Procurement Request No. V2402021
DEPARTMENT OF TRANSPORTATION
OFFICE OF THE ASSISTANT SECRETARY FOR RESEARCH AND TECHNOLOGY
VOLPE NATIONAL TRANSPORTATION SYSTEMS CENTER (VOLPE CENTER)
Facilities V240
SOLE SOURCE SAP JUSTIFICATION
A. Description of Supplies/Services.
The General Services Administration (GSA) contracted with the Massachusetts Institute of Technology (MIT) to build a new Volpe Center building on the existing Volpe Center campus. The first phase of construction is to install new mechanical equipment (at two Temporary Central Utility Plants –TCUPs) to support the existing Volpe Center during the four years that the new building is under construction. This new TCUP equipment provides critical cooling – and partial heating - to the entire center, including the data center and NextGen/SWIM labs. J.C. Cannistraro LLC is the mechanical contractor hired to install all of the mechanical systems and equipment at these two TCUPs. In addition to performing this equipment purchase and installation, under the contract J.C. Cannistraro will be providing a 4-year limited warranty* for all this new, Volpe-critical, heating and cooling equipment.
The Government intend to sole source this requirement to J.C. Cannistraro to maintain all the new TCUP mechanical equipment. As part of the requirements of the limited warranty, the equipment MUST be maintained in strict accordance with manufacturer’s maintenance schedule.
B. Market Research. N/A -
Market research was performed on 6/26/19 by Steve Coffey. Based on the market research performed J.C.
Cannistraro purchased and installed all the mechanical equipment for the two TCUP’s which comes with a 4-year limited warranty on all equipment and therefore no other contractor could provide maintenance and maintain the warranty on all the equipment.
C. Supporting Rationale.
Complete one of the following three sections and annotate the two non-applicable sections with an “N/A.”
(1) Sole Source: Only one responsible source and no other supplies or services will satisfy agency requirements.
(i) J.C Cannistraro worked with the design engineers and the equipment manufacturers throughout the design, submittal, and installation process and have the knowledge and expertise to maintain this TCUP equipment.
Each piece of equipment was purchase and installed by J.C. Cannistraro in accordance with the manufacturer’s recommendations and they are the only company that can perform maintenance on all the new TCUP mechanical equipment in order to maintain the warranty on the equipment. It is very important the equipment warranties be maintained due to it supporting the critical operations at the Volpe center that cannot be adversely affected by disruptions or failures in its mechanical systems which provide cooling and heating.
Ensuring that all the newly installed mechanical equipment is being maintained properly and keeping the warranty on all equipment, maintenance can only be performed by JC. Cannistraro.
(ii) As part of the requirements of the equipment warranty, it must be maintained in strict accordance with manufacturer’s maintenance schedule. If anyone other than J.C. Cannistraro performs the maintenance and there is equipment failure, there will be a dispute as to whether the proper maintenance was performed in order satisfy the warranty. If it is shown that the maintenance was not performed to the warranty requirements, then the Volpe Center will be potentially responsible for repair or replacement cost of equipment. Since Cannistraro purchased and installed all the mechanical equipment for the two TCUP’s no
V220T.12 (01/19) other contractor could provide both the maintenance as well as the warranty on all the equipment without a conflict of interest.
(i) Brand Name: A specific brand that is available from multiple vendors. N/A
