About this file

This is a Sole Source Determination Form submitted by the New Mexico Public Education Department (PED) for a contract with the Council of Chief State School Officers (CCSSO), a nationwide nonpartisan nonprofit organization. The PED seeks to procure membership and services from CCSSO for three educational collaboratives: the Chief Academic Officer/Chief Talent Officer (CAO/CTO) Collaborative with three memberships, the Systems to Elevate Excellent Teaching (SEET) Collaborative with one membership, and the School Leadership Development and Supports (SLDS) Collaborative with one membership. These collaboratives provide infrastructure, staff support, meeting logistics, and leadership development for senior cabinet-level education officials and support state policy development in educator effectiveness, teaching workforce recruitment and retention, and school leadership strategies. The contract term extends from sole source execution through June 30, 2027, with the contract value set at $234,548.00 before tax.

The PED determined CCSSO as the sole source capable of fulfilling the contract requirements based on seven specified criteria, including that the organization must be a national membership organization of all state chief school officers, provide formal collaboration structures, offer access to professional learning communities and multi-state research capabilities, support national education policy participation, and maintain established infrastructure for coordinating multi-state initiatives. The PED concluded that no other entity possesses membership of all fifty state education chief officers and U.S. territories necessary to meet the agency's needs for federal policymaking participation, national resource access, and maintaining competitive educational leadership across states. The sole source determination requires a thirty-day posting period without protest before final approval by the State Purchasing Agent.

The Council of Chief State School Officers (CCSSO) is a nonpartisan, nationwide, nonprofit organization of public officials who head departments of elementary and

CCSSO provides leadership, advocacy, and technical assistance on major educational issues. The Council seeks member consensus on major educational issues and expresses their views to civic and professional organizations, federal agencies, Congress, and the public. CCSSO is the sole vendor for the following collaboratives:

1) The Chief Academic Officer/Chief Talent Officer (CAO/CTO) Collaborative. The

CAO/CTO Collaborative is reserved for senior, cabinet-level staff that oversee departments focused on talent, educator effectiveness, and standards and academics. The CAO/CTO Collaborative members lead the creation of policies in their states that improve teacher practice and leader capacity to support high-quality instruction aligned to college and career-ready standards. The CAO/CTO Collaborative supports states as they enhance their assessment, accountability, and curriculum and instruction systems to provide equity and inclusion for students with disabilities. New Mexico has three memberships in the CAO/CTO Collaborative.

2) The Systems to Elevate Excellent Teaching (SEET) Collaborative. The SEET Collaborative explores how states can establish and institutionalize structures that recruit and retain a high-quality, diverse, teaching workforce, as well as vehicles for teachers to meaningfully influence policy, strengthen instructional practice, elevate the teaching profession, and change the experience of teachers. New Mexico has one membership in the SEET Collaborative.

3) The School Leadership Development and Supports (SLDS) Collaborative. The

SLDS Collaborative assists states as they advance and implement school leadership workforce strategies to ensure that reliable and quality leadership guides students on every step of their journey through the education system. New Mexico has one membership in the SLDS Collaborative.

VI. Provide a detailed explanation of the criteria developed and specified by the agency as necessary to perform and/or fulfill the contract and upon which the state agency reviewed available sources. (Do not use “technical jargon;” use plain English. Do not tailor the criteria simply to exclude other contractors if it is not rationally related to the purpose of the contract.)

The CCSSO infrastructure and staff support meeting logistics and leadership, as well as providing the State Collaborative on Assessment and Student Standards (SCASS) with a budget to fund related research projects, leverage state resources, and create professional development products for member use. CCSSO is a nationwide, nonpartisan, and nonprofit membership organization. The only one of its kind to bring together the top education leaders across the nation.

The criteria developed and specified by the PED as necessary to perform or fulfill the contract upon which the PED reviewed available resources is established over the

Docusign Envelope ID: 77AEDE1B-DDA8-8B4E-8095-C7D994734148Docusign Envelope ID: 1A4179D6-928A-83BC-83DC-708B7035E634 years, and it involves the PED as a State Educational Agency needing to seek and access an entity that would be able to allow access to resources with educational leadership statewide, a network that involves all the state’s chief educational officers, and the ability to participate in federal policymaking. These efforts and agency necessity also allows the PED to remain even and competitive with other states in terms of quality in leadership provided to the State, in access to resources, in professional development and remaining part of a critical network, in terms of being able to continue to maintain the foundation for continued leadership to the State, and in terms of having a voice regarding education nationwide. The entity, and its collaboratives, is needed as an expectation for the PED in its role as a State Educational Agency providing educational services for students and families statewide.

The PED identified the following criteria as necessary to fulfill the purpose of this contract and used these criteria when reviewing available sources:

1. The organization must be a national organization whose membership includes the chief state school officers or equivalent leaders from all states and territories.

2. The organization must provide a formal structure for collaboration among state education agencies on educational leadership, policy development, and implementation of federal and state education initiatives.

3. The organization must provide access to established professional learning communities, workgroups, and collaboratives focused on assessment, academic standards, accountability, educator effectiveness, and other key responsibilities of state education agencies.

4. The organization must support state participation in national education policy discussions and provide opportunities for states to share best practices, research, and innovative approaches to improving student outcomes.

5. The organization must have the capacity to conduct, coordinate, or support multi-state research projects and develop resources, guidance documents, and professional development materials for member states.

6. The organization must provide the administrative infrastructure, staffing, and meeting support necessary to coordinate national and multi-state initiatives involving state education agencies.

7. The organization must have an established history of serving state education agencies and maintaining a nationwide network that enables direct communication and collaboration among state education leaders.

Based on these criteria, PED determined that the CCSSO is the only organization that meets all identified requirements. CCSSO is a national, nonpartisan, nonprofit membership organization composed of the chief education leaders from every state. Through its established network, professional collaboratives, research activities, policy engagement opportunities, and leadership support services, CCSSO provides the resources and statewide educational leadership connections necessary for PED to effectively fulfill its responsibilities

VII. Provide a detailed, sufficient explanation of the reasons, qualifications, proprietary rights or unique capabilities of the prospective contractor that makes their company the only source capable of providing the required professional service, general service, construction or item(s) of tangible personal property. (Please do not state the source is the “best” source or the “least costly” source. Those factors do not justify a “sole source.”)

CCSSO is unique in that it represents membership of the chief education officer from every state in the nation. CCSSO provides consensus on federal education matters before the Administration, Congress, and the U.S. Department of Education. CCSSO provides chief state school officers the opportunity to collaborate to solve shared problems, engage in professional development and determine priorities for collective state action.

VIII. Provide a detailed, sufficient explanation of how the professional service, general service, construction or item(s) of tangible personal property is/are unique and how this uniqueness is substantially related to the intended purpose of the contract.

CCSSO is a nationwide membership that focuses on ambitious reforms to prepare the next generation of learners for lifelong learning, meaningful work, and citizenship.

The CCSSO is the only membership of its kind in the nation.

IX. Provide a narrative description of the agency’s due diligence in determining the basis for the procurement, including procedures used by the agency to conduct a review of available sources such as researching trade publications, industry newsletters and the internet;;

contacting similar service providers; and reviewing the State Purchasing Divisions’ Statewide Price Agreements. Include a list of businesses contacted (do not state that no other businesses were contacted), date of contact, method of contact (telephone, mail, e-mail, other), and documentation demonstrating an explanation of why those businesses could not or would not, under any circumstances, perform the contract; or an explanation of why the agency has determined that no businesses other than the prospective contractor can perform the contract.

There are no other service providers with membership of all state education chief officers that serve the entire fifty (50) states and US territories. As the CCSO is the only entity with membership of all state education chief officers that serve the entire fifty states and US territories, no other entity could fulfill the needs of the agency.

Access to these resources, network, and ability to participate in this level for federal policymaking is a requirement, and the PED has familiarized itself with the other existing associations and organizations and has ascertained that there is no other source available to provide these services.
