About this file

This is Amendment 0002 to solicitation 693C73-25-B-000004 issued by the Federal Highway Administration's Eastern Federal Lands Highway Division for road reconstruction work at Catoctin Mountain Park in Maryland. The amendment removes multiple FAR and Transportation Acquisition Regulation (TAR) clauses related to discrimination and merit-based opportunity pursuant to Executive Order 14173, provides responses to bidder questions, replaces bid schedule pages to revise/add pay items, and replaces several plan sheets to add standards/details, revise quantities, update the construction sign summary, and remove BIL (Bipartisan Infrastructure Law) signage.

The amendment maintains the bid opening date of March 11, 2025 at 2:00 PM EDT. Key schedule details include: Schedule A (Base Contract) with 62 calendar days performance period, Schedule B (Government Option 1) with 58 calendar days, and Schedule C (Government Option 2) with 59 calendar days. If all schedules are awarded together, total performance period is 183 calendar days. Work involves full depth reconstruction and mill/overlay of Foxville-Deerfield Road and Park Central Road, including pavement marking, drainage improvements and other miscellaneous work. Construction activities can begin as early as June 2025 pending required approvals.

Responses to Questions/Clarifications:

1. Typically, aggregate base is measured by the Ton not by the Cubic Yard. In the Plans, the estimated quantities are listed by the Cubic Yard. Is this able to be switched to Tons for less confusion.

Response: Pay item 30103-4000 Aggregate base grading C or D to remain as shown on the plans (Schedule A and B).

2. Type H markings require a 30 day wait period prior to placement, however there is not a pay item for any temporary striping. There are also no sign details to alert the public about no striping. What is FHWA intent in this situation?

Response: Follow the thermoplastic pavement marking manufacturer’s recommendations for application. Typically, hydrocarbon thermoplastic will require a 30 day wait period, however, an alkyd thermoplastic may be applied soon after paving.

Include “No Centerline” W8-12 signs for each schedule:

3. Will signage quantities be updated to remove the bipartisan infrastructure signs?

Response: The bipartisan infrastructure signs will be removed from the project.

4. One note says work is permitted from November 1 to March 31. However, during this time the weather is unpredictable and paving operation are unlikely. Is this the time where unrestricted full closures can occur.

Work may progress throughout the year, including November 1 to March 31. Work on Schedule A can begin as early as June 2025, provided the necessary submittals are submitted, reviewed, and approved, except as stated in the SCRs (see SCRs for more information).

Section 108.03 subsection (3): Time adjustment for unscheduled events. Throughout the performance of the contract, there may be days or times where no work may be performed for Park security reasons. With little or no advanced notice, certain unscheduled events that affect Park roads may require the Contractor to temporarily suspend all construction operations and remove temporary lane closures. An unscheduled event that results in a temporary stoppage of construction activities will be considered the same as a single Rain Day in accordance with Subsection 155.02(h). If the unscheduled event that causes a temporary stoppage of construction activities occurs on the same day as a Rain Day, only the actual Rain Day will count.

Section 156.04.

Maintain one lane of traffic at all times.

• Close Foxville-Deerfield Road and the section of Park Central Road between Manahan

Road and Camp 3 to traffic during construction as approved by the CO. Open the roadway within 24 hours after completion of work or as directed by the CO.

• Do not close the section of Park Central Road between Foxville Road (Route 77) and Camp 3 to traffic during construction. Use single lane closures according to Section 635 and as shown in the plans.

Section 156.05)(b)

• Maintain access to Camp 3 on Park Central Road at all times. Maintain access to Owens Creek Campground on Foxville-Deerfield Road from May 1 to October 31

5. Another note states that work can start in June 2025. Can work under a single lane closure or full closure occur at this time.

Response: See response 4.

6. Can portions of Foxville-Deerfield Road and Park Central Road be closed. Is this a full closure or a one lane closure. Can this closure and work occur starting in June 2025

Response: See response 4.

7. Please Clarify the location of camp #3

Response: Location of Camp #3 is shown on Sheet A05 of the plans (± Sta. 258+00 Schedule B)

8. Does the park have a standard seed mix they would want the contractor to use? If not, would a VDOT roadside seed mix suffice?

Response: See Sheets M01-M05 of the plans, specifically Sheet M04 under criteria for allowed seed mix.

9. Please Confirm the size of culvert we are installing. The pay item B1180 – 18-Inch Equivalent Diameter Arch or Elliptical Pipe Culvert says we are to install an 18” culvert. The plans show we are to install a 14”x23” Reinforced Concrete Pipe.

Response: Install a 23”x14” RCP per the plans. See Sheet K01. See Detail E602-08.

10. In place of Diversion Fence can the contractor elect to use a Wire Backed Silt fence?

Response: No, the diversion fence in this situation is required based upon Maryland Department of Environment Water Management Administration.

11. Per the Drawings we are to install a 23”x14” RCP Pipe. Can you please specify what class RCP we are to install?

Response: Furnish and install Class HE-IV Reinforced Concrete Elliptical Pipe in accordance with

AASHTO M 207.

12. Schedule A shows 350 TN of 'Thin Lift Asphalt Concrete Pavement' (pay item A1180, shown on type sections B04 of plan set). This appears to be undefined within the the project documents as to the mix design. Per the attached, Maryland SHA guidelines show for a 0.75in lift thickness that a 4.75mm aggregate size mix would be the only potential mix which would meet the required lift thickness. Please confirm if this would meet the project requirements, and if a 64-22 liquid would be required as a binder.

Response: See Subsection 431.03 for Thin Lift Asphalt Concrete Pavement requirements. A state approved 4.75 mm mix with PG 64-22 binder that meets the requirements of Table 431-1 will be acceptable.

13. Do the Superintendent, SSHO and QC Manager need to be 3 separate individuals?

Response: The QC manager cannot be Superintendent or SSHO. The Superintendent may be SSHO. See Subsection 153.02 of the FP-14.

14. Can the period of performance be extended after award once the material/equipment lead times are confirmed due to current market conditions for the equipment for this project?

Response: See Section 108 of the FP-14.

15. Are soil boring reports available? If not, it will be assumed that excavation will be clear of rocks and obstructions.

Response: The Geotech and Pavement Investigation is included in the advertisement document.

16. Please provide the site visit attendee sign in sheet.

Response: The signing sheet is not required since there no pre-bid meeting.

17. Is there a bulk water fill i.e. a hydrant or water source we can pump from for grading operations in close proximity?

Response: Fire hydrants available in Camp Round Meadow, which is in close proximity to both Park Central and Foxville Deerfield roads. Meter is not required for the use.

18. Are there any specs for the type of stone to be mortared to the head wall?

Response: The stone to be government furnished per Section 620.03 in the SCR’s.

19. Are we to replace the grate at the inlet shown on detail E604-02A? If so, what line in the pricing schedule should we account for the cost?

Response: No, replace the concrete cover only.

20. Please provide a detour plan for pricing purposes.

Response: Detour sign quantities shown in Construction Sign Summary on Sheet C10. Also refer to the Temporary Traffic Control Narrative on Sheet N01, specifically note 16.

21. Section 108.01 states that work is permitted from Nov.1 to March 31 when the weather permits. Is this correct? Please confirm.

Response: Correct, 108.01 (c) states: Work is permitted from Nov.1 to March 31 when weather permits. However, one must consider the entirety Section 108.

22. Can both roads be closed during reconstruction excavation?

Response: The contractor is allowed to close Foxville-Deerfield and Park Central Road if the closures comply with Section 156 of the SCR’s.

23. The ¾ inch paving for Foxville - Deerfield in my experience seems to be light for traffic. When visiting the site, we noticed a tractor and trailer traveling on this road. Please confirm this is what is intended.

Response: The contractor is to follow the proposed plans as designed.

24. a. Is there a waste site for this project on site or will all the material need to be hauled away?

b. Looking at the detail sheet B01, for the shoulder backup on both roads show 5” under pavement and 9” on the shoulders with 3 and 4 Inches of topsoil on top of the stone. We suggest the shoulder should be all stone. If not, the topsoil will be rutted from traffic constantly. c. Please confirm material needed.

In addition, please confirm the shoulder section should be 2” deeper in the subgrade for the shoulders.

Response: 24a: No waste site had been identified for this project. The Contractor will be responsible for hauling and disposing of material as needed.

24b & 24c: Contractor to follow plan details and insert A as shown on Sheet B01.

25. For pay items B1300 & C1270 – 64707-1000 – Mitigation, Archaeological Site Monitoring. Is a written report detailing site monitoring required? Per the Maryland Historic Trust it mentions that monitoring should have “associated reporting, recording and recovery of major features or artifacts uncovered where practical”

Response: Yes, a written report of site monitoring activities is required as part of pay items pay items B1300 & C1270 – 64707-1000.

BID SCHEDULE INSTRUCTIONS

PROJECT: CATO 10(5), 11(2), ETC

BIDDERS PLEASE NOTE: Before preparing the bid, carefully read the Instructions to

Bidders. While preparing the bid comply with the following:

COMPLETING THE BID SCHEDULE

Complete the Bid Schedule(s) by handwriting in ink or typing. Specify a Unit Bid Price, in figures with cents to only two decimal places for each pay item in the Unit Bid Price column for which a quantity is given. Do not enter or tender a Unit Bid Price for any pay item for which no estimated quantity appears in the Bid Schedule. Determine the products of the respective unit prices and quantities, and show them, in figures, in the Amount Bid column. If a Unit Bid Price and Amount Bid have been inserted by the Government for a pay item, do not change the Unit Bid Price and Amount Bid for the pay item. Determine the Bid Total for each specific individual Schedule of Work by adding the amounts of the listed items and show in the block provided for that individual Schedule of Work. In case of multiplication errors, the Amount Bid for the item will be based on the Unit Bid Price.

To be eligible for award, bidders must submit prices for each pay item.

Review Subsection 109.05 of the FP (standard specifications book) regarding scope of payment for direct and indirect payment work.

Fill in the Bid Total(s) for each individual Schedule of Work as directed on the Bid Summary page. Fill in the Evaluation Total Price of Project in the space provided on the Bid Summary page.

The amount in Block 17 of the SF 1442 should be completed as follows:

Schedule A - $ .

Schedule B - $ .

Schedule C - $ .

SCHEDULES OF WORK

The Bid Schedule is comprised of the following separate schedules and options:

Schedule A (Base Contract) - Pages B-1 through B-3

Schedule B (Government Option 1) - Pages B-4 through B-6

Schedule C (Government Option 2) - Pages B-7 through B-9

The Government will award the project as a Base Contract (Schedule A) with the option to award Schedules B and C (Government Options 1 and 2); see FAR Clauses 52.217-4 and 52.217-5.

The purpose of the multiple schedules and options is to give the Government maximum flexibility in completing the project in a timely manner and at a cost-effective price by proper utilization of programmed funds and upon receipt of any additional funds required to award the contract. If complete funding is in place at the time of award of Schedule A (Base Contract), the Government may award Schedules B and C (Government Options 1 and 2) at that time. If additional funding is required for the award of Schedules B and C (Government Options 1 and 2), and is received after the award of Schedule A (Base Contract), the Government has the right to exercise Schedules B and C (Government Options 1 and 2) at the unit prices bid according to the following schedule:

Schedule B (Government Option 1): No later than the contract completion date for Schedule A (Base Contract).

Schedule C (Government Option 2): No later than the contract completion date for Schedule B (Government Option 1).

COMPLETION OF WORK

The Government has estimated the number of calendar days necessary to complete all work from the effective date of the Notice to Proceed to contract completion for the various award scenarios.

The maximum number of calendar days allowed (i.e. the contract performance period) is shown in Block 11 of the SF-1442 and described below.

If the Government awards the contract as Schedules A + B + C, the performance period to complete all work will be 183 calendar days.

If the Government awards the contract as Schedule A only, the performance period to complete all Schedule A work will be 62 calendar days and will start on the effective date of Schedule A’s Notice to Proceed.

If Schedule B (Government Option 1) is exercised after the award of the original contract, the performance period to complete all Schedule B work will be 58 calendar days and will start on the effective date of Schedule B’s Notice to Proceed.

If Schedule C (Government Option 2) is exercised after the award of the original contract, the performance period to complete all Schedule C work will be 59 calendar days and will start on the effective date of Schedule C’s Notice to Proceed.

In developing a construction schedule to determine the number of calendar days, the Government considered and included the work limitations shown in Sections 108 and 156 of the FP and Special Contract Requirements (SCRs). Specific work limitations may be (but are not limited to): National legal holidays, weekends, rush hours, night work, specified no work periods, work or traffic control phasing, etc. The Government also considered those work items that are weather sensitive and when those work items will be performed. Specific work items are (but not limited to): those that require a minimum ambient air temperature (asphalt paving and surface treatment, pavement striping, stone masonry, etc.); those that require maintaining a minimum surface temperature (concrete pavement, structural concrete, painting, etc.); and those that have specific planting seasons (turf establishment, sod, trees, plants, etc.). The Government also considered time required for preparing material and drawing submittals, and the allowable Government review times for those submittals (Subsection 104.03 of the FP and SCRs).

Bidders are to assume that the award of the contract and approval of the Contractor’s Performance and Payment Bonds (see Block 12a of the SF-1442 and FAR Clause 52.228-

15) may result in the start of construction activities to be no earlier than June 2025. See Subsection 108.01 of the SCRs for additional details.

BASIS FOR AWARD

The contract will be awarded to the responsive, responsible bidder with the lowest Evaluation

Total Price of Project, which is defined as:

Schedule A (Base Contract) Bid Total + Schedule B (Government Option 1) Bid Total +

Schedule C (Government Option 2) Bid Total.
