About this file
This is a New Mexico State Emergency Determination Form for an emergency procurement involving the New Mexico Environment Department (NMED), Burns & McDonnell Engineering Inc., and the City of Las Vegas. The emergency contract is for preliminary engineering services to plan, design, and prepare for procuring equipment and developing interim and long-term solutions for drinking water infrastructure following the Hermits Peak/Calf Canyon Fire. The contract is valued at not to exceed $20,000,000, with a six-month term, focusing on creating a functional, compliant, and sustainable drinking water system for Las Vegas. The scope includes preliminary engineering, conceptual design, regulatory compliance, water quality analysis, alternatives analysis, and 30% design documentation.
The emergency procurement is justified by repeated post-fire flooding that has compromised the city's water treatment infrastructure, posing significant public health risks. The State of New Mexico entered an Intergovernmental Agreement (IGA) to assume responsibility for planning and delivering water treatment facilities after the City of Las Vegas demonstrated inability to progress effectively. Funding will come from state sources, with potential involvement of FEMA funds. Burns & McDonnell will be reimbursed via an accompanying rate sheet, with hourly professional service billing rates ranging from $82 to $335 per hour. The emergency procurement is specifically limited to planning and design services, with future equipment procurement and construction to be handled through separate procurement processes.

d. State of NM retains with sole responsibility to comply with IGA Intergovernmental
Agreement No. 25-667-4000-0001 (IGA), as the IGA is not part of this agreement.
IV. Provide an explanation for the justification of the procurement including a description of the emergency condition(s) requiring use of emergency procurement and the practicable competition utilized in compliance with NMSA 1978, Section 13-1-127.
Continued post-fire flooding during heavy rainfall events has repeatedly overwhelmed the City of Las Vegas’ existing water treatment infrastructure, resulting in system failures and persistent risks to the safety of the municipal water supply. These risks are ongoing and affect the health and welfare of thousands of Las Vegas residents daily. The existing system’s unreliability poses an imminent threat, particularly to vulnerable populations who depend on consistent access to clean and safe drinking water.
The Hermit’s Peak and Calf Canyon fires of 2022 was the largest wildfire event in New Mexico’s recorded history, and caused catastrophic damage to natural infrastructure critical to the City of Las Vegas’ water supply. These fires have been followed by significant and repeated post-fire flooding, which severely impacts the City’s ability to provide safe and reliable drinking water to its residents. Despite the availability of Federal Emergency Management Agency (FEMA) funding, progress on implementing permanent solutions through the City has been either nonexistent or unacceptably slow in the years since the disaster.
To address this continued public health emergency, the State of New Mexico (through a coordinated effort by the Department of Finance and Administration, Department of Homeland Security and Emergency Management, and the New Mexico Environment Department (NMED)) entered into an IGA with the City of Las Vegas. The IGA enables the State to assume responsibility for planning, designing, procuring, constructing, and delivering both temporary and permanent water treatment facilities, and to bring these projects to closure in an expedited and coordinated manner. As set forth in the IGA, the City acknowledges that the State must take over implementation of these critical projects due to ongoing threats to public health and the City’s inability to do so in a timely and effective way.
The IGA was finalized in June and calls for immediate mobilization by the State to mitigate these public health threats. Given the urgency of the situation and the daily risk to residents, there is insufficient time to initiate and complete a traditional, non-emergency procurement process.
Immediately after the IGA was executed, NMED procured project management services from the Plexos Group LLC to implement the IGA. Plexos is on-site, has reviewed all prior planning work done by the City of Las Vegas, and is currently performing source-water and treated-water sampling and analysis to finalize required treatment methodologies for a new water treatment plant. Additional activities such as storm water run-off planning are currently underway.
With that support, we have determined that a fully qualified design-build (“D/B”) firm is needed to deliver the new water treatment plant. Due to New Mexico law, Plexos is prohibited from either performing the permanent design work directly or subcontracting a qualified general contractor to build the plant. The option of creating a joint-venture to obtain D/B services was fully explored. Under New Mexico law, all joint-venture partners must be fully licensed to perform all scopes (design and construction). This requirement is prohibitive of Plexos’ entry into a joint venture for D/B services.
The option of GSA to State Purchasing Agreement was also explored. Qualified firms that are on a GSA schedule could have their GSA schedules adopted by the State of New Mexico via a State Price Agreement. Industry-leading firms were gauged for interest, and their GSA schedules researched to ensure compliance. This proved to be a non-viable option for numerous reasons. Most firms did not have applicable GSA schedules for this scope of work, while other firms simply refused to work from a GSA schedule.
Additionally, many firms are getting away from GSA contract vehicles and letting them lapse due to lack of a strong business case to continue performing under them.
Therefore, emergency procurement is necessary for NMED to immediately engage a qualified contractor to plan and design interim and long-term solutions to stabilize and secure the City’s water supply. The existing system’s unreliability poses an imminent threat, particularly to vulnerable populations who depend on consistent access to clean and safe drinking water. Given the urgency of need for the residents of the City of Las Vegas and the State of New Mexico, an Emergency Procurement is needed. This emergency procurement is essential to expedite the design and construction of the new system to protect public health and welfare, prevent further degradation of critical infrastructure, and fulfill the State’s obligation under the IGA to act without delay.
V. Describe what measures are being taken to minimize the duration and effect of this particular emergency procurement (for example: is the emergency only in place until a competitive process can be completed, etc.).
While this emergency procurement is necessary to immediately mobilize the effort to implement the above defined scope, it is limited to planning and design and preconstruction services. Equipment Procurement Awards and Project Construction require a separate procurement vehicle.
VI. Describe what measures the Agency will take in the future to prevent/mitigate use of an emergency procurement under similar circumstances.
NMED is establishing a new bureau to focus on emergency responses. This will help the Department proactively coordinate with local governments, the Department of Homeland Security and Emergency Management, the Department of Finance and Administration, and federal agencies such as FEMA at the earliest stages of disaster response and recovery. By initiating planning discussions and technical assessments promptly after a disaster, NMED can help identify potential infrastructure vulnerabilities before they escalate into public health emergencies. NMED will work with communities to develop and update comprehensive emergency response and continuity-of-operations plans for drinking water and wastewater systems, with an emphasis on identifying interim treatment solutions and pre-approved contractor pools that can be activated quickly but within standard procurement processes.
