Questions and Answers

Amendment No. 01, dated: 02/22/2023

1. Is there an incumbent?

As stated in the Performance Work Statement (PWS), NLRB previously fulfilled this requirement via an Interagency Agreement with the Environment Protection Agency

(EPA).

2. The PWS states, “FOIA data migration from FOIAOnline & integration support”. Can you provide estimates on the amount of data to be migrated to the new FOIA system?

The estimated amount of data to be migrated to the new FOIA system is 225 GB.

3. PWS, Section 1.3 - Can NLRB please confirm if the proposed go-live date of June 30, 2023 is flexible due to extenuating circumstances such as, but not limited to, security requirements, application configuration, and sufficient user training?

There is limited flexibility to the proposed go-live date that may be caused by extenuating circumstances.

4. PWS, Section 3.6 - Can NLRB please elaborate on what is meant by "customer built" regarding integration with marketplace applications?

With regard to the customer built section, this can be interpreted to align with PWS section

4.9.1

5. PWS, Section 3.11 - Can NLRB please confirm NLRB FOIA Branch and OIG requests and records need to be completely separated and isolated from each other, requiring separate databases for each?

There is no explicit requirement for separate databases. The separation of the FOIA Case files between the FOIA Branch and OIG should be one of access control, preventing unauthorized access to either office by any user, and permitting access to either or both office by authorized users.

6. PWS, Section 4.6.2 - Can NLRB please confirm private cloud hosted solutions that are

Authorized at the FedRAMP Moderate level are acceptable?

Section 4.6.2 has been revised. Please see the updated PWS.

7. PWS, Section 4.7.2 - Can NLRB please expand upon what is meant by zero trust initiatives in the context of this RFQ?

This section has been removed.

8. PWS, Section 4.7.4; Sub-Category Security, No. 6 - Will NLRB consider approving the use of the

Rev. 4 security baseline?

See update to PWS section 4.7.16.

9. PWS, Section 4.7.1 - Could NLRB please confirm that consistent with FedRAMP Authorized

Moderate security provisions multifactor authentication (MFA) is required to access a cloud hosted FCMS?

The required security access provisions are stated in PWS sections 4.7.1 and 4.10.3.

10. PWS, Section 4.1.2.5 - The government's PWS states that any key personnel should be substituted with somebody possessing qualifications "equal to or better than the qualifications of the personnel originally identified for the position." Will NLRB consider changing this criteria to

"equal to or better than the requirements of the PWS?"

No, the qualifications of the proposed substitute personnel should be equal to or better than the qualifications of the personnel originally identified for the position.

11. I respectfully request you remove the 2 federal government customer requirement, item 3.106 of the PWS.

This section has been removed.

12. Can the Government please confirm the number of users expected to use the new FOIA system.

Please see PWS section 4.6.8.

13. Can the Government please estimate the anticipated number of documents needed per case within the new FOIA system.

Please see PWS section 3.60.

14. Can the Government please confirm which platform the legacy FOIA webportal was built on.

The legacy FOIA webportal was managed by the EPA (not NLRB). See response to question

1.

15. Can the Government please clarify whether the eSolution is being provided, referencing Veritas, or should we propose an eDiscovery component.

As stated in the PWS, all software, licenses, etc., necessary to meet the requirements of the

PWS must be included in the proposed solution. No eDiscovery solution is being provided by NLRB.
