A. Evaluation and Contract Award Process: All responses will be reviewed to determine Project qualifications and competence, and qualified respondents will be reduced to a final pre-qualified list of firms or joint ventures (i.e., a "Consultant" list). All responses that meet the minimum evaluation threshold as determined by the City of Buda will be included in the pool of pre-qualified Consultants. Contracts will not be negotiated as a direct result of this solicitation. The pre-qualified Consultant list will be considered a pool of qualified firms from which professional service agreements for contracts with and exclusively on behalf of the City may be negotiated over the next three (3) year period in accordance with Texas statute, federal regulations (when applicable) and with the City’s purchasing policy.
B. Completeness: If a response to the RSQ is incomplete or otherwise fails to conform to the requirements of the

Page 5 of 21 of RSQ #26-013 mailto:Support.Bonfire@eunasolutions.com https://customer.eunasolutions.com/public/s/knowledge-base/bonfire-hub
C. Ambiguity: Any ambiguity in the response to the RSQ as a result of omission, error, lack of clarity or non-compliance by the Offeror with specifications, instructions and all conditions shall be construed in the favor of the City. In the event of a conflict between these standard RSQ requirements and details provided in Appendix A – Scope of Services or Appendix B – Statement of Qualifications, the Appendices shall prevail.
D. Additional Information: City may request any other information necessary to determine Offeror’s ability to meet the minimum standards required by this solicitation.
E. Public Information: The requirements of Subchapter J, Chapter 552, Government Code, may apply to this solicitation and the contractor or vendor agrees that the contract can be terminated if the contractor or vendor knowingly or intentionally fails to comply with a requirement of that subchapter.
F. House Bill 89 Verification Form: Passed by the Legislature in 2017, House Bill 89 prohibits a governmental entity, including a school district, from entering into a contract for goods or services with a company unless the contract contains a written verification from the company that it does not boycott Israel and will not boycott Israel during the term of the contract (Texas Government Code 2270.002). The form must be completed and included in the Offeror’s response, unless exempted by the statute, in order to ensure compliance with House Bill 89. Failure to enclose a verification form may result in Offeror’s response being deemed non-responsive.
G. Contract: For any contracts resulting from being on the pre-qualified Consultant list, the City of Buda will offer for execution its standard form of agreement with the successful firm(s) chosen for award. Firms are welcome to contact the City of Buda’s Purchasing Office to obtain a sample of the City’s standard form of agreement for review. No vendor contracts will be accepted and no adjustments to the legal language within the City’s standard form of agreement will be considered. By submitting a statement in response to this RSQ, the offeror understands and accepts this requirement. Contracts will not be negotiated as a direct result of this solicitation.
V. Required Representations

Appendix A – Scope of Services
I. Description of Services The City of Buda invites statements of qualification from entities with proven expertise in construction inspection of public improvements and infrastructure. Through this RSQ, the City will develop a pre-qualified pool of firms capable of providing comprehensive, professional inspection services to support city staff and manage quality assurance on a range of municipal projects.
Inspection services requested herein may be required to:
• Augment City staff capacity by providing professional inspection and quality assurance for public infrastructure constructed as part of residential and commercial development projects.
• Deliver construction inspection services for Capital Improvement Projects (CIPs) and Bond Projects, ensuring improvements meet municipal standards, approved plans, and applicable codes throughout all phases of construction.
The City will conduct a detailed review of all responses to assess project-specific qualifications, technical competence, and past experience in similar inspection roles. Entities meeting the City's evaluation criteria will be added to the Consultant list, considered pre-qualified for future projects as needs arise during the three-year term. Selection for actual contracts will occur as individual project requirements are identified;
inclusion on the list is not a guarantee of award, and no reimbursement is offered for RSQ response preparation.
The selected Consultant’s scope of work may include, but is not limited to:
• Inspection of erosion and sedimentation controls, transportation infrastructure (roads, sidewalks, ADA features), potable water, reuse water, and wastewater systems, storm drainage, utilities, and related appurtenances.
• Verification of materials, coordinating field and laboratory testing for soils, concrete, asphalt, pipe, and other required construction elements to ensure compliance with City standards and regulatory requirements.
• Review and documentation of contractor progress, quality control actions, and resolution of site issues through clear communication with all project stakeholders, including City staff, developers, contractors, and utility providers.
• Preparation of detailed inspection reports, daily documentation, and coordination of corrective actions to address non-compliance or changes in the scope of work, as directed by the City. Coordination and oversight of punch list activities, final project closeout, and documentation required to achieve formal acceptance by the City.
Firms submitting for this RSQ must demonstrate knowledge of and adherence to the City of Buda’s most current construction inspection standards, technical codes, and permitting processes, as well as all applicable Texas Department of Transportation (TXDOT) and Texas Commissioner on Environmental Quality (TCEQ) standards and specifications. The City of Buda references the City of Austin Transportation, Utility, Environmental, and Drainage Criteria Manuals, Standards Manual, and Standard Specifications Manual.
Inspection staff are expected to ensure that all public infrastructure and development activities comply with the requirements established by the City of Buda, including but not limited to environmental controls, utility installation, roadway and drainage construction, and quality assurance testing. Familiarity with these regulatory frameworks is essential for performing inspections consistent with regional best practices and for supporting the City of Buda in meeting both municipal and state infrastructure standards.
The City reserves the right to adjust the scope of services as necessary following Consultant selection, to meet evolving municipal needs and support the best interests of the community. All work must be completed in accordance with City standards, regulations, and accepted engineering practices. Expanded and improved Description of Services for your RSQ Scope of Services.
