About this file
This is a bidding proposal document for the Texas Department of Transportation (TxDOT) for tree trimming and brush removal work on State Highway 21 in Bastrop County, Texas. The project (Control 6487-33-001, Project RMC-A00216584) involves tree trimming, brush removal, and debris removal at various locations in Bastrop and Lee Counties along multiple roadway segments, with work to be conducted on both left and right sides of each roadway. The contractor must complete all work within 42 working days of receiving written notice to begin, with work required to start within seven calendar days of notification. Work is restricted to the period of September 16 through February 28 annually; work outside this timeframe requires submission of a bird survey request to TxDOT at least 30 business days prior to beginning work. Bid items include debris removal (3 miles), tree trimming and brush removal (45.7 miles), and tree removal in various diameter categories ranging from 12 inches to 60 inches (totaling 43 individual trees). Bidders must acknowledge receipt of all addenda and submit a completed Bidders Questionnaire at least ten days prior to the letting date. The work is subject to Houston Toad habitat restrictions requiring worker training, site clearance notifications, installation of amphibian and reptile exclusion fencing, and compliance with specific work hour limitations (30 minutes after sunrise to 30 minutes before sunset).
The proposal guaranty requirement is $4,000.00, payable to the Texas Transportation Commission in the form of a cashier's check, teller's check, bank money order, or bid bond. Bidders must submit unit prices for each pay item in accordance with the specified format, and the official total bid amount will be calculated by multiplying unit bid prices by estimated quantities. The contract includes liquidated damages provisions with daily rates applicable based on contract value, along with minimum daily production rate requirements of 2 miles per day for tree trimming and brush removal and 17 days for tree and spot debris removal. Work is restricted to Monday through Friday between 30 minutes after sunrise and 30 minutes before sunset, with no lane closures permitted on weekends, working days adjacent to national holidays, or during specified large and special events in the region. The project prohibits mobile operations and requires compliance with traffic control plans, migratory bird and bat protection measures, fire ant treatment, and environmental commitments outlined in the EPIC plan sheets. Bidders must meet various certifications including nondiscrimination compliance, E-Verify registration, conflict of interest statements, and certifications regarding boycotts of Israel and energy companies and non-discrimination against firearm entities.

Closures that conflict with adjacent contractor will be prioritized according to critical path work per latest schedule. Conflicting critical path or non-critical work will be approved for first LCN submitted. Denial of a closure due to prioritization or other reasons will not be reason for time suspension, delay, overhead, etc.
Meet with the Engineer prior to lane closures to ensure that sufficient equipment, materials, devices, and workers will be used. Take immediate action to modify current and future traffic control, if at any time the queue becomes greater than 20 minutes.
Consider inclement weather prior to implementing the lane closures. Do not set up traffic control when the pavement is wet.
Cover, relocate, or remove existing small, large, and overhead signs that conflict with traffic control. Cover large and overhead signs to remain using latest standard TS-CD. This work is subsidiary.
The Contractor Force Account “Safety Contingency” that has been established for this project is intended to be utilized for work zone enhancements, to improve the effectiveness of the Traffic Control Plan, that could not be foreseen in the project planning and design stage. These enhancements will be mutually agreed upon by the Engineer and the Contractor’s Responsible Person based on weekly or more frequent traffic management reviews on the project. The Engineer may choose to use existing bid items if it does not slow the implementation of enhancement.

Pursuant to Texas Government Code Section 2261.252(b), the Department is prohibited from entering into contracts in which Department officers and employees have a financial interest.
By signing the Contract, the Contractor certifies that it is not prohibited from entering into a Contract with the Department as a result of a financial interest as defined under Texas Government Code Section 2261.252(b), and that it will exercise reasonable care and diligence to prevent any actions or conditions that could result in a conflict of interest with the Department.

E-VERIFY CERTIFICATION
Pursuant to Texas Transportation Code §223.051, all TxDOT contracts for construction, maintenance, or improvement of a highway must include a provision requiring Contractors and subcontractors to use the U.S. Department of Homeland Security’s E-Verify system to determine employment eligibility. By signing the contract, the Contractor certifies that prior to the award of the Contract:
the Contractor has registered with and will, to the extent permitted by law, utilize the United States Department of Homeland Security’s E-Verify system during the term of the Contract to determine the eligibility of all persons hired to perform duties within Texas during the term of the agreement; and the Contractor will require that all subcontractors also register with and, to the extent permitted by law, utilize the United States Department of Homeland Security’s E-Verify system during the term of the subcontract to determine the eligibility of all persons hired to perform duties within Texas during the term of the agreement.
Violation of this requirement constitutes a material breach of the Contract, subjects a subcontractor to removal from the Contract, and subjects the Contractor or subcontractors to possible sanctions in accordance with Title 43, Texas Administrative Code, Chapter 10, Subchapter F, “Sanctions and Suspension for Ethical Violations by Entities Doing Business with the Department.”
