SECTION C: Specification/Statement of Work

C.1 SPECIFICATIONS

Note: See Attachment J-1 for N.S. Savannah technical specifications/drawings.

C.2 STATEMENT OF WORK (SOW)

The U.S. Department of Transportation (DOT), acting by and through the Maritime Administration (MARAD), holds a U.S. Nuclear Regulatory Commission (NRC) 10 CFR Part 50 license (License no. NS-1, Docket 50-238) to “possess but not operate” a mothballed, defueled, 80MWth pressurized water nuclear reactor and power plant located onboard the vessel (the word “ship” is used interchangeably throughout) Nuclear Ship SAVANNAH (NSS). The NRC license is bounded by the outer perimeter of the vessel, such that all operations and retention activities onboard the NSS are subject to inspection and oversight by the NRC. The license remains in effect until facility decommissioning is completed, and confirmatory surveys permit it to be terminated.

In accordance with the NRC license and MARAD’s Post Shutdown Decommissioning Activities Report (PSDAR), NSS is maintained to a baseline condition of protective storage. This work is characterized by maintenance of a radiological protection program to safeguard workers and the environment; active surveillance, monitoring and maintenance of the nuclear facilities housed onboard the ship; and custody, staffing, and maintenance (together referred to as husbandry) of the ship as the primary physical boundary and protective barrier of the licensed site. License Amendment 15 (April 2018) allows dismantlement and disposal of the ship’s nuclear facilities, which will be carried out following the DECON and License Termination chapters of the PSDAR.

The activities of protective storage and decommissioning are collectively referred to as MARAD’s licensed activities. MARAD maintains a licensee organization to administer these licensed activities. This organization is known as the SAVANNAH Technical Staff (STS). The STS is made up of a combination of direct employees, contractors (including this contract) and other government partners, who together provide the comprehensive nuclear competencies required of a licensee by the NRC.

This contract supports MARAD in its conduct of licensed activities, including the physical custodial care and safeguarding of the NSS. The Contractor shall provide nuclear services to MARAD including: a) specialized technical expertise in licensing and operations; b) specialized technical services, labor, equipment and supplies to carry out radiological protection, monitoring, RFP# 693JF719R000021, Page 14 and surveillance programs; c) engineering, planning, labor and supervision to carry out decommissioning industrial dismantlement activities and handle and package waste materials and

The Contractor shall provide administrative support to ensure that all requirements of the contract are accomplished in a timely and efficient manner.

C-1.1. National Historic Landmark Status

The NSS is a National Historic Landmark (NHL) of the United States. All work activities on the site must conform to requirements stemming from the National Historic Preservation Act of 1966, as amended (NHPA), and relevant historic preservation regulations (36 CFR 800) and executive orders including Preserve America (E.O. 13287 dated 2003).

C-1.2. Types of Licensed Activities

The contract activities are divided into two types that align with the two license conditions identified in C-1. The types are the protective storage condition, and decommissioning. The following paragraphs describe the types; the contractor effort for each type is discussed in C-7.

C-1.2.1. PROTECTIVE STORAGE (BASELINE CONDITION)

The NSS is located in the Port of Baltimore, Maryland, in a condition of attended protective storage comparable to the 1974 Mothballing criteria of NRC Regulatory Guide (RG). This licensed activity type involves ship husbandry and custodial care, maintenance of the physical facilities and structures onboard the ship, and the spectrum of surveillance, monitoring and radiological protection programs necessary to ensure the safety and health of the public and the environment. This protective storage condition shall remain in effect until the NRC license is terminated.

C-1.2.2. DECOMMISSIONING

The decommissioning licensed activity type includes industrial dismantlement and license termination activities, and will be performed at a MARAD-contracted lay-berthing facility.

C-2.1.1.4. Work Identification, Control and Management

The STS Work Control Process procedure (STS-002-007) defines the process to identify, classify, authorize, plan, schedule, procure, execute, and document work performed on the NSS. The Business and Risk Manager (BRM) key person is designated in the procedure to manage the STS Work Control Process. All STS work-related activities are tracked in a Comprehensive Action Tracking System (CATS). This database is used to track and provide status of various actions including:

• Commitments;

• Corrective Actions (CAR - Reports and Resolutions);

• Surveillances;

• Work Orders;

• Training;

• Correspondence and Reports; and,

• Self-Assessments, Audits, and Effectiveness Reviews.

The BRM has primary responsibility for entering and tracking items in CATS. The Contractor shall identify any additional persons requiring access to CATS, and the type of access required.

Work is defined as activities conducted to perform corrective actions, preventative and corrective maintenance, modifications and surveillances. These activities are conducted as part of deficiency resolution or in compliance with procedure requirements. Deficiency is a standard MARAD management term used to describe conditions on a vessel that require correction. Such conditions may include non-conformities; deteriorations of structure, systems and equipment related to age, normal wear and tear, or damage; and scheduled maintenance repair and regulatory inspections.

RFP# 693JF719R000021, Page 17

Deficiencies may be discovered in the process of performing routine inspections and surveillances, or may be identified as long-term planning actions. Deficiencies may be identified by the Contractor and/or MARAD.

Minor deficiencies shall be corrected by the Contractor as an integral part of his daily work routine using onboard available resources. Major and critical deficiencies are corrected through the work control process, and may be corrected using in-house resources, or may require procurement of services or supplies. Work Orders generated for the correction of major and critical deficiencies shall form the basis for such procurements.

C-2.1.1.4.1. MANAGEMENT SYSTEMS

MARAD employs ABS Nautical Systems Enterprise (hereinafter referred to as NSE) software.

NSE is a comprehensive management suite that integrates competitive budget and resource management, procurement, inventory management, preventive and corrective maintenance and repairs, surveys and inspections and major projects (e.g., drydocking). The NSS is a standalone facility that does not compete for resources in a shared budget pool; nor is the vessel equipped, outfitted or maintained for seagoing service. MARAD has adapted NSE for certain NSS business practices; principally the Preventive Maintenance Program and inventory management. The NSE application also hosts the CATS database, and the application allows for the generation and routing of work controlling documents such as Work Authorizations and Work Orders. Contractor personnel will be provided access to NSE and training to employ the various applications.

C-2.1.1.5. Physical Security and Fire Protection

MARAD and the Contractor share responsibility for ensuring the physical security and safety of the NSS. The Contractor carries out its responsibilities through actions described in this SOW and STS procedures. The NSS is not subject to the requirements of the Maritime Transportation Security Act (MTSA) or the International Ship and Port Security (ISPS) Code. Security protocols for the NSS acknowledge and respond to threat conditions promulgated by the Department of Homeland Security and the cognizant USCG Captain of the Port. Such protocols include:

• Internal and external security,

• Heightened security conditions,

• Security risk assessments, and

• Security reporting and drills.

The STS Vessel Security Plan (STS-007-VSP) codifies these protocols.

C-2.1.1.5.1. ACCESS CONTROL

Access to the NSS site is controlled in accordance with the provisions of the TS and NRC regulations. The STS Site Access Control procedure (STS-002-004) defines the methods by which access to the site is managed. The Contractor-provided Watch Stander is designated in the procedure to manage daily personnel access, and provide accountability for all persons on duty

RFP# 693JF719R000021, Page 18 each day. The Contractor shall have a Watch Stander onsite and on duty at all times during core working hours.

Related access control requirements include the daily site lockup; daily surveillances of the RCA doors and accesses listed in the Technical Specifications and the fore/aft flotation marks; and weekend site inspection. These are Technical Specification (TS) requirements. Contractor personnel are required to perform these functions and complete the appropriate procedural checklists. The governing procedures are Site Lockup Procedure and Checklist (SIC-TS-D-4), Surveillance, Inspection and Calibration (STS-004-004), and Inspection Checklist for Site Patrol, Technical Specification 3.7.1.5 Doors and Draft Marks (SIC-TS-D-1). The TS surveillances are performed daily; in-person when the ship is staffed, and remotely on weekends, holidays, and when the ship is closed due to inclement weather or for other reasons (see C-6.1). If remote monitoring systems are not available, the Contractor must carry out the inspection or surveillance in-person. If conditions preclude both remote and in-person inspection or surveillance, the Contractor must immediately notify MARAD. Weekend and holiday inspections are essential services, and shall be included in the firm-fixed price regardless of the method of completion.

The Contractor may be tasked to provide temporary security services. The additional security services shall be procured through the T&M CLIN.

C-2.1.1.5.2. ALARM MONITORING AND RESPONSE

Under the vessel and facility turnover, the Contractor shall assume responsibility for the two alarm systems central monitoring and service contracts. The Contractor is responsible to respond to alarms in accordance with the provisions of procedure STS-007-001, Abnormal & Emergency Conditions, and to have personnel and resources available for such response at all times. Alarm response is an essential service.

C-2.1.1.5.3. FIRE PROTECTION AND SUPPRESSION

The STS Fire Protection Plan (STS-008-003) describes fire protection controls; responses to fires are described in STS-007-001, Abnormal & Emergency Conditions.

All original CO2 fixed fire suppression systems are disabled and inactive; CO2 bottles are evacuated and empty. A fixed FM 200 fire suppression system is fitted to the ship’s paint locker and is in-service. The ship’s fire main is not in service. Fire stations are equipped with certified and serviced fire extinguishers.

The NSS is not staffed or equipped to organize and maintain a fire party. Fire suppression is permitted only at the incipient or discovery stage of a fire, and is limited to use of fire extinguishers. All other active firefighting or suppression requires offsite first responders.

The Contractor shall provide inspection and servicing of fire extinguishers and related equipment;

coordinate and conduct pre-fire planning with the local fire station; and arrange and coordinate fire drills and exercises among ship’s personnel and local first responders. Based on the planned work activities, the Contractor shall provide and designate a Fire Protection Engineer on an as-

RFP# 693JF719R000021, Page 19 required basis to fulfill the procedural responsibilities of that position as described in STS-008- 003, Fire Protection Plan.

C-2.1.1.5.4. EMERGENCY PREPAREDNESS AND RESPONSE

In addition to the requirements of the Emergency and Port Operating Plan (STS-007-EPOP), the Contractor shall take precautions to protect personnel and the ship in the event of an in-port threat or emergency (including acts of God, e.g., weather events, earthquake, etc.). The Contractor shall:

• cooperate with local authorities and responders during emergency situations;

• execute emergency and security plans and work with the lay-berth facility owner and USCG authorities as required;

• coordinate emergency preparedness and response efforts with cognizant MARAD authorities; and,

• prepare and submit SITREPs as requested by MARAD.

C-2.1.1.5.5. EVENT REPORTING

The Contractor shall notify the COR whenever a significant event occurs onboard. Significant events and reporting timelines are included in Abnormal & Emergency Conditions (STS-007- 001). When the FSM position is filled by a MARAD incumbent, that incumbent shall be notified of all other events, with guidance on such reporting developed through mutual understanding of the parties. When the FSM position is vacant, and Contractor personnel are filling the non-governmental functions of the position, the Contractor shall report events to the COR under the same terms described for the FSM.

The Contractor is not authorized to make direct reports to the NRC, other federal, state or local entities, or to non-STS persons at MARAD.

C-2.1.1.6. Official Visitation

Section C-4.1 covers public access, visitation and required safety training for access. Official visitation pertains to those personnel who are routinely expected to be associated with the vessel and are specifically authorized to come onboard. Official visitors may include Contractor personnel beyond those directly employed on the vessel and contract; personnel associated with unions representing credentialed merchant mariners employed on the vessel; vendors and subcontractors acting in their official capacity; regulatory body inspectors; MARAD and other Government personnel; other contractors under MARAD or Government contract; and entities with whom MARAD conducts business.

Official visitors are not considered members of the public, and are subject to the procedural requirements for visitor training / escort of STS-002-004, Site Access Control rather than STS- 002-007, Public Access.

C-2.1.1.7. Safety and Environmental

RFP# 693JF719R000021, Page 20

NSS Safety and Environmental standards, practices and requirements are embodied in the Environmental, Safety and Health Manual (STS-008), and it’s implementing plans and procedures. The Contractor shall be responsible for safety and environmental compliance acting through the STS procedures program.

C-2.1.1.7.1. SAFETY MANAGEMENT

MARAD manages safety on NSS as a blend of nuclear and maritime safety practices and programs. Because the NSS does not meet the regulatory prerequisites for the ISM Code, that code is not directly invoked on NSS, and MARAD employs an NSS Safety Management System (SMS) in its place. As noted in C-2-1.1.2, Procedures Program, the Contractor shall not directly apply an ISM program onboard the NSS, and must instead incorporate any required ISM plans, programs and procedures into STS procedures (see also C-2.3.4.6, Marine Practices and Standards). The NSS SMS is described in STS-008-001, Safety, Health and Environmental Management Plan. The plan describes the blending of the nuclear and maritime safety elements for application on the NSS site, and includes by reference such provisions of this SOW and STS procedures as are necessary to avoid duplication of effort. The NSS SMS directly invokes the NRC SCPS and SCWE as required under the license.

The STS Corrective Action Process (STS-003-002) is the governing procedure and primary element of the NSS SMS for evaluating the safety significance of problems, setting priorities in correcting problems, and tracking them until they have been corrected. The Contractor shall manage the STS corrective actions program.

The Contractor shall maintain a deck log whenever a staff of any size is onboard. The Contractor shall conduct safety training, drills, and actual practice in accordance with the STS SMS or procedure as may be appropriate. Safety information, including below list, shall be recorded, as applicable, in the deck log:

• Emergency Drills and Training;

• Security Drills and Training;

• Safety Meetings and Training; and

• Injuries and Other Medical Attention.

The Contractor shall manage occupational safety and health act implementation and compliance.

If the Contractor publishes company safety bulletins, newsletters or announcements, the Contractor shall include MARAD on their distribution.

In addition to the required periodic effectiveness reviews of the SMS and implementing procedures, a periodic review or audit of the STS SMS may be conducted by the MARAD Office of Ship Operations Safety Program. The MARAD Safety Program requires an annual material condition / safety inspection, that may be performed by that office, or as a self-inspection. An NSS-specific Safety Checklist is included in the Technical Procedures Manual (STS-006 series), and shall be employed for self-inspections. If the inspection is performed externally, the

Contractor shall cooperate with the inspection team as required.

C-2.1.1.7.2. PERSONAL PROTECTIVE EQUIPMENT

The Contractor shall maintain the on-board stock of employer-supplied personal protective equipment (PPE), including: hard hats, gloves (appropriate to the task at hand); eye and ear protection gear, flashlights and batteries, and personnel communication equipment (walkie-talkies/pagers) with chargers. The stockshall cover all STS personnel and in-service damage. An allowance of required PPE for up to fifteen (15) official visitors shall also be maintained. The stock shall be replenished as required due to damage, wear, and expiration.

The Contractor’s PM shall enforce the use of PPE by all personnel in all areas and situations subject to the use of PPE.

C-2.1.1.8. Environmental Compliance

C-2.1.1.8.1. ENVIRONMENTAL TESTING, MONITORING AND SURVEILLANCE

MARAD maintains a radiological and environmental surveillance program that includes semi-annual sampling of land, water and sediment in the area surrounding the ship’s berth, and offsite control locations. The Contractor shall carry out the surveillance program using a combination of ship’s equipment and contractor-provided radiological protection equipment specified in this

SOW.

C-2.1.1.8.2. DISCHARGES

MARAD vessels are subject to National Pollutant Discharge Elimination System (NPDES) permitting under Section 402 of the Clean Water Act, and operational vessels are permitted for specific vessel discharges under the Vessel General Permit (VGP). Because the NSS is not an operational vessel with operational discharges, the management of storm water runoff is the predominant discharge issue. Guidance on discharges shall be provided by MARAD post contract award.

C-2.1.1.8.3. HAZARDOUS AND RADIOLOGICAL MATERIALS MANAGEMENT

Hazardous materials are defined and regulated in the United States primarily by laws and regulations administered by the U.S. Environmental Protection Agency (EPA), the U.S.

Occupational Safety and Health Administration (OSHA), the U.S. Department of Transportation (DOT) and the NRC. The Contractor shall be responsible for the life cycle management of all such materials used on NSS during the period of this contract. The following STS procedures directly bear on NSS hazardous materials management: a) STS-008-002 Health and Safety Plan;

b) STS-008-004 Hazardous Materials Management Plan; c) STS-008-005 Asbestos Management Plan and d) STS-008-006 Lead Management Plan.

RFP# 693JF719R000021, Page 22 material that has no further economic value and is to be left undisturbed, stored, or shipped to a decontamination, volume reduction, or disposal facility. Radiological materials also include sealed sources employed in the radiological protection program and incidental materials dating from the construction and operation of the NSS. Radiological waste materials are generated from the conduct of the radiological protection program and decommissioning activities. The Contractor shall be responsible for the life cycle management of all such materials used or generated on NSS during the period of this contract. The following STS procedures directly bear on NSS radiological materials management (all prefixed STS-005): a) 001 Radiological Protection Plan; b) 002 Personnel Contamination and Decontamination; c) 003 Radiation Work Permit; d) 010 Free Release of Material; e) 013 Radioactive Material Shipping and Handling; f) 019 Chain of Custody of Samples; g) 021 Radiological Ventilation Unit Use and Control; h) 022 Radioactive Waste Process Control Plan; i) 023 Low Level Radiological Waste Management Plan and j) 024 Mixed Waste Management Plan.

Fixed hazardous materials are present onboard the NSS in the form of coatings, insulation, and non-structural members (principally joiner bulkheads and ceilings). Fixed hazardous materials include paint containing chromates, PCBs and asbestos (other materials may also be present).

Such materials are anticipated to be left undisturbed for the performance of this contract, except when repairs, modifications or upgrades to spaces containing these materials are contemplated.

When or if required, remediation or removal of these materials shall be carried out in full compliance with all applicable laws and regulations. The TSIM own-staff is not required to be qualified to perform remediation of asbestos or lead paint hazards. The presence and hazards of these materials is covered in the content of STS General Employee Training, and Visitor Safety Briefing. The Contractor shall ensure that all persons entering the NSS are notified of the presence of hazardous materials onboard NSS.

Other non-fixed hazardous materials shall be managed by the Contractor in such a manner as to maintain minimum quantities onboard; to retain only those materials with an adequate shelf life for the expected use; to ensure proper labeling, handling and recordkeeping during all phases of use; and to ensure lawful disposal. At no time, shall the Contractor transfer hazardous materials (including donation) to any private sector, state or local entity, other than for lawful disposal. To the extent not otherwise provided in this SOW or STS procedures, the Contractor shall develop and maintain policies and procedures for the procurement, receiving, handling, stowage, and use of non-fixed hazardous materials. The Contractor shall inventory hazardous materials annually, and provide a report to the COR that details the type, quantity and location of each material covered in the inventory.

Fixed radiological materials are present onboard the NSS in the form of activated primary system components and equipment, and contamination entrained within the primary system components, equipment and piping. Such materials are anticipated to be left undisturbed for the performance of this contract, except when decommissioning activities are being undertaken. During decommissioning activities, fixed radiological materials shall be converted into radiological waste and either properly stored or disposed. The presence and hazards of these materials is covered in the content of STS General Employee Training, and Visitor Safety Briefing. The Contractor shall ensure that all persons entering the NSS are notified of the presence of radiological materials
