About this file

This is a Notice of Intent to Award (NITA) for a proposed noncompetitive sole-source procurement issued by the U.S. Environmental Protection Agency (EPA) on September 3, 2026.

The EPA intends to purchase a three-year subscription to RSMeans Building Construction, Landscape, and Site Work cost data from The Gordian Group, Inc. (UEI: DFAEDF67P941) under simplified procedures for commercial products and services (FAR Part 12). The software subscription will provide access for approximately 150 EPA and state users and support the RCRA hazardous waste financial assurance program by supplying current, reliable cost data for evaluating facility closure and post-closure care estimates. The Product Service Code is D317 (IT and Telecom – Web Based Subscription), and the NAICS Code is 513210 (Software Publishers). Award is anticipated on or about September 28, 2026. The EPA has determined that only one source is available because RSMeans data is the industry standard cost data currently integrated into EPA's hazardous waste cost estimation tool, and other identified sources either lack the complete range and level of detail required or provide incompatible data formats that would necessitate significant modification or rebuilding of existing EPA tools.

Interested parties may submit capability statements by September 18, 2026, at 4:30 PM EDT to Adrianne Wells, Contracting Officer, at Wells.Adrianne@epa.gov. Required capability statement submissions include Unique Entity Identifier (UEI), company name and address, company point of contact with phone and email, and a capability statement providing clear and convincing evidence that competition would be advantageous to the Government. The Government will not reimburse respondents for costs associated with responding to this notice. No set-asides apply to this procurement.

(4) Description:

(i) EPA Intends to purchase three years of RSMeans Building Construction, Landscape, and Site Work cost data from Gordian. (v) NO SOLICITATION IS AVAILABLE. This notice is not a request for competitive proposals. However, pursuant to Subpart 5.101(c)(4)(vi), all responsible sources may submit a capability statement which shall be considered by the Agency. Capability statements must be received within the time set forth in this announcement to be considered by the Government. Each response should include the following Business Information:

Unique Entity Identifier (UEI) Company Name and Address

Company Point of Contact, including Phone and Email Capability Statement

Responses to this notice must be in writing and provide clear and convincing evidence that competition would be advantageous to the Government. A determination not to compete based upon the responses to this notice is solely within the discretion of the Government.

The Government will not reimburse respondents for costs associated with responding to this notice.

(vii) Proposed Source: THE GORDIAN GROUP, INC., UEI: DFAEDF67P941

In accordance with RFO FAR 12.102(a), the Government has determined that only one source is available to satisfy this requirement. The Gordian Group, Inc. is uniquely qualified because its RSMeans data is the industry standard cost data currently used by EPA’s hazardous waste cost estimation tool. The data provides the comprehensive and detailed pricing information necessary to support EPA’s closure and post closure cost estimates and is formatted for integration with EPA’s existing tools.

EPA’s market research identified other sources however, those sources either did not provide the complete range and level of detail required or provided data in formats that are not compatible with EPA’s existing cost estimation methodology. Use of another source would require significant modification or rebuilding of existing EPA tools, resulting in duplicative costs, delays, and potential inconsistencies in EPA’s cost estimates.

(viii) Not applicable.

(d) Timing. Responses to this notice and/or capability statement submissions must be received by September 18, 2026, NLT 4:30 PM EDT.
