About this file

This is a Sole Source Determination Form submitted by the New Mexico Department of Public Safety for the procurement of an Automated Thermal Inspection System (ATIS) to be installed at the Texico Port of Entry. The system will integrate with the existing Smart Roadside Inspection Systems (SRIS) currently operated by the New Mexico State Police Commercial Vehicle Enforcement division. The contract is proposed for a 12-month term with Drivewyze as the sole source contractor. The scope of work includes the purchase and installation of the ATIS hardware and software, along with ongoing operations and maintenance support for the unified SRIS system to ensure continuity of critical public safety inspection capabilities at the port of entry.

The prospective contract value is $279,990.00 before tax with no estimated tax amount. Drivewyze, located in Edmonton, Alberta, Canada, is identified as the sole capable source due to proprietary compatibility requirements with the existing SRIS platform installed in 2009. The agency asserts that only Drivewyze software can directly communicate and integrate with the existing SRIS system without requiring complete system replacement or substantial modification. The determination cites the need for specialized knowledge, proprietary system access, and integration of the Thermal Inspection System alongside existing components including an Automated License Plate Reader, Hazmat Placard Identification System, CVSA Safety Sticker Recognition, Advanced Lane Controllers, and Vehicle Waveform Identification capabilities. The sole source request was posted for the required 30-calendar-day protest period and received approvals from the Agency Chief Procurement Officer, Agency Legal/General Counsel, Cabinet Secretary, and State Purchasing Agent on May 5, 2026.

III. Agency is required to provide the detailed scope of work (or amendment) for this sole source. Scope of work must match the scope included in the services determination and

Horizons declination.

To purchase and install the Automated Thermal Inspection System (ATIS) to be used in conjunction with the Smart Roadside Inspection Systems (SRIS) for the Department of

Public Safety (DPS), New Mexico State Police (NMSP), Commercial Vehicle

Enforcement (CVE) at the Texico Port of Entry.

IV. Provide a detailed explanation of the criteria developed and specified by the agency as necessary to perform and/or fulfill the contract and upon which the state agency reviewed available sources. (Do not use “technical jargon;” use plain English. Do not tailor the criteria simply to exclude other contractors if it is not rationally related to the purpose of the contract.)

The following criteria reflect the agency’s minimum needs to support and expand an existing mission-critical system.

• The contractor must have knowledge of the proprietary (SRIS) software installed in

2009 to ensure effective support of the current system.

• The contractor must provide software that is fully compatible with SRIS. Only

Drivewyze software is currently capable of directly communicating with this system, which is necessary to maintain functionality and avoid disruption.

• The contractor must provide ongoing operations and maintenance for the unified SRIS system to ensure continuity of critical public safety services.

• The contractor must supply and install an Automated Thermal Inspection System that integrates with SRIS to expand inspection capabilities at the Texico Port of Entry.

V. Provide a detailed, sufficient explanation of the reasons, qualifications, proprietary rights or unique capabilities of the prospective contractor that makes their company the only source capable of providing the required professional service, general service, construction or item(s) of tangible personal property. (Please do not state the source is the “best” source or the “least costly” source. Those factors do not justify a “sole source.”)

Drivewyze is the is the only source capable of providing the required services due to its unique technical capabilities and proprietary control over the software required to operate the existing system. The SRIS system currently in use is a proprietary system that requires specialized knowledge and access to support, maintain, and expand its functionality.

Drivewyze, is the only provider with software that can directly communicate and integrate with the existing SRIS platform. This exclusive compatibility is necessary to ensure continued system operation and prevent service disruption.

In addition, Drivewyze has the unique capability to provide and install an Automated

Thermal Inspection System that integrates seamlessly with SRIS. No other vendor can provide this level of integration without requiring replacement or substantial modification of the existing system.

Because of these proprietary rights and system compatibility requirements, no other vendor is reasonably available to provide the required services without creating significant operational risk, service interruption, or additional cost to the State of New Mexico.

Therefore, Drivewyze is the only source capable of meeting the agency’s needs.

VI. Provide a detailed, sufficient explanation of how the professional service, general service, construction or item(s) of tangible personal property is/are unique and how this uniqueness is substantially related to the intended purpose of the contract.

The services and equipment required under this sole source project are unique because they must function within, and directly integrate with, the existing SRIS platform currently deployed by DPS. SRIS is a proprietary system with specific technical requirements that limit compatibility with external software and hardware.

The required software is unique in that it must be capable of directly communicating with

SRIS to support real-time roadside inspection operations. At present, only one provider offers this level of compatibility. In addition, the Automated Thermal Inspection System to be procured must integrate seamlessly with SRIS to enhance inspection capabilities without disrupting current operations.

This uniqueness is substantially related to the purpose of this contract, which is to maintain continuous, reliable public safety operations while expanding inspection capabilities at the

Texico Port of Entry. Any alternative solution would require replacement or significant modification of the existing SRIS system, resulting in operational disruption, increased risk, and additional cost to the State of New Mexico.

VII. Provide a narrative description of the agency’s due diligence in determining the basis for the procurement, including procedures used by the agency to conduct a review of available sources such as researching trade publications, industry newsletters and the internet;;

contacting similar service providers; and reviewing the State Purchasing Divisions’

Statewide Price Agreements. Include a list of businesses contacted (do not state that no other businesses were contacted), date of contact, method of contact (telephone, mail, e-mail, other), and documentation demonstrating an explanation of why those businesses could not or would not, under any circumstances, perform the contract; or an explanation of why the agency has determined that no businesses other than the prospective contractor can perform the contract.

No other available solution can meet DPS requirements without significant customization, or without introducing risk to continuity of a critical public safety function. Each possible alternative uses different proprietary content and algorithms that would require integration into a suite of authoritative data sources and equipment including a Thermal Inspection

System, Automated License Plate Reader, Hazmat Placard Identification System (HPIS), CVSA Safety Sticker Recognition (SSR), Advanced Lane Controllers, and Vehicle

Waveform Identification (VWI).
