About this file

This is a Sole Source Procurement Justification document submitted by the Legal Department of Doña Ana County, New Mexico, for Legal Consultation and Representation Services. The county is seeking to engage Kennon Law Firm to provide comprehensive legal services across multiple practice areas including administrative law, contract law, criminal law, employment law, litigation assistance, statutory guidance, land use law, codes enforcement, property tax administration and enforcement, and election law. The scope of services encompasses direct legal consultation and representation to county personnel and the Board of County Commissioners, with meetings to be conducted in person or electronically as mutually agreed. Additionally, the firm will provide training sessions to county personnel as requested during the agreement term. The document does not specify a defined contract term end date, though it references the vendor's prior engagement from January 1, 2026, through June 30, 2026.

Kennon Law Firm's pricing structure includes an hourly rate of $125.00 for Fred Kennon's legal services, travel and mileage reimbursement at the county's established rates, New Mexico State Bar dues reimbursement not to exceed $550.00, and continuing education costs not to exceed $2,000.00 to satisfy state bar requirements. The sole source justification is based on Fred Kennon's unique expertise and specialized familiarity with Doña Ana County's operations, objectives, and issues developed through prior professional services engagement with the county. The county asserts that engaging an alternative entity would result in substantial service duplication, operational inefficiencies, and unnecessary public expenditure. No formal competitive research documentation is provided to support the sole source determination.
