About this file

This is a Sole Source Determination Memo issued by the Oregon Department of Human Services, Office of Contracts and Procurement, on behalf of the Oregon Health Authority and Oregon State Hospital Laboratory. The procurement concerns the MilliporeSigma Water Solutions AFS (Analyzer Feed System) 24 CLRW Water System, which purifies water for specimen analysis, calibrates waterflow for various tests, and operates in tandem with laboratory testing equipment. The scope includes purchase, installation, repair visits, spare parts, annual preventative maintenance visits, system checks, replacement of worn parts, software and firmware updates, and all consumable parts and supplies required to maintain and operate the system. The agency intends to issue purchase orders, contracts, or utilize the SPOTS Card for ongoing purchases of maintenance, repair, parts, and supplies over a ten-year contract period with a potential five percent annual increase. The estimated total contract value is $100,000 over ten years. No specific bidder meetings, site visits, or response deadlines are detailed in the memo; however, protests to this sole source determination are due within seven calendar days after the first notice posting on OregonBuys.

The prospective vendor is EMD Millipore Corporation, doing business as MilliporeSigma, located at 3050 Spruce Street, St. Louis, Missouri. The justification for the sole source determination is based on the agency's prior purchase of a Siemens Atellica CI1900 analyzer, for which MilliporeSigma is the recommended and only approved water system provider due to proprietary technology and compatibility requirements. Additionally, some supplies are available only directly from MilliporeSigma, and purchasing through this vendor is projected to generate approximately $3,000 annually in cost savings compared to alternative vendors. The brand name specification is approved under ORS 279B.215 and ORS 413.033, and the procurement authority is established under OHA OAR 137-047-0275 and ORS 413.033.

2. Brand name to be acquired:

Legal entity name: EMD Millipore Corporation DBA: MilliporeSigma (V00024939) Address: 3050 Spruce St., St. Louis, MO 63103

Contact person: James Haines Phone: 206-310-9139 Email: Jim.haines@milliporesigma.com

3. Findings to satisfy required standards:

Use of a brand name specification is unlikely to encourage favoritism in the awarding of public contracts or substantially diminish competition for public contracts because:

or Use of a brand name specification would result in substantial cost savings to the agency or the public because: Purchasing all supplies directly through MilliporeSigma will result in a cost savings of approximately $3,000/year. This is based on the quoted pricing from MilliporeSigma and the pricing from other vendors.

or There is only one manufacturer or seller of the product of the quality, performance or functionality required; because: Some supplies for the system are only available directly from MilliporeSigma. EMD Millipore Corporation is the only approved vendor to perform and provide the required annual preventative maintenance, systems upgrades, services and parts of the MilliporeSigma Water Solutions AFS (Analyzer Feed System) 24® CLRW Water System Complete AFS 24 Water System.

or The efficient utilization of existing goods requires the acquisition of compatible goods or services because: Agency has purchased a Siemens Atellica CI1900 analyzer. The recommended water system for the new Siemens system is the MilliporeSigma Water Solutions AFS (Analyzer Feed System) 24® CLRW Water System Complete AFS 24 Water System. In order to utilize the Siemens Atellica CI1900 Agency needs to maintain MilliporeSigma Water Solutions AFS (Analyzer Feed System) 24® CLRW Water System Complete AFS 24 Water System which requires repair visits, spare parts, annual preventative maintenance visits, including checks of the system, replacement of worn parts, software and firmware updates, all consumable parts/supplies
