D. Construction Schedule and Stipulations
• Construction will begin once the contract is fully executed and a Work
Authorization has been issued by the Department. It is anticipated that construction shall begin in April 2026 at the earliest and be completed as soon as feasible unless otherwise directed by the Department in coordination with NPS. The Contractor shall notify NPS and the Department prior to their start of construction to allow relevant staff to be present if desired.
• Four tasks are designated as “Destructive Closure, Warm Season” (DCWS;
see Table 1), specifically:
o Task 2 - El Dorado Adit 3 o Task 3 - Ganim Inclined Shaft o Task 6 - Gladys Shaft o Task 8 - South Boundary Shaft
On these four features, construction work shall ONLY occur in the warm season between May 1 and October 15.
Immediately prior to construction start on any of these features, a wildlife exclusion3 shall be performed by the Contractor at the feature for a minimum of three nights. A wildlife exclusion shall consist of completely covering the adit portal or shaft collar with 1-inch chicken wire, anchored around the perimeter, while leaving a small, low awning (window) open. This allows any bats inside to exit the feature under the awning, but this opening will not be apparent when bats attempt to approach it from the outside. The exclusion does not need to be observed or monitored by the Contractor while it is in place.
• In addition to the above wildlife exclusion work, the Contractor shall thoroughly inspect the general area around the installation location at all features for wildlife immediately before installation begins. If any bats or nesting birds are observed, the Contractor shall exit the feature and contact NPS and the Department, and no work on that task shall proceed until authorized by NPS through the Department.
• Avoid disturbance near active bald eagle nests during nesting season (January 1 to August 15). The bald eagle is a State Listed Endangered Species and is federally protected by the Bald and Golden Eagle Protection Act (16 U.S.C. 668-668d). Restrict activities producing above-ambient noise (above 92 decibels) or visual disturbance within 0.25 mile (no line-of-sight) or
0.50 mile (line-of-sight) of an eagle nesting site during the nesting season. The Contractor shall consult with WHIS via DOC on the distribution of active eagle nests before any work is conducted during the eagle nesting season.
3 For more information, see “Step 4.3.3 Exclusions for Destructive Closures” (pages 85, 88) in Managing Abandoned Mines For Bats for more details: pacwestbats.org/_files/ugd/943ff7_303b8c449b2346cca350682ca3b6b359.pdf
• When work is to occur during raptor and other birds' nesting season (February 1 to August 1), the Contractor is required to consult with WHIS via DOC to ensure that a pre-work nesting bird survey is conducted in work areas and overland vehicular travel routes prior to commencing work. If an active nest is found during pre-work surveys, the nest information shall be shared by WHIS with DOC prior to work commencement. Information will include species, location, and recommended protective measures to be implemented. If an active bird nest is encountered during work, work shall cease within the area of the nest and the Contractor shall contact WHIS via DOC for further guidance. Nesting birds are protected by the Migratory Bird Treaty Act (16 U.S.C. §§ 703-712).
• For fire prevention:
a) WHIS typically experiences higher fire danger between June and
November, although annual weather conditions vary considerably.
b) Due to the year-round high risk of fire at WHIS, an NPS-approved Fire
Prevention Plan (FPP) is required for all Contractors operating in the park. The FPP shall be submitted to DOC and WHIS within 30 days of contract award for review and approval.
c) Standard best management practices in the FPP shall include the following:
i. All motorized vehicles and equipment in each active construction area will carry a copy of the approved FPP, one round-point shovel with an overall length of not less than 46 inches, one fire extinguisher rated 5 A:B:C or greater or two fire extinguishers rated 2 A:B:C or greater, a first aid kit, a method of communication (see d. below), one gallon of bottled water, and an emergency evacuation action plan.
ii. During conditions of extreme fire danger, the USFS system and the localized CalFire Rating System may limit or suspend operations in specific areas or require additional measures.
iii. WHIS also retains the authority to suspend or stop all work activities during red flag warnings, fire weather watch, and/or during an ongoing emergency in the Park.
1. Red Flag Warnings are posted on the National Weather Service (NWS) website:
http://www.wrh.noaa.gov/firewx/main.php.
2. Fire Weather Watches are issued by NWS to alert land managers and the public that upcoming weather conditions could result in extensive wildfire occurrence or extreme fire behavior. A Fire Weather Watch means https://gcc02.safelinks.protection.outlook.com/?url=https%3A%2F%2Fwww.law.cornell.edu%2Fuscode%2Ftext%2F16%2F703&data=05%7C02%7CDavid.Tibor%40conservation.ca.gov%7C2b6442436ecf46227c3708de33930774%7C4c5988ae5a0040e8b065a017f9c99494%7C0%7C0%7C639004903774593410%7CUnknown%7CTWFpbGZsb3d8eyJFbXB0eU1hcGkiOnRydWUsIlYiOiIwLjAuMDAwMCIsIlAiOiJXaW4zMiIsIkFOIjoiTWFpbCIsIldUIjoyfQ%3D%3D%7C0%7C%7C%7C&sdata=gDLOAmhGnR54l7S5Y16%2Fsgc%2BO1InyMcskjDbH%2FAb2FU%3D&reserved=0 http://www.wrh.noaa.gov/firewx/main.php critical fire weather conditions are possible but not imminent or occurring.
iv. All fires will be reported via 9-1-1 and/or agency dispatch ASAP.
In the event that project construction results in a wildfire or other unplanned ignition, on-site staff will immediately call 9-1-1 and take all reasonable steps to safely attempt to extinguish the fire.
d) WHIS has limited cellular capabilities in various areas of the park, with Verizon the primary accessible cellular network provider. Limited service may be available for T-Mobile, AT&T, or other cellular providers.
Due to poor cell phone coverage in certain areas of the park, each work site shall possess a satellite phone and/or Verizon-network cellular phone for emergency use.
• For “hot work”:
a) All hot work (e.g., welding, cutting, brazing/soldering, grinding) must conform to industry best practices and safety standards.
b) To minimize the potential for accidental ignition from welding, the use of protective welding blankets, wetting down of vegetation or flammable cultural resources (e.g. collar timbering), and/or work in a non-vegetated area may be required.
c) Hot work performed within the Park shall adhere to the stipulations of the approved Fire Prevention Plan, including the following:
i. Hot work is allowed on all dates, except during Red Flag Warnings, Fire Weather Watches, and/or during an ongoing emergency in the Park.
ii. Removal of shrubby vegetation immediately surrounding a mine feature to facilitate safe work distances is authorized. All vegetation must be cut flush to the ground and dispersed at least 25 feet from the mine feature. No vegetation piling is authorized.
iii. If tree felling is required to facilitate a safe work zone, please notify DOC and WHIS for assistance. The Contractor is not authorized to fell trees within WHIS.
E. Additional Stipulations The following additional stipulations are provided by NPS and shall be followed by the Contractor. Any deviations shall be discussed and agreed upon with NPS and the Department.
• Primary access to the project sites is limited to existing roads. Off-road equipment travel and use are prohibited.
• To reduce the risk of introducing invasive plant species, all equipment, tools, and materials shall be washed, free of mud, and inspected by the Contractor prior to transport to each mine site.
• To prevent the introduction or spread of invasive weed species, WHIS requires off-site inspections for large equipment (e.g. toter/track-barrow, ATV, skid steer) before entering the park. Additional large equipment inspections are required before transporting equipment between work sites within the park.
WHIS will provide these inspection services in coordination with the Contractor upon work mobilization.
• Limit vegetation removal and other surface disturbance to the minimum required for project implementation.
• Feeding of wildlife, leaving of food or trash as an attractive nuisance to wildlife, collection of native plants, or harassment of wildlife is prohibited.
• Collection of any natural or historical materials (e.g., plants, seeds, rocks, artifacts) is strictly prohibited.
• All persons involved with the project must follow the most recent version of the National White-Nose Syndrome (WNS) Decontamination Protocol4:
o Before entering WHIS:
All tools, equipment, and clothing will be properly decontaminated (see below).
If the Contractor has previously worked at a WNS-positive site, any clothing or tools used at that site will not be used on this project.
o Before moving between mine sites or demobilizing from a mine site:
Remove dirt/mud from equipment at site.
Change into clean clothing and footwear prior to entering a vehicle.
Contain work clothing in a garbage bag or other container for treatment away from the location.
Spray work boots and hard wearable items (e.g., hard hat, welding helmet) with 50-70% Isopropyl alcohol and let dry for at least 20 seconds.
Wash work clothing with hot water of at least 131 degrees Fahrenheit (55 degrees Celsius) for at least five continuous minutes.

• All motorized project equipment shall be equipped with spark arrestors and mufflers.
• Within WHIS boundary, smoking only is allowed in designated areas (e.g., Visitor Center picnic area, marinas, parking lots) or within a personal vehicle.
• To protect cultural resources, if changes or modifications to the approved hazard mitigation methods become necessary due to unforeseen circumstances during project implementation, all work on that feature shall be stopped, and NPS shall be consulted prior to any deviation from the approved plan.
• All timbers, cribbing, or other features that retain the integrity and are associated with mine adits, shafts, or prospects proposed for remediation by this project shall be left in place and intact unless otherwise directly specified in the task descriptions. If loose artifacts (e.g., individual timbers on the floor inside an adit) must be moved to allow for access and construction, they shall be photographed and returned as closely to their original positions as possible.
• Pets must be kept on a leash no longer than six feet at all times. Pets may never be left unattended. Pet excrement must be collected and disposed of in garbage receptables.
• Any existing fences around mine features shall be removed only immediately prior to remediation work. If construction work is not completed in a single day, protective measures (e.g., reinstalling removed section of fencing, adding temporary construction fencing) to restrict wildlife and human access shall be installed while the job site is unattended, and removed when the work is completed.
• Standard practices, such as the use of containment areas and spill cleaning kits, will be onsite to prevent toxic chemicals, hazardous materials, and other fluids from entering vegetation type streams, washes, and tributary networks through water runoff, erosion, or sediment transport. Contact NPS immediately if any spill occurs.
• All materials, debris, and trash must be removed from site after completion of the installation.
• Project areas and adjacent staging areas shall be returned to approximate original site conditions upon completion of work.
F. Worker Site Hazards Mitigation The Contractor must provide at the site such equipment and medical facilities as are necessary to supply first aid service to anyone who may be injured in connection with the work. The Contractor will be responsible for accident prevention and safety in the performance of all work and will be governed by the requirements of this article in all operations at the work site. The Contractor shall ensure all personnel have appropriate Cal/OSHA trainings and certificates related to the work being performed.
The Contractor must comply with all applicable safety regulations and orders of the State of California, Department of Industrial Relations, Division of Occupational Safety and Health and all applicable provisions of the California Health and Safety Code and will take or cause to be taken such additional measures as may be necessary for the prevention of accidents. The Contractor must impose the foregoing requirements on all subcontractors and enforce compliance therewith.

B. Budget Contingency Clause It is mutually agreed that if the State Budget Act of the current year and/or any subsequent years covered under the Agreement does not appropriate sufficient funds for the program, the Agreement shall be of no further force and effect. In this event, the State shall have no liability to pay any funds whatsoever to the Contractor or to furnish any other considerations under the Agreement and the Contractor shall not be obligated to perform any provisions of the Agreement.
If funding for any fiscal year is reduced or deleted by the Budget Act for purposes of this program, the State shall have the option to either cancel the Agreement with no liability occurring to the State or offer an Agreement amendment to the Contractor to reflect the reduced amount.
C. Prompt Payment Act Payment will be made in accordance with and within the time specified in the California Government Code Chapter 4.5, commencing with Section 927.
D. Federal Funding It is mutually understood between the Contractor and the Department that the Agreement may have been written for the mutual benefit of both parties before ascertaining the availability of congressional appropriation of funds to avoid program and fiscal delays that would occur if the contract were executed after that determination was made.
The Agreement is valid and enforceable only if sufficient funds are made available to the State by the United States Government for the purpose of this project. In addition, the Agreement is subject to any additional restrictions, limitations, or conditions enacted by the Congress or to any statute enacted by the Congress that may affect the provisions, terms, or funding of the contract in any manner.
The Contractor and the Department mutually agree that if the Congress does not appropriate sufficient funds for the program, the contract shall be amended to reflect any reduction in funds.
