The contractor is responsible for any damage to public or private property caused by equipment use. The City assumes no liability for lost hauling time except when City-owned equipment experiences mechanical failure exceeding one hour. After a 12-hour notice of City equipment repairs, the City shall not be liable for further payment until repairs are completed.
