About this file
This is a Justification for Other Than Full & Open Competition (J&A) issued by the Department of the Navy, NAVSUP WSS (Naval Supply Systems Command Weapon Systems Support) located in Philadelphia, Pennsylvania.
The acquisition covers repair/overhaul services for a Night Device Adapter (NSN 5855-01-614-7970, P/N 720200-04-01) with an expected final delivery date of November 5, 2025. The procurement is being conducted as a non-competitive action under the authority of 10 USC 3204(A)(1) and FAR 6.302-1, justified by the determination that only one responsible source can satisfy agency requirements. The item has been designated a Critical Application Item (CAI), limiting qualified sources to a single approved repair source that possesses exclusive technical data, drawings, specifications, and test equipment/procedures essential for repair, testing, and certification. The Navy does not possess sufficient intellectual property rights to solicit alternative sources, making full and open competition infeasible. Market research was conducted per FAR Part 10, and a 15 MAR 2019 Class Waiver of the requirement to post a Request for Information or Sources Sought Notice applies. The Source Development Department has received no Source Approval Requests from interested parties seeking approval as alternate sources. The Contracting Officer determined the anticipated cost will be fair and reasonable. The contract action was synopsized on the government-wide point of entry. The J&A was created November 5, 2024, and received final approval from the Competition Advocate on March 14, 2025, with legal sufficiency certification dated March 7, 2025.

This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing/repair knowledge by the qualified source(s) require acquisition/repair of the part from the approved source(s). The approved source(s) retain data rights, manufacturing/repair knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity's procedures, as approved by the cognizant Government engineering activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application. If one source is approved, A/RMCs 3, 4, or 5 are valid. If at least two sources are approved or if data is adequate for an alternate source to qualify in accordance with the design control activity's procedures, A/RMCs 1 or 2 are valid.

All alternate sources must qualify IAW the DCA's procedures, as approved by NAVAIR/NAVSUP WSS Source Development Department prior to contract award. Since the Navy does not possess sufficient rights to information such as drawings, specifications, and/or test equipment/procedures, a full and open competitive solicitation cannot be supported.
