About this file

This is a Justification for Other Than Full & Open Competition (J&A) submitted by NAVSUP WSS-Philadelphia for negotiation and award of contract orders through a Basic Ordering Agreement (BOA Number N00383-26-G-0008) valid through December 31, 2030. The acquisition covers repair and overhaul of various spare parts and components with nomenclature, NSN, and part numbers detailed in Attachment A. The contracting activity justifies the use of other than full and open competition under 10 USC 3204(A)(1) and FAR 6.302-1, citing that only one or a limited number of responsible sources can satisfy agency requirements.

The rationale for single-source procurement centers on Critical Application Items (CAI) and Aerospace Standards Equipment (ASE) approved items that require engineering source approval by design control activities. For CLIN A item A004, identified as a CAI per JDRS, the single approved repair source possesses exclusive technical data, drawings, specifications, and test equipment/procedures that are neither physically available to the government nor economically obtainable elsewhere. Similar restrictions apply to items A001-A003 and A004AA-A008AA, and FMS items C001-C006 (coded RMC/RMCS 3D in ASE), all requiring repair from approved sources with exclusive technical data rights. The contracting officer determined anticipated costs to be fair and reasonable. Market research confirmed no alternative qualified sources exist, with no Source Approval Requests received from interested parties. NAVSUP WSS has no current plans to compete future contracts but will advertise future requirements on the government-wide point of entry to encourage potential vendors to submit Source Approval Requests. The J&A received final approval from the Head of Contracting Activity on November 6, 2025.

Acquire, for the second or subsequent time, directly from the actual manufacturer.

A/RMSC C,D

This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing/repair knowledge by the qualified source(s) require acquisition/repair of the part from the approved source(s). The approved source(s) retain data rights, manufacturing/repair knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity's procedures, as approved by the cognizant Government engineering activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application. If one source is approved, A/RMCs 3, 4, or 5 are valid. If at least two sources are approved or if data is adequate for an alternate source to qualify in accordance with the design control activity's procedures, A/RMCs 1 or 2 are valid.

The data needed to acquire/repair this part competitively is not physically available, it cannot be obtained economically, nor is it possible to draft adequate specifications or any other adequate, economical description of the material for a competitive solicitation. A/RMCS 3, 4, or 5 are valid.

This acquisition will be solicited to

CLIN A. With regards to item number A004. Per JDRS, this item has been deemed a Critical Application Item (CAI), thus limiting qualified sources. The repair of the item listed above will be solicited to because they are currently the only capable source with the technical data required to manufacture/repair, test and certify this item prior to unit delivery and is the sole approved repair source identified in JDRS. All alternate sources must qualify IAW the DCA's procedures, as approved by NAVAIR/NAVSUP WSS Source Development Department prior to contract award. Since the Navy does not possess sufficient rights to information such as drawings, specifications, and/or test equipment/procedures, a full and open competitive solicitation cannot be supported. NAVSUP-WSS must repair the item from to . With regards to items A001-A003 & A004AA-A008AA. The repair of the items listed above will be solicited to because they are currently the only source with the technical data required to manufacture/repair, test and certify this item prior to unit delivery. Since the Navy does not possess sufficient rights to data such as drawings, specifications, and/or test equipment/procedures, a full and open competitive solicitation cannot be supported. NAVSUP-WSS must repair the items from CLIN C. With regards to FMS, items C001 – C006 are listed in ASE and coded with a RMC/RMCS of 3D and will be repaired by because they are currently the only source with the technical data required to manufacture/repair, test and certify this item prior to unit delivery. Since the Navy does not possess sufficient rights to data such as drawings, specifications, and/or test equipment/procedures, a full and open competitive solicitation cannot be supported. NAVSUP-WSS must repair the items from .

History

Market research was conducted in accordance with far part 10. The results of the market research conducted (or the reason(s) market research was not conducted) are as follows

CLIN A. With regards to item A004. The latest configuration has been checked and all records (ITIMP, JDRS/ASE, etc.) have been properly aligned, identified, and documented. This item has been deemed a Critical Application Item, thus limiting qualified sources. Per JDRS/ASE, is the only approved source at this time. The data necessary to solicit this item from sources other than is not physically available and is uneconomical to obtain. With regards to items A001-A003 & A004AA-A008AA. The latest configuration has been checked and all records (ITIMP, JDRS/ASE, etc.) have been properly aligned, identified, and documented. This item’s criticality has not yet been determined. However, the data necessary to solicit this item from sources other than is not physically available and is uneconomical to obtain. CLIN C. with regards to FMS items, the latest configuration has been checked and all records (ITIMP, JDRS/ASE, etc.) have been properly aligned, identified, and documented. These items are ASE approved items, and are FMS only items, thus limiting qualified sources. Per ASE, is the only approved source at this time for this repair. The data necessary to repair these items from sources other than is not physically available and is uneconomical to obtain at this time. The available technical data is insufficient for the development of new sources. Source Development Department files indicate no Source Approval Request (SAR) has been received from any party interested in becoming an approved source. is the only approved source at this time.

The contracting officer determines that the anticipated cost to the Government of the supplies covered by this J&A will be fair and reasonable.

For reasons set forth in Section (5 & 6), NAVSUP WSS has no plans, at this time, to compete future contracts for the subject item covered by this document. If another potential manufacturing source emerges, NAVSUP WSS will assess whether competition for future requirements is feasible. Also, future requirements will be advertised in the government-wide point of entry in order to encourage potential vendors to submit Source Approval Requests.
