About this file

This document is a property use agreement between the State of New Mexico and Lua Union Land and Grazing Company for the use of property as a dip site and water source to fill water tenders during fire suppression efforts. The agreement includes pre-use and post-use inspection sections to document the condition of the property before and after government occupancy. The contract is identified as Agreement No. NM-N4S-000451-103 and was executed on August 18, 2026, with Susan Hobrock serving as the Fire Business Data Analyst for the government and Daniel J. Smith as the Managing Director for the property owner.

The post-use inspection identified damage to a cattle guard located at coordinates 35.9182807, -105.0383571 that occurred during heavy equipment travel over the structure while conducting fire suppression activities. The property owner, through a conversation with Daniel J. Smith, treasurer, estimated the repair cost at $1,000.00, which was added to the total invoice amount due to the vendor. The agreement includes a release of claims statement in which the contractor releases the government from all claims arising under the agreement upon receipt of the final payment, with the total amount due to be determined at the end of the incident.
