JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
Project Number: 6MI0225 Lease Number: GS-05P-LMI17119
Social Security Administration (SSA) Kalamazoo, MI
1. Identification and Description of Action Being Approved:

SSA has requested approval for a new lease to service this area, but has not yet received approval from its National Office. Consequently, the current lease will expire prior to awarding a new/replacing lease, unless this action is approved.
The office provides vital public services provided by the Social Security Administration.
2. Description of Supplies or Services Required:
Approval is being requested to award a lease extension using other than full and open competition. The current annual rent is $21.14/RSF, including parking, and permission is requested to extend the lease for a term of three years, two years firm, to allow for completion of the New/Replacing Lease.
3. Identification of Statutory Authority:
41 U.S.C. 3304 (a)(1). Only one responsible source and no other supplier of services will satisfy the agency requirements.
4. Demonstration that the Acquisition Requires use of the Authority cited:
Contracting without full and open competition is permitted when the property or services needed by the agency are available from only one reasonable source and no other type of property or services will satisfy the needs of the agency.
GSAM Section 570.402-4 states that, if any potential acceptable locations through the advertisement or the market survey are identified, a justification to negotiate directly with the present lessor is to be prepared.
5. Description of Efforts to Solicit as Many Offers as Practicable:
A temporary lease extension is required to bridge the time from the expiration of the current lease until the effective date of a New/Replacing Lease.
6. Demonstration that the Anticipated Cost will be Fair and Reasonable:
Based on market research, the anticipated rental rate for the extension will be less than market in Kalamazoo, MI.
7. Other Facts Supporting the use of Other Than Full and Open Competition:
N/A
8. List of Sources that Expressed an Interest in the Acquisition: N/A
9. Statement of Actions to Overcome Barriers to Competition:
There were no unusual barriers to competition identified in this procurement action. Upon termination of the succeeding lease to be awarded during the term of the temporary extension of this action, it is anticipated that if a continuing need exists, the space will be provided through full and open competition.
Contracting Officers Determination and Certification:
I certify that this justification for other than full and open competition is complete and accurate to the best of my knowledge and belief and that it is the best interest of the Government.
