RESPONSES TO SUPPLIERS’ QUESTIONS

QUESTION: What is the remedy if the government should default (e.g., fail to make payments) on the contract?

ANSWER: All clauses referenced in Solicitation Number 697DCK-20-R-00242 apply. It is the Offeror’s responsibility to fully review the current RFO. Failure to do so will be at the Offeror’s own risk. The RFO states the clauses that are incorporated by reference. Full text clauses can be found at https://fast.faa.gov/contractclauses.cfm. Issues involving default and remedies to default are addressed in Solicitation Number 697DCK-20-R-00242 by the Prompt Payment Act (3.3.1-17) and the Disputes Clause (3.9.1-1).

QUESTION: What is the contracting legal entity name and legal address?

ANSWER: United States of America, by and through the FAA, 1701 Columbia Ave., College Park, GA

30337

QUESTION: Our entity information is not listed in the SAM database. Who do we need to contact so we can get this updated?

ANSWER: You will need to register your company to the SAM website. The SAM link is as follows: https://sam.gov/SAM/

QUESTION: How does that contracting process work? Do we use our (the Supplier’s) Master Terms and Conditions with contract language incorporating Solicitation#697DCK-20-R-00242 into the Agreement?

ANSWER: The FAA does not accept proposals with exceptions or supplemental terms and conditions including Contractor’s “Master Terms and Conditions”. The FAA views this question and clarification as an exception to Solicitation Number 697DCK-20-R-00242 and the FAA does not agree to these exceptions. All clauses referenced in Solicitation Number 697DCK-20-R-00242 apply. If you take exception to the FAA’s Solicitation Number 697DCK-20-R-00242, your proposal will be rendered unresponsive and unacceptable.

QUESTION: Our team wanted to know if there is any anticipated load variances expected at the site either Covid-19 related or otherwise planned for the contract period. Can you please advise?

ANSWER: The FAA does not guarantee that there will be no changes to electrical usage at the site. The FAA is not expecting any significant reductions to the electric usage associated with the Covid-19 virus. The majority of the large energy consuming devices (chillers, computer servers, lighting, etc.) are still operating as normal. In addition, there are no anticipated or planned activities that would have any significant impact to the load variances during the term of the supply contract.
