About this file

This is a Justification for Other Than Full & Open Competition (J&A) document issued by the Department of the Navy, NAVSUP WSS in Philadelphia for the negotiation and award of a Basic Ordering Agreement (BOA) through other than full and open competition.

The acquisition covers repair and overhaul services for Maritime Atmospheric Control Materials through a BOA with Hamilton Sundstrand Corporation (CAGE 26581), valid through August 12, 2031 (five years). The J&A is based on 10 USC 3204(A)(1) and FAR 6.302-1, citing that only one or a limited number of responsible sources can satisfy agency requirements. The specific justification uses A/RMC codes 3 and 4, indicating acquisition from the actual manufacturer both for second/subsequent time and first-time purchases, with A/RMSC code R applied because the Government does not own the data or rights necessary to procure repair services from alternative sources, and it is uneconomical to purchase the data rights or reverse engineer the items. Market research conducted through multiple Government databases (ITIMP, FLIS, MBPS/Windchill, and ERP) identified Hamilton Sundstrand as the only known approved manufacturing and repair source, with no identified distributors or substitutes. The document includes attestations from Requirements Cognizance, Technical Cognizance, Source Validation Cognizance, the Contracting Officer, Competition Advocate, and Legal Sufficiency review, all certified between February 12 and April 13, 2026. The proposed action was synopsized on the government-wide point of entry on March 19, 2026, and a Class Waiver of the Requirement to Post a Request for Information or Sources Sought Notice applies to this requirement.

A/RMSC R

The Government does not own the data or the rights to the data needed to purchase / contract repair of this part from additional sources. It has been determined to be uneconomical to buy the data or rights to the data. It is uneconomical to reverse engineer the part. This code is used when the Government did not initially purchase the data and/or rights. If only one source has the rights or data to manufacture/repair this item, A/RMCs 3, 4, or 5 are valid. If two or more sources have the rights or data to manufacture/repair this item, A/RMCs 1 or 2 are valid.

This acquisition will be solicited to

26581, HAMILTON SUNDSTRAND CORPORATION The repair of the items listed in ATTACHMENT A will be solicited to HAMILTON SUNDSTRAND CORPORATION (CAGE 26581) because they are currently the only source with the technical data required to manufacture, repair, test and certify this item prior to unit delivery. Since the NAVY does not possess sufficient rights to data such as drawings, specifications, and/or test equipment/procedures, a full and open competitive solicitation cannot be supported. NAVSUP-WSS must procure repair of the items in ATTACHMENT A from HAMILTON SUNDSTRAND CORPORATION (CAGE 26581). There are no substitutes for this material. Items in ATTACHMENT A have RMC/RMSC codes of 3R (acquire from actual manufacturer, data rights not owned by government) and RMC/RMSC 4R (acquire from actual manufacturer first time, data rights now owned by government).

15 MAR 2019 Class Waiver of the Requirement to Post a Request for Information or Sources Sought Notice applies to this requirement

The proposed contract action was synopsized on the government-wide point of entry on 03/19/2026 and as a result

Market research was conducted in accordance with far part 10. The results of the market research conducted (or the reason(s) market research was not conducted) are as follows

A technical review, which consisted of searching several Government databases including ITIMP, FLIS, MBPS/WINDCHILL and ERP, has been completed on this item. Search criteria included Part Number, Design Control Activity, Cage Code, NSN, Nomenclature, AMC/AMSC, AAC, Criticality Coding, recorded approved sources of supply, historical sources of supply and past contracts. Based on this market research, the technician has determined that the only known approved manufacturing repair source is HAMILTON SUNDSTRAND CORPORATION, CAGE 26581. A review of the data bases listed in the market research did not reveal nor identify any known distributors or substitutes.
