About this file

This document is a Sole Source Justification for Commercial Items (J&A) issued by the Department of the Navy's NAVSUP WSS (Naval Supply Systems Command Weapon Systems Support) in Mechanicsburg, PA. The justification is for procuring a relief valve (NSN 1HM 4820 010742177 X5, Part Number 202030QM51M) through a non-competitive acquisition method. The procurement is based on statutory authority 41 U.S.C. 1901 and Federal Acquisition Regulation Subpart 13.5, with the primary rationale being that the government cannot obtain the technical data rights to manufacture or repair the part from alternative sources, and reverse engineering would be uneconomical. The required delivery date is 02/26/2027, and NAVSUP WSS indicates they will continue to encourage potential vendors to submit technical data packages to enable future competition, though they currently have no plans to compete this specific contract.

The contracting officer determines that the anticipated cost to the Government of the supplies covered by this J&A will be fair and reasonable.

To promote competition, NAVSUP WSS will continue to encourage vendors with the expertise to manufacture/repair the subject item to submit a complete technical data package for review and source approval by the appropriate engineering source approval authority per the (WSS) guidelines. Also, future requirements will be advertised on the government-wide point of entry. For reasons set forth in Paragraph (5 & 6), NAVSUP WSS has no plans at this time to compete future contracts for the subject item covered by this document.
