JUSTIFICATION FOR SOLE SOURCE PROCUREMENT (OPEN MARKET OR GSA)
UNDER $250,000
Sole source acquisitions may be used on a limited basis and only when the Contracting Officer’s
Representative (COR)/Program Official has provided sufficient justification and the Contracting Officer has determined that the circumstances warrant such action. The content for a justification must contain detailed facts and rationale to justify the sole source acquisition. Soliciting from a single source must be done in accordance with FAR 13.106-1(b) or 8.405-6. At a minimum, the following information must be included:

Detector (PN: A98089 MD 2), from AB Sciex, LLC. The CESI 8000 High
Performance Separation-ESI Module includes: • High-resolution Separation-
ESI Module with sample storage temperature control (4 - 60°C) and capillary temperature control (15 - 30°C) • UV and Diode Array Detectors • Portable, height adjustable electric lab bench • System controller pre-loaded with CESI
8000 software • System application guide • System start-up reagents, installation and basic training

D. The justification for this non-competitive action is:
☒ In accordance with FAR 13.106-1(b)(1), “only one source [is] reasonably available” which states that, “For purchases not exceeding the simplified acquisition threshold. (i)
Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). (ii)
Where a single source is identified to provide a portion of a purchase because that portion of the purchase specifies a particular brand-name item, the documentation in paragraph
(b)(1)(i) of this section only applies to the portion of the purchase requiring brand-name item. The documentation should state it is covering only the portion of the acquisition which is brand- name.”

E. Other facts supporting sole source procurement:
a. What can this product/service do that other products/services cannot do?
This is a brand name only procurement. CESI-MS Base Unit with UV and
Diode Array Detector (PN: A98089 MD 2), from AB Sciex, LLC, is the first commercial CESI sprayer combined with new capillary electrophoresis (CE) instrumentation specifically designed for Sciex mass spectrometers (MS). CESI combines an intrinsically low flow CE separation with electrospray ionization
(ESI), in the same process, within the same device. The system is designed for analysis of challenging charged & polar metabolites/degradation products such as glyphosate and dialkylphosphate metabolites and other anionic and/or hydrophilic analytes of interest in our laboratory.

b. What other products/services were considered and why did they not meet the need?
There are no other combined capillary electrophoresis electrospray ionization instruments commercially available and fully compatible with AB Sciex mass spectrometers. AB Sciex, LLC is the only company that produces The CESI
8000 High Performance Separation-ESI Module.
F. Program Office efforts to seek potential offerors:
Several market research techniques were used to identify possible alternatives including queries of internet information sources, review of catalogs and product literature, discussions with colleagues and other scientists. No other instrumentation company provides a capillary electrophoresis electrospray ionization instrument that is fully compatible with AB Sciex mass spectrometers.
