Housing supported NMCLP’s application and has funds available to support the match requirement. While the minimum match requirement is 1:1, Office of Housing intends to provide $150,000 in match funding to ensure the project is successful.

By receiving funding and technical assistance through the New America grant, NMCLP is uniquely positioned to address the critical need for a statewide coordinated system to collect and analyze eviction data. No other entity in NM is receiving funding and technical assistance to lead a statewide initiative to collect and analyze eviction data, and so no other entity is in a position to lead this work. If Office of Housing were to provide funds to another entity that is not receiving technical assistance and funding through New America, the Office of Housing funds would not be as effectively utilized. Therefore, a sole source procurement method is justified.

VIII. Provide a detailed, sufficient explanation of how the professional service, general service, construction or item(s) of tangible personal property is/are unique and how this uniqueness is substantially related to the intended purpose of the contract.

If Office of Housing were to provide funds to another entity that is not receiving technical assistance and funding through New

America, the Office of Housing funds would not be as effectively utilized. Therefore, a sole source procurement method is justified.

IX. Provide a narrative description of the agency’s due diligence in determining the basis for the procurement, including procedures used by the agency to conduct a review of available sources such as researching trade publications, industry newsletters and the internet;;

contacting similar service providers; and reviewing the State Purchasing Divisions’

Statewide Price Agreements. Include a list of businesses contacted (do not state that no other businesses were contacted), date of contact, method of contact (telephone, mail, e-mail, other), and documentation demonstrating an explanation of why those businesses could not or would not, under any circumstances, perform the contract; or an explanation of why the agency has determined that no businesses other than the prospective contractor can perform the contract.

DWS conducted a thorough review of available sources before determining this sole source procurement:

• Reviewed the New Mexico Procurement Code to identify the appropriate procurement method.

• Researched other entities doing eviction prevention work in New Mexico using online resources.

• Reviewed the State Purchasing Division’s Statewide Price Agreements for relevant services.

• Obtained documentation confirming the NMCLP was selected by New America to receive funding and technical assistance through the Eviction Data Response

Network.

DWS determined that no other entity could perform the work because no other entity has access to the funding and technical assistance necessary to successfully carry out this project.

Agency certifies this sole source submission complies with NMSA 1978, Sections 13-1-28 through 13-1-199, the New Mexico Administrative Code (NMAC) and Governmental Conduct

Act, NMSA 1978, Sections 10-16-1 through 10-16-18.
