About this file
Summary
This is a Justification for Other Than Full & Open Competition (J&A) submitted by the Department of the Navy's NAVSUP WSS (Mechanicsburg, PA) for the acquisition of spare parts for initiators (SQ03: CCU-133/A Impact Initiator and SQ04: BBU-58/A Front Mount Initiator). The acquisition is being conducted as a sole-source contract with Chemring Energetic Devices (CAGE Code 93455) under the authority of 10 USC 3204(A)(1) and FAR 6.302-1 (only one or a limited number of responsible sources can satisfy agency requirements). The items have been classified as Critical Safety Items (CSIs), limiting qualified sources to those with specialized manufacturing and testing capabilities. The parts require engineering source approval by the design control activity to maintain quality; Chemring Energetic Devices is the sole approved manufacturing source and the only vendor possessing the technical data (drawings, specifications, and test equipment/procedures) necessary for manufacturing, testing, and certification prior to delivery.
The solicitation was synopsized on the government-wide point of entry on September 23, 2025. Market research was conducted in accordance with FAR Part 10, including a technical review by an In-Service Engineer Activity (ISEA) and publication of a source-sought notice. Results confirmed that only Chemring Energetic Devices can meet government requirements. A 15 MAR 2019 Class Waiver of the requirement to post an RFI or sources-sought notice applies. The contracting officer determined the anticipated cost to be fair and reasonable. To promote future competition, NAVSUP WSS will continue encouraging vendors with appropriate expertise to submit complete technical data packages for source approval review. The J&A was approved by multiple stakeholders including the Contract Specialist (Ashley Leonard), Competition Advocate (Adam Johnson), and Attorney (Susan Whitley Newburg), with final approval dated October 16, 2025.

A/RMSC C
This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing/repair knowledge by the qualified source(s) require acquisition/repair of the part from the approved source(s). The approved source(s) retain data rights, manufacturing/repair knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity's procedures, as approved by the cognizant Government engineering activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application. If one source is approved, A/RMCs 3, 4, or 5 are valid. If at least two sources are approved or if data is adequate for an alternate source to qualify in accordance with the design control activity's procedures, A/RMCs 1 or 2 are valid.
This acquisition will be solicited to
Chemring Energetic Devices (93455) This item has been deemed a Critical Safety Item (CSI), thus limiting qualified sources. The acquisition of the item listed above will be solicited to Chemring Energetic Devices (93455) because they are currently the only capable source with the technical data required to manufacture, test and certify this item prior to unit delivery and is the sole approved manufacturing source. Since the Navy does not possess sufficient rights to information such as drawings, specifications, and/or test equipment/procedures, a full and open competitive solicitation cannot be supported. Procurement of the item must come from Chemring Energetic Devices (93455). There are no substitutes for the item. Chemring Energetic Devices (93455). these parts are Critical Safety Items and are source controlled. Manufacture of these parts is highly specialized and requires acquisition from source specified.
15 MAR 2019 Class Waiver of the Requirement to Post a Request for Information or Sources Sought Notice applies to this requirement
The proposed contract action was synopsized on the government-wide point of entry on 09/23/2025
Market research was conducted in accordance with far part 10. The results of the market research conducted (or the reason(s) market research was not conducted) are as follows
The latest configuration has been checked and all records (ITIMP, JDRS/ASE, etc.) have been properly aligned, identified, and documented. The Government does not possess sufficient rights in the technical data to distribute them to potential new suppliers of the item. There are no known distributors. An In-Service Engineer Activity (ISEA) technical review was conducted and a source sought notice was published to identify all additional sources or interested vendors. The result of this market research indicates that only the above-name vendor(s) are able to meet the government's requirements.
The contracting officer determines that the anticipated cost to the Government of the supplies covered by this J&A will be fair and reasonable.
