About this file
This is a Statement of Work for ACM-regulated drilling and anchor installation work at the United States Merchant Marine Academy's Bland Memorial Library in Kings Point, New York. The Contractor shall perform all labor, supervision, equipment, materials, and incidentals necessary to drill forty holes (24 holes at 1/2-inch diameter to 3/8x16 depth and 16 holes at 1/4-inch diameter to 1-1/2 inch depth) through asbestos-containing materials within an approximately 30-square-foot area beneath existing carpet, then install corresponding drop-in anchors flush with the substrate. The work must comply with federal, state, and local regulations including OSHA Asbestos Standards (29 CFR 1926.1101 and 1910.1001), EPA NESHAP (40 CFR Part 61, Subpart M), New York State Industrial Code Rule 56, New York State Department of Labor asbestos licensing requirements, and the Davis-Bacon and Related Acts. Additionally, all work must be fully consistent with the Secretary of the Interior's Standards for the Treatment of Historic Properties and Standards for Rehabilitation as the academy is listed on the National Register of Historic Places.
The Contractor must establish a regulated asbestos work area with warning signs and access controls, protect existing carpet for reinstallation, employ continuous wet methods with HEPA-filtered drilling tools and local exhaust ventilation, clean each hole using HEPA-vacuum shroud or integrated aspiration systems prior to anchor installation, properly dispose of ACM waste at a New York State-approved facility, and perform final HEPA cleaning of the substrate. All HEPA equipment must capture 0.3 microns with 99.97% efficiency. Pre-award submittals include a Site-Specific Asbestos Work Plan, NYS Asbestos Contractor and Supervisor Licenses, worker training certifications, and laboratory testing certification for HEPA-filtered equipment; post-award submittals include waste manifests and final waste manifest. Work shall be completed within two working days after issuance of Notice to Proceed. Final asbestos clearance sampling will be conducted by the academy's awarded monitoring/sampling contractor, with regulatory clearance levels set at 70 structures per square millimeter or lower and 0.01 fibers per cubic centimeter or lower; if criteria are not met, the work area must be recleaned until clearance is achieved.

STATEMENT OF WORK (SOW)
Project Title: ACM-Regulated Drilling & Anchor Installation Work – USMMA Bland Library
Location: United States Merchant Marine Academy (USMMA), Kings Point, NY
1. Scope of Work The Contractor shall provide all labor, supervision, equipment, materials, and incidentals necessary to perform regulated drilling and anchor installation activities within an approximately 30-square-foot area beneath the existing carpet in the USMMA Bland Memorial Library. The work includes drilling twenty-four (24) 1/2-inch diameter holes and sixteen (16) 1/4-inch diameter holes through building materials confirmed or assumed to contain Asbestos-Containing Material (ACM). Following regulated drilling, the Contractor shall install 1/2-inch diameter (3/8x16) and 1/4-inch diameter (1-1/2 inch) drop-in anchors flush with the substrate within the designated area.
The work includes:
• Drilling approximately twenty-four (24) holes with a 1/2-inch diameter and a depth of 3/8x16 through building materials confirmed or assumed to contain Asbestos-Containing Material (ACM).
• Drilling approximately sixteen (16) holes with a 1/4-inch diameter and a depth of 1-1/2 inches through building materials confirmed or assumed to contain ACM to secure wire raceway molding.
• Installing twenty-four (24) 1/2-inch diameter, 3/8x16 deep drop-in anchors flush with the substrate within the designated area.
• Installing sixteen (16) 1/4-inch diameter, 1-1/2 deep drop-in anchors to secure the wire raceway molding.
Because the USMMA is listed on the National Register of Historic Places, all work shall be fully consistent with the Secretary of the Interior's Standards for the Treatment of Historic Properties (36 CFR part 68). Additionally, all work shall meet or exceed the standards provided in the Secretary of the Interior’s Standards for Rehabilitation, following the application guidelines published by the Technical Preservation Services branch of the National Park Service (36 CFR 67.7).
2. Regulatory Compliance All work shall be performed in strict accordance with applicable federal, state, and local regulations, including but not limited to:
• OSHA Asbestos Standards – 29 CFR 1926.1101 and 29 CFR 1910.1001
• EPA NESHAP – 40 CFR Part 61, Subpart M
• New York State Industrial Code Rule 56 (12 NYCRR Part 56)
• New York State Department of Labor asbestos licensing requirements
• U.S. Department of Labor – Davis-Bacon and Related Acts (DBRA)
3. Work Practices
• Area Controls: Establish a regulated asbestos work area with warning signs and access controls.
• Asset Protection: Carefully roll back and protect existing carpet for reinstallation upon completion.
• Engineering Controls: Utilize continuous wet methods, HEPA-filtered drilling tools, and local exhaust ventilation.
• Hole Clean-out Protocol: Prior to inserting anchors, clean each drilled hole using a HEPA-vacuum shroud or an integrated aspiration system to extract residual ACM dust directly from the bottom of the cavity. Maintain local negative pressure exhaust source capture at all times, to prevent dust propagation.
• Anchor Setting: Install the 1/2 inch in diameter, 3/8x16 deep & the 1/4-inch diameter,1-1/2 deep drop-in anchors to proper embedment depth using the manufacturer's specified setting tool to ensure the internal expansion plug is completely driven.
• Waste Management: Properly containerize, label, transport, and dispose of all ACM waste at a NYS-approved facility.
• Final Decontamination: Perform a final HEPA cleaning of the substrate prior to demobilization.
• Equipment Performance: Utilize HEPA equipment with a minimum filter requirement capable of capturing 0.3 microns with 99.97% efficiency.
4. Submittals The Contractor must provide the following document submissions before and after the project:
• Site-Specific Asbestos Work Plan / Occupant Protection Plan
• NYS Asbestos Contractor License & Supervisor Licenses
• Worker Training Certifications - including but not limited to NYS Asbestos contractor license, asbestos handler, or equivalent regulatory standards
• Equipment & Material Submittals:
o Laboratory testing certification for HEPA-filtered vacuum and drilling systems.
• Waste Manifests/Shipment Records (including final waste manifest) (After Award)
5. Schedule Work shall be fully completed within Two (2) working days after issuance of the Notice to Proceed.
6. Additional Information
• The Contractor shall work alongside the academy’s awarded monitoring/sampling contractor.
• A final lead and asbestos clearance sampling/monitoring will be conducted by the academy’s awarded monitoring/sampling contractor.
• EPA Asbestos Regulatory Clearance Levels:
1. 70 structures per square millimeter (s/mm²) or lower.
2. 0.01 fibers per cubic centimeter (f/cc) or lower.
• If sampling results for the work area do not meet the regulatory clearance criteria, the work area shall be thoroughly recleaned using the appropriate regulatory methods and standards until final clearance results are met.
