About this file

This is a Justification for Other Than Full and Open Competition (OFTOC) document for an unevaluated lease renewal by the General Services Administration (GSA) Public Buildings Service (PBS).

The GSA seeks to renew the office lease for the U.S. Citizenship and Immigration Services (USCIS) at 2150 Parklake Drive NE, Atlanta, Georgia 30345, covering 67,996 ABOA/78,194 rentable square feet (RSF). The current lease expires December 23, 2026, and approval is requested to renegotiate a five-year, three-year firm unevaluated renewal option with the incumbent lessor without competitive solicitation. The renewal is justified under 41 U.S.C. 3304(a)(1) and GSAR 570.402, which permit sole-source renewal when relocation would result in substantial duplication of costs unrecoverable through competition. The cost-benefit analysis demonstrates that relocation costs and replication of existing tenant improvements make remaining at the current location more economical for the Government. The proposed rental rates fall within the fair and reasonable market range of comparable Atlanta properties identified through CoStar market research. Market research conducted on July 13, 2026, identified thirty-three potentially acceptable alternative locations within the delineated area, and a SAM.gov advertisement posted May 12, 2026, for eleven days generated one expression of interest from the incumbent lessor. The facility meets USCIS requirements with proximity to public transportation and allows the agency flexibility to develop long-term space requirements while maintaining continuity of operations.

3. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION.

41 U.S.C. 3304(a)(1): Only one responsible source and no other supplies or services will satisfy agency requirements. This statutory authority is implemented through: FAR 6.103-1 (GSA Class Deviation RFO- 2025-06) and GSAR 570.402. In accordance with GSAR 570.402, use of the sole source authority is appropriate where it is determined that award to any other offeror would result in substantial duplication of costs to the Government that are not expected to be recovered through competition.

4. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR

NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED.

It is in the best interest of the Government to remain at the current location. Award to other than the current Lessor would require relocation of the entire requirement and would cause USCIS to incur move and replication costs that would not be recovered through competition. Relocation costs are estimated to be . Additionally, this allows the Government to make use of existing tenant improvements, avoiding replication costs of . A cost-benefit analysis, attached, was completed following the procedures set forth in GSAR 570.402-6. The cost of relocating CIS using the low-cost quote exceeds the cost of remaining at 2150 Parklake Dr NE, Atlanta, GA 30345. The total savings to the Government is .

5. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS

MANY POTENTIAL SOURCES AS IS PRACTICABLE.

Per the requirements of GSAR 570.402, the GSA Lease Contracting Officer placed an advertisement on the Contracting Opportunities domain of SAM.gov on 5/12/2026, for eleven (11) days. In addition, Public Properties, GSA Broker Contractor, conducted market research using CoStar.

6. DEMONSTRATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE

GOVERNMENT WILL BE FAIR AND REASONABLE.

Recent market surveys conducted by Public Properties, GSA Broker Contractor, in Atlanta, GA showed the rental rate within the delineated area ranges from per RSF (see attached market research).

Therefore, the proposed rental rates for this succeeding lease of , are within the current market range for this submarket and are deemed fair and reasonable by the GSA Lease Contracting Officer.

7. DESCRIPTION OF MARKET RESEARCH CONDUCTED AND THE RESULTS.

GSAR 570.402-5 allows for negotiation with the incumbent Lessor when a cost-benefit analysis shows that the Government cannot expect to recover relocation and duplication costs through competition.

On 7/13/2026, Public Properties, GSA Broker Contractor, conducted market research using CoStar and identified thirty-three (34) potentially acceptable locations (thirty-three plus the incumbent) that might meet the agency’s needs within the delineated area. Buildings identified are located within the delineated area and have at least 78,000 RSF of contiguous space available. In addition, PBS posted an advertisement conforming to GSAR 570.402-2 on the Contract Opportunities domain of SAM.gov website on 5/12/2026. GSA received one (1) expressions of interest in response to the advertisement from the incumbent Lessor. The incumbent Lessor’s expression of interest indicated that the rate would be per RSF.

See Figure 1 below for the results of the market research and SAM.gov advertisement, including the incumbent.
