The sealed envelope must be clearly marked "BID FOR Condiments - AGREEMENT
NO. 6000001957 Attention: Kevin Arredondo - DO NOT OPEN." Failure to do so may result in the premature opening of, or failure to open, your bid.

All required documents listed in the Bid Submittal Checklist should be included within the sealed bid package. Failure to submit the required documentation may be cause for rejection of your bid.
No bid will be considered unless it is made on the Bid Proposal (Exhibit B) or facsimile and is in conformance with the submission requirements of this IFB.
The bid must be submitted for the entire activity described herein. The State does not accept alternate contract language from a prospective bidder. A bid with such language will be considered a counter proposal and will be rejected.
Additionally, bids may be rejected if the bid proposal shows any alterations of form, additions not called for, a conditioned or incomplete bid, or erasures and/or irregularities of any kind. Any bid amounts changed after the amounts are originally inserted MUST be initialed in ink by the bidder.
Under California Penal Code Section 5005, “the Director (of CDCR) shall specify what commodities shall be sold in the Inmate Canteens.” Items specified in this IFB are non-negotiable. No substitutes will be accepted.
The State is not required to award an Agreement and reserves the right to reject any and all bids and to waive any immaterial deviations in the bid. The State’s waiver of an immaterial deviation shall in no way modify the IFB document or excuse the bidder from full compliance with all requirements if awarded the Agreement.
VII. PUBLIC BID OPENING
If you are planning to attend the public bid opening, you must notify the contact person listed in the cover letter of this IFB at least five (5) working days before the bid opening date specified in Section I – Projected Timetable. At the time of the public bid opening, the dollar amount of each bid shall be read.
The contract award is subject to a complete review of the entire bid proposal for compliance and adherence to the IFB requirements and verification of all calculations.
VIII. DISABLED VETERAN BUSINESS ENTERPRISE (DVBE) PROGRAM
This IFB is exempt from the DVBE requirement. However, the State is committed to achieving legislatively established goals for the participation of DVBEs in all state contracting and seeks to use certified DVBE business whenever possible. Therefore, the State requests your voluntary participation in reporting any certified DVBEs, including yourself, that will be used in the performance of this Agreement.
IX. NONRESPONSIBLE BIDDER
If a previous Agreement with a prospective bidder was terminated for cause, the State reserves the right to hold a responsibility hearing before awarding the Agreement to determine if the bidder is responsible. The bid may be rejected if the State deems, at the conclusion of the responsibility hearing, that the bidder is not responsible.

XII. AGREEMENT EXECUTION
The contract will be executed only upon the State's acceptance of the Contractor's certificates of insurance, licenses and permits when such items are required. Should the Contractor fail to commence work at the agreed-upon date and time, CDCR, upon five (5) days written notice to the Contractor, reserves the right to terminate the Agreement.
The successful bidder shall enter into a contract with CDCR, which will be prepared on a State of California Standard Agreement (STD 213 form, sample attached), and shall include from this IFB Exhibits A, B, B-1, C, D, E, F, and G.
The Agreement will not include a hard copy of the Contractor Certification Clauses (CCC). The CCC may be downloaded from the Internet at http://www.documents.dgs.ca.gov/ols/CCC-307.doc and printed for your files. An original, signed copy of all pages of the CCC must be submitted to CDCR.

If the Contractor fails to notify CDCR at least 30 days prior to the brand, size or packaging becoming unavailable, CDCR reserves the right to cancel the contract.
At no time will CDCR pay more than the original contract price for a substituted brand, size or packaging.
Should the Contractor recommend a brand, size or packaging substitution that has a lower manufacturer’s list price, the Contractor shall provide the substituted brand, size or packaging at a correspondingly lower contract mailto:Charlotte.Enriquez@cdcr.ca.gov
California Department of Corrections and Rehabilitation (CDCR) Exhibit A price. Should the Contractor recommend a brand, size or packaging substitution that has a higher manufacturer’s list price, the Contractor shall provide the brand, size or packaging at the original contract price.
All products and/or cases MUST be date stamped to meet industry standards and have a shelf life of at least
(6) six months. All products or multi-packs MUST be individually bar coded. Bar codes CANNOT be changed without notifying the Inmate Accounting Branch (IAB) in writing at the address above. Notification must occur at least 30 days prior to the bar code change. Failure to notify may result in lengthy delays in payment without penalty to the State.
It is the Contractor’s responsibility to hire or contract for carriers who will maintain a fleet of trucks that can pass a vehicle inspection and employ drivers who can pass a California Law Enforcement Telecommunications (CLETS) check. All Contractor personnel (including any subcontractors) MUST receive security clearances from the institution by providing the full names of all personnel, their dates of birth, driver’s license numbers, and social security numbers. Gate clearance policies vary from institution to institution; however, a minimum of ten (10) working days’ notice MUST be given to each institution.
At the time of bid opening, the bidder must have met all of the following minimum qualifications: have been in business for a minimum of two (2) years, have at least one (1) year of experience selling and providing post-purchase service to accounts with requirements similar to CDCR, have sold and delivered over $15,000 in one individual sale to the State of California or to an account with requirements similar to those of CDCR, and have provided a resume that illustrates the minimum qualifications required (as above) with a contact person(s) name and telephone number for verification. Failure to meet these minimum requirements will be grounds for bid rejection.
D. ORDERS
Each individual institution will place orders directly with the Contractor. An order, which is a minimum of five
(5) cases, may be placed by telephone by institution staff. A written confirmation order to the Contractor will immediately follow on a Std. 65, Contract/Delegation Purchase Order. The Contractor MUST confirm each order by fax or Email within 24 hours of receipt of the telephone order. Institution Information, Exhibit E, lists each institution’s shipping address, billing address, receiving hours, telephone numbers and fax numbers.
The Contractor MUST deliver the commodity within six (6) working days after receipt of the order. If the
Contractor is unable to fill the order within six (6) working days, CDCR reserves the right to purchase the commodity outside the contract from another vendor and shall be reimbursed by the Contractor for any additional costs above the contract price.
Institutions may request that orders be shipped in their entirety rather than in multiple shipments. Institutions not wanting multiple shipments may stipulate on the purchase order “NO PARTIAL SHIPMENTS
ACCEPTED.” Purchase orders stating such must be shipped in their entirety within six (6) working days after receipt of the order.
In accordance with the Interstate Commerce Commission (ICC) standards, CDCR reserves the right not to accept orders that are damaged (hidden or concealed). The Contractor has six (6) working days from receipt of verbal or written notification of damage to replace the commodity. Failure to do so shall result in CDCR exercising its authority and right to purchase the commodity from another Contractor.
California Department of Corrections and Rehabilitation (CDCR) Exhibit A
E. PACKAGING
The exterior packaging MUST show the contents and the purchase order number. All packaging is to conform to the applicable freight classifications, ICC and/or postal regulations and is to be of a quality to assure final delivery without damage to the contents. All packages must be sealed or shrink-wrapped to ensure the package contents are intact.
F. DELIVERY
The Contractor MUST be able to provide, if needed, delivery trucks with lift gates and any other equipment required for the delivery of orders including pallet jacks. The Contractor must use size 48 x 40 four-way hardwood pallets that are compatible with pallet jacks. The CDCR WILL NOT provide exchange pallets for the deliverer.
All deliveries shall be made during normal working days, Monday through Friday excluding State holidays, and during the hours listed on Exhibit E.
Some deliveries will be made outside the perimeter fence of the institution and some inside. There could be significant delays while entering and exiting the Institution. All deliveries as well as all vehicular traffic entering or leaving the institution shall be subject to inspection by the institutional staff. The Contractor should be prepared to schedule deliveries with sufficient time in the event that the carrier is delayed at the institution.
Any costs associated with checking employees and/or vehicles in and out of the institution or the inspection of deliveries shall be borne by the Contractor.
G. CONTRACT EVALUATION
The CDCR will perform an ongoing evaluation of the Contractor’s compliance with all requirements specified in the contract. The evaluation criteria shall include, but is not limited to, problems encountered during the contract, future performance and any other subjects relating to the ordering, packaging, delivery, etc.
