I. FEDERAL ACQUISITION REGULATION (48 CFR CHAPTER 1) CLAUSES

NUMBER TITLE DATE

52.212-1 Instructions to Offerors

-- Commercial Items

52.247-34 F.O.B. DESTINATION

NOV 1991

52.212-4 Contract Terms and Conditions

-- Commercial Items.

52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following non-price factors, listed in descending order of importance, shall be used to evaluate offers:

· Technical Capability: Warranty and delivery time. (See 52.212-1 b(4)).

· Past Performance: of the offeror (See 52.212-1 b(10))

· Price (See 52.212-1(g)).

The government will make award to the offeror whose offer conforms to solicitation requirements and represents the “best value” to the government based on technical capability, past performance, and price. The combined weight of non-price related factors are significantly more important than price. Therefore, award may be made to other than the lowest priced, responsible offeror.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced.

Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Addendum to 52.212-1 Instructions to Offerors -- Commercial Items (Jun 2008).

---Instructions for the Preparation of Technical and Business Quotations.

(a) General Instructions. Quotations submitted in response to this solicitation shall be furnished in the following format with the number of copies as specified below.

(1) The quotation must include a technical quotation and business quotation. Each of the parts shall be separate and complete so that evaluation of one may be accomplished independently from evaluation of the other. The technical quotation must not contain reference to price or cost; however, resource information (such as data concerning labor hours and categories, materials, subcontracts, etc.) must be contained in the technical quotation so that the contractor's understanding of the statement of work may be evaluated.

(2) Offerors may, at their discretion, submit alternate quotation or quotation which deviate from the requirement; provided, that an offeror also submit a proposal for performance of the work as specified in the Statement of Work. Any "alternate" quotation may be considered if overall performance would be improved or not compromised, and if it is in the best interest of the Government. Alternate quotation, or deviations from any requirement of this RFP, must be clearly identified.

(3) The Government will evaluate quotation in accordance with the evaluation criteria set forth in clause 52.212-2 of this RFP.

(4) Offerors shall email their quotation(s) in the following format and the quantities specified:

(a) 2 copies via mail and 1 copy via email of the completed, signed offer

(Including 52.212-3)

(b) 2 copies via mail and 1 copy via email of the technical quotation
