About this file

This is a Sole Source Request and Determination Form submitted by Eastern New Mexico University – Roswell (ENMU-Roswell) to the State of New Mexico for the procurement of American Heart Association (AHA) training materials, certification eCards, and instructional resources. The university seeks to maintain its AHA-approved training program, which delivers Basic Life Support (BLS), Heartsaver CPR/AED, First Aid, and other authorized AHA training courses to university employees, students, healthcare program participants, and community members. The scope of services includes certification cards (BLS Provider eCards, Heartsaver CPR/AED eCards, First Aid eCards, and combined eCards), training materials (student workbooks, instructor manuals, course videos, and digital learning resources), and program support services including access to AHA curriculum updates and the electronic certification card issuance system. The contract term extends through June 30, 2027, with no renewal options specified in the document.

The prospective contractor is the American Heart Association (AHA), located at the National Center, 7272 Greenville Ave, Dallas, TX 75231, with a contract value of $200,000 before tax and an exempt tax status. ENMU-Roswell conducted due diligence by reviewing alternative CPR and First Aid certification providers, including the American Red Cross and other training organizations, and determined that only authorized AHA Training Centers and affiliated instructors are permitted to purchase official AHA course materials and issue AHA certification cards. The sole source justification rests on AHA's exclusive ownership and distribution rights for its proprietary curriculum, materials, instructor resources, and certification credentials, making no other vendor capable of providing official AHA-branded certification materials and services. The document requires approval from the State Purchasing Agent following a thirty-day posting period without protest.

2026 Sole Source Form

VII. Provide a detailed explanation of the criteria developed and specified by the agency as necessary to perform and/or fulfill the contract and upon which the state agency reviewed available sources. (Do not use “technical jargon;” use plain English. Do not tailor the criteria simply to exclude other contractors if it is not rationally related to the purpose of the contract.)

For many years, ENMU–Roswell has maintained an employee who is an authorized AHA instructor and has successfully delivered BLS, CPR, and First Aid training to university personnel and community members. Continuation of the AHA training program ensures consistency in training standards, certification recognition, and compliance with healthcare industry and employer requirements.

The American Heart Association is the nationally recognized source for BLS, CPR, AED, and

First Aid certification programs utilized by healthcare organizations, educational institutions, emergency responders, and employers throughout the United States. AHA certification cards and training materials are proprietary and cannot be substituted with equivalent products from other vendors when AHA certification is specifically required. Successful course completion results in an official AHA certification card issued through the AHA Training Center system.

VIII. Provide a detailed, sufficient explanation of the reasons, qualifications, proprietary rights or unique capabilities of the prospective contractor that makes their company the only source capable of providing the required professional service, general service, construction or item(s) of tangible personal property. (Please do not state the source is the “best” source or the “least costly” source. Those factors do not justify a “sole source.”)

This procurement qualifies as a sole source pursuant to the New Mexico Procurement Code because the American Heart Association maintains exclusive ownership, control, and distribution rights for its curriculum, course materials, instructor resources, and certification credentials.

AHA course completion cards and eCards may only be issued through authorized AHA Training

Centers and affiliated instructors. No other vendor is authorized to reproduce, distribute, or issue official AHA certification materials or cards.

Additionally, AHA certification cards are restricted to authorized Training Centers and instructors operating under the AHA training network. The university's instructor must utilize official AHA materials and certification systems to maintain instructor status and issue valid certifications recognized by healthcare employers, regulatory agencies, and industry partners.

IX. Provide a detailed, sufficient explanation of how the professional service, general service, construction or item(s) of tangible personal property is/are unique and how this uniqueness is substantially related to the intended purpose of the contract.

No other supplier can provide official AHA-branded certification cards, instructor materials, course rosters, or certification management services. Any alternate certification provider would result in a different certification standard and would not satisfy requirements where AHA certification is specifically requested or required.

X. Provide a narrative description of the agency’s due diligence in determining the basis for the procurement, including procedures used by the agency to conduct a review of available sources such as researching trade publications, industry newsletters and the internet;;

contacting similar service providers; and reviewing the State Purchasing Divisions’

Statewide Price Agreements. Include a list of businesses contacted (do not state that no other businesses were contacted), date of contact, method of contact (telephone, mail, e-mail, other), and documentation demonstrating an explanation of why those businesses could not or would not, under any circumstances, perform the contract; or an explanation of why the agency has determined that no businesses other than the prospective contractor can perform the contract.

ENMU–Roswell reviewed alternative CPR and First Aid certification providers, including the

American Red Cross and other training organizations. While other certification programs exist, they are separate proprietary programs and cannot provide official American Heart Association certifications. Research conducted through AHA training documentation confirms that only authorized AHA Training Centers and affiliated instructors may purchase official course materials and issue AHA certification cards.

Based on this review, no other vendor is capable of supplying official AHA certification materials and credentials required to maintain the University's existing AHA training program.

Agency certifies this sole source submission complies with NMSA 1978, Sections 13-1-28 through 13-1-199, the New Mexico Administrative Code (NMAC) and Governmental Conduct
