About this file

This document is a Sole Source Justification Letter from the Village of Los Lunas Wastewater Division to the State of New Mexico General Services Department, involving SNF Polydyne Inc. as the sole source vendor for a specific liquid cationic polymer (CLARIFLOC C-6286) used in wastewater treatment plant sludge dewatering operations. The procurement is for a specialized polymer product to be used with the facility's dewatering equipment, with the goal of achieving optimal solids capture, maintaining regulatory discharge standards, and ensuring consistent sludge handling performance.

The pricing for the product is $1.76 per pound, with a proposed purchase of four 2,300-pound totes totaling $16,192.00, delivered directly to the facility. The justification for sole source procurement is based on the polymer's unique molecular structure, technical compatibility with existing equipment, proprietary formulation, and proven performance history. The Village of Los Lunas argues that switching to alternative products would require extensive re-testing, potentially disrupt operational processes, and risk non-compliance with regulatory standards. The procurement is being pursued under the State of New Mexico Procurement Code (NMSA 1978, 13-1-126) for a sole-source acquisition.

Subject: Sole Source Justification Procurement Type: Sole Source Vendor: SNF Polydyne Inc.

Address: 1 Chemical Plant Road, Riceboro, GA 31323

I. Purpose This memorandum serves as justification for a sole-source procurement under the State of New Mexico Procurement Code (NMSA 1978, §13-1-126) for the continued purchase of sludge polymer used in the dewatering operations at the Village of Los Lunas Wastewater Treatment Plant.

II. Description of Procurement The Village of Los Lunas Wastewater Division requires a reliable supply of liquid cationic polymer for sludge conditioning and dewatering. The polymer is used in conjunction with the facility’s [centrifuge or belt filter press – specify as appropriate] to achieve optimal solids capture and sludge cake dryness while maintaining regulatory discharge standards.

The polymer product in use is manufactured and supplied exclusively by SNF Polydyne Inc.

III. Sole Source Justification

1. Technical Compatibility and Performance

• The SNF Polydyne polymer has been specifically optimized and tested for compatibility with the Village’s existing sludge characteristics, dewatering equipment, and process configuration.

Wastewater Treatment Plant Division

• Polymer performance is unique and non-transferable switching brands would require extensive re-testing, recalibration of feed systems, and potential process upsets.

• The current polymer has demonstrated superior solids capture efficiency, reduced polymer dosage rates, and improved dewatering consistency compared to previously tested products.

2. Operational Reliability

• Consistent performance from SNF Polydyne polymer ensures uninterrupted sludge handling and compliance with discharge and biosolids regulations.

• Deviating from this product could result in increased polymer consumption, poor sludge quality, or equipment fouling, leading to higher operating costs and potential permit violations.

3. Proprietary Product

• SNF Polydyne polymers are proprietary formulations not available through alternative manufacturers or distributors.

• The specific polymer currently used at the Los Lunas Wastewater Treatment Plant is only available directly through SNF Polydyne Inc.

4. Past Performance and Support

• SNF Polydyne has provided reliable technical and delivery support to the Village for multiple years, ensuring product availability, training, and emergency response when needed.

• The company’s technical staff is familiar with the Village’s plant operations and has assisted in optimizing polymer usage, resulting in measurable cost and efficiency improvements.

IV. Market Context and Rationale The Village of Los Lunas Wastewater Division recognizes that there are multiple polymer suppliers in the industry. However, based on the Village’s extensive operational experience and the proven effectiveness of SNF Polydyne’ s products, no further testing or market assessment has been necessary at this time. SNF Polydyne’ s polymer has consistently shown reliable performance, a stable supply, and compatibility with the Village’s specific treatment processes and equipment. Switching products would require extensive process re-testing and could jeopardize performance stability. Considering this consistent, satisfactory performance and the importance of sludge dewatering operations, it is in the Village’s best interest to continue procuring from SNF Polydyne to ensure operational consistency and regulatory compliance.

V. Determination Based on the information provided, SNF Polydyne Inc. is the only known source capable of providing the required polymer formulation that meets the performance, reliability, and compatibility standards for the Village of Los Lunas Wastewater Treatment Plant.

Therefore, pursuant to NMSA 1978, §13-1-126 (Sole Source Procurements) and 1.4.1.7 NMAC, it is determined that procurement through any other source is not feasible or practical at this time.
