52.212-2 Evaluation--Commercial Items Addendum

The Government will make a responsibility determination by analyzing the acceptability of the offer to the solicitation technical requirements. In order to be acceptable and eligible for evaluation, proposals must be prepared in accordance with Instructions and must meet all the requirements set forth in the other sections of this solicitation.

The following factors shall be used to evaluate offers:

Factor 1 - Technical Qualifications/Experience

The Offeror provides a project plan and a work breakdown staffing plan that thoroughly demonstrates the Offeror (1) has a thorough understanding of the SOW; (2) proposes a realistic and viable approach/plan of action; (3) has the available resources to perform the project; (4) identifies any potential problems and/or critical issues that will relate to the successful completion of the project; and (5) milestone schedule.

This factor considers the offeror's experience within the past five (5) years. The execution of similar work as well as the quality of the work with consideration to timeliness and technical success should be noted. This factor also considers the education, experience, knowledge, and necessary skills of the offeror's staff entomologist and each service technician or other technical personnel assigned to the contract.

Factor 2 – Price (Costs associated with any work necessary that exceeds routine maintenance (such as replacement parts)).

a). The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The Government reserves the right to trade off non-price factors with price. Technical Qualifications/Experience is slightly more important than price.

b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
